<p>Consequent upon acceptance of the recommendations of the <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">Seventh (7th) Central Pay Commission</a>, instructions issued by DOP&amp;T vide their O.M. No. 2/11/2017-Estt.(Pay-II) dated 24.11.2017 amending the rate of Deputation (Duty) Allowance and the related conditions have been adopted &amp; circulated on Railways vide Board’s letter No.F(E)I/2017/DE/1/2 dated 26.12.2017.</p>



<p>2. Now, DOP&amp;T, vide their O.M. No. 2/11/2017-Estt.(Pay-II) dated 15.03.2021 has issued some clarification regarding admissibility of Deputation (Duty) Allowance in terms of Note-2 &amp; Note-3 below para-4(d) of OM dated 24.11.2017. These instructions shall apply mutatis-mutandis to Railway employees also.</p>



<p>3. A copy of these instructions is sent herewith for information/guidance, which shall take effect from 1st July, 2017.</p>

<p><strong>Subject; Grant of Deputation (Duty) Allowance in cases where the basic pay in parent cadre has been upgraded on account of NFU, MACP, NFSG, etc. in the 7th CPC context &#8211; clarification regarding.</strong></p>



<p>The undersigned is directed to refer to this Department’s OM of even number dated 24th November, 2017 regarding grant of Deputation (Duty) Allowance in the 7th CPC context, and to say that this Department has been receiving references from various Ministries/ Departments/ Organizations for clarifications regarding admissibility of Deputation (Duty) Allowance in terms of Note 2 and Note 3 below para 4(d) of this Department’s OM dated 24th November, 2017 in cases-where the basic pay in parent cadre has been upgraded on account of NFU, MACP, NFSG, etc. in the 7th CPC context.</p>



<p>2. Note 2 and Note 3 of the para 4(d) of this Department’s OM dated 24th November, 2017 are as follows:-</p>



<ul class="wp-block-list"><li>‘<strong>Note 2</strong> In cases where the basic pay in parent cadre has been upgraded on account of Nonfunctional upgradation (NFU), Modified Assured Career Progression Scheme (MACP), Non Functional Selection Grade (NFSG), etc., the upgraded basic pay under such upgradations shall not be taken into account for the purpose of Deputation (Duty) Allowance.</li><li><strong>Note 3</strong> In the case of a Proforma Promotion under Next Below Rule(NBR): If such a Proforma Promotion is in a Level of the Pap Matrix which is higher than that of the ex-cadre post, the basic pay under such Profoma Promotion shall not be taken into account for the purpose of Deputation (Duty) Allowance. However, if such a Proforma Promotion under NBR is in a Level of the pay matrix which is equal to or below that of the ex-cadre post, Deputation (Duty) Allowance shall be admissible on the basic pay of the parent cadre post allowed under the proforma promotion, if opted by the deputationist.</li></ul>



<p>3. In view of the references received from different Ministries/Departments/Organisations, the following is clarified with regard to the admissibility of Deputation (Duty) Allowance in terms of Note 2 and Note 3 below para 4(d) of this Department’s OM dated 24th November, 2017 . in cases where the basic pay in parent cadre has been upgraded on account of NFU, MACP, NFSG, etc. in the 7th CPC context:-</p>



<ul class="wp-block-list"><li>3.1 In cases where the basic pay in parent cadre has been upgraded (upto Level 13 A) on account of Non-Functional Upgradation (NFU), Modified Assured Career Progression Scheme (<a href="https://centralgovernmentnews.com/latest-macp-orders-from-dopt/" target="_blank" rel="noreferrer noopener">MACP</a>), Non Functional Selection Grade (NFSG), etc., and the officer has opted for such upgraded pay of the parent cadre, in that event, the upgraded h sic pay under such upgradations shall not be taken into account for the purpose of Deputation (Duty) Allowance. In such cases, the Deputation (Duty) Allowance will be calculated taking the basic pay of the parent cadre which the officer was getting before such upgradation and the amount of the same would be further regulated every year on the basis of the pay arrived at by giving annual increments on the presumptive pay.</li><li>3.2 However, if the upgradation is to Level 14 or above, he shall be given the option to draw the upgraded basic pay under such upgradations without Deputation (Duty) Allowance or the pay which he was drawing before such upgradation with Deputation (Duty) Allowance, whichever is more beneficial as per the option of the officer.</li><li>3.3 In the case of Proforma Promotion under Next Below Rule (NBR), if such a Proforma Promotion (up to Level 13 A) is in a Level of the Pay Matrix which is higher than that of the ex-cadre post, and the officer has opted for the upgraded pay of the Proforma Promotion, the basic pay under such Proforma Promotion shall not be taken into account for the purpose of Deputation (Duty) Allowance. Deputation (Duty) Allowance will be calculated taking into account the basic pay which the officer was getting before such Proforma Promotion. The amount of Deputation (Duty) Allowance would be calculated on the basis of the pre-upgraded presumptive pay that the officer was drawing prior to Proforma Promotion and the amount of the same would be further regulated every year on the basis of the pay arrived at by giving annual increments on the presumptive pay.</li><li>3.4 However, if such a Proforma Promotion under NBR is in a Level of the pay matrix which is equal to or below that of the ex-cadre post, Deputation (Duty) Allowance shall be admissible on the basic pay of the parent cadre post allowed under the Proforma Promotion, if opted by the deputationist.</li><li>3.5 However, if the upgradation is to Level 14 or above of the Pay Matrix, he shall be given the option to draw the upgraded basic pay under such Proforma Promotion without Deputation (Duty) Allowance or the pay which he was drawing before grant of Proforma Promotion with Deputation (Duty) Allowance, whichever is more beneficial as per the option of the officer-The amount of Deputation (Duty) Allowance would be calculated on the basis of pre-upgraded presumptive pay that the officer was drawing prior to the grant of Proforma Promotion and the amount of the same would be further regulated every year on the basis of the pay arrived at by giving annual increments or the presumptive pay.</li></ul>



<p>4. These orders shall take effect from 1st July, 2017.</p>



<p>5. Insofar as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the office of the Comptroller and Auditor General of India.</p>

<p>Ret: Board’s letter No. F(E)I/2016/AL-7/1 dated 09.06.2020.</p>



<p>In terms of the Board’s letter of even number dated 09.06.2020 (Annexure-I). Ministry of Health and Family Welfare’s instructions issued vide their O.M. No. A-45012/04/2017/CHS-V (Pt) dated 09.04.2019 (Annexure-II), in consultation with the Ministry of Finance / Department of Expenditure. regarding grant of Conveyance Allowance at the revised rate to Central heath Service (CHS) Doctors was adopted mutatis-mutandis for Railway Medical Officers and circulated over Indian Railways.</p>



<ol class="wp-block-list" start="2"><li>The above-mentioned instructions provide that the Conveyance Allowance to Railway Medical Officers will be admissible as per the provisions and at the rates mentioned in Ministry of Finance/ Department of Expenditure O.M. No.19039/03/ 2017/-E.1V dated 19th July. 2017.</li><li>Subsequently on receipt of a representation from the <a href="https://centralgovernmentnews.com/indian-railways-latest-news-today/">Indian Railway</a> Medical Service Association (IRMSA). a reference was made to the Ministry of Health and Family Welfare. the nodal Ministry in the matter. They have reviewed the matter in consultation with the Ministry of Finance / Department of Expenditure. It has accordingly been decided that the instructions contained in Board’s above-referred letter will remain unchanged and the Conveyance Allowance to Railway Medical Officers will continue to be admissible as per the provisions and at the rates mentioned in the Ministry of Finance / Department of Expenditure O.M. No.19039/03/2017/-E.1V dated 19th July 2017.</li><li>This disposes of Indian Railway Medical Service Association’s letter No. IRHS/conveyance allowance. dated 13.07.2020 and South East Central Railway’s letter No. SECR/HQA/Estt.-Fin/2020-21/Misc/352. dated 05.08.2020</li><li>Hindi version will follow.</li><li>Please acknowledge receipt.</li></ol>

<p>I am directed to refer to references being received from the various Ministries / Departments of Central Government and from the State Governments, on the above-mentioned Subject and to say that Rule 4 (A) (ii) (a) &amp;(b) of AS (Pay) Rules, 2016 state that:</p>



<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/7th-cpc-pay-fixation-method-for-all-central-government-employees-with-illustration/" target="_blank" rel="noreferrer noopener">7th CPC Pay Fixation Method for all Central Government Employees with Illustration</a></strong></h4>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>“(a) where, in the fixation of pay, the pay of members of the Service drawing pay at two or more stages in pre-revised Pay Band and Grade Pay or scale, as the case may be, get fixed at same Cell in the applicable Level the Pay Matrix, one additional increment Shall be given for every two stages bunched and the pay of member of Service drawing higher pay in pre-revised structure shall be fixed at the next vertical Cell in the applicable Level.</p><p>(b) For this purpose, pay drawn by two members of the Service in a given pay Band and Grade Pay or scale where the higher pay is at least 3% more than the lower pay Shall constitute two stages. Officers drawing pay where the difference is less than 3% shall not be entitled for this benefit.”</p></blockquote>



<p>2. Accordingly, it is stated that the bunching benefits are granted to an officer when his/ her pay arrives equal to his/her junior due to revision of pay as per the new Pay Commission and not in the case when the junior gets equal pay due to promotion to next promotional grade. Hence. the bunching benefits do not apply to the cases where the junior officer is drawing equal pay to that of his/ her senior due to pay fixation in the promotional grade. However, a comparative chart worked out for indicating instances, wherein junior officer gets equal to that of his senior and senior office not being eligible for bunching, is enclosed for ready reference.</p>



<p>3. This issues with the approval of the competent authority.</p>

<p>Consequent upon the decision taken by the Government on the recommendations made by the <strong><a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">7th Central Pay Commission</a></strong> on the subject of Risk Allowance and with the approval of D/o Expenditure, it has been decided to revise the rates of Risk Allowance paid to the Central Govt. employees. The revised rates of Risk Allowance are as follows:</p>

<h3 class="wp-block-heading">Sub: Payment of Night Duty Allowance (NDA) pursuant to the recommendations of 7th Central Pay Commission &#8211; reg.</h3>



<p>1. Please refer to Board’s letter of even number dated 08.03.2018 (RBE No. 36/2018) whereby the rates for revision of Night Duty Allowance (NDA) have been issued.</p>

<p>2. The matter has been reviewed based on the orders received from DoPT, the nodal Deptt. of Govt. on NDA. The President is pleased to decide that the hourly rate of NDA shall be equal to {(Basic Pay + Dearness Allowance)/200} which would be admissible to eligible categories of non-gazetted Railway Servants classified under Chapter XIV of the Railway Act, 1989 read with the Railway Servants (Hours of Work and Period of Rest) Rules, 2005 for work put in during the period from 22:00 hrs to 06:00 hrs. <strong>The ceiling of basic pay for entitlement of Night Duty Allowance shall be Rs.43600 per month. </strong>The rate should be worked out separately for each employee. The present formulation of weightage of 10 minutes for every hour of duty performed between the hours of 22:00 and 06:00 would continue.</p>



<p>3. The grant of NDA shall be subject to furnishing of a certificate by the supervisor concerned that Night Duty is essential.</p>



<p>4. These instructions will be applicable w.e.f. 01.07.2017.</p>



<p>5. This issues with the concurrence of the Finance Directorate of Ministry of Railways.</p>

<p>Subject: <strong>Protection of pay to the Central Government Servant consequent to appointment to a new post in different service or cadre in Central Government, through direct recruitment where either higher duties and responsibilities are involved or not, as the case may be, under FR 22-B(1), in the 7th CPC Scenario &#8211; Regarding.</strong></p>



<p>The undersigned is directed to say that consequent to various references<br />received from Ministries/ Departments on protection of pay under FR 22-B(1), a need has been felt to issue guidelines on the manner of fixation of pay in respect of the Central Government Servant who after technical resignation, is appointed to new post in the different service or cadre in Central Government through direct recruitment where either higher responsibilities are involved or not, as the case may be, in 7th Central Pay Commission scenario.</p>



<p>2. <strong>Provisions of FR 22-B(1) inter-alia provide as under :</strong></p>



<p>&#8220;<strong>P.R. 22-B.(1)</strong> Notwithstanding anything contained in these Rules, the<br />following provisions shall govern the pay of a Government servant who is<br />appointed as a probationer in another service or cadre, and subsequently<br />confirmed in that service or cadre &#8211;</p>



<ul class="wp-block-list"><li>(a) during the period of probation, he shall draw pay at the minimum of the time scale or at the probationary stages of the time scale of the service or post, as the case may be:</li></ul>



<p>Provided that if the presumptive pay of the permanent post on which he<br />holds a lien or would hold a lien had his lien not been suspended, should at<br />any time be greater than the pay fixed under the clause, he shall draw the<br />presumptive pay of the permanent;</p>



<ul class="wp-block-list"><li>(b) on confirmation in the sen/ice or post after the expiry of the period of probation, the pay of the Government servant shall be fixed in the time-scale of the service or post in accordance with the provisions of Rule 22 or Rule 22-C, as the case may be…&#8221;</li></ul>



<p>3. Consequent upon the implementation of 7th CPC Report and CCS (RP)<br />Rules, 2016, the President is pleased to allow protection of pay in the light of the provisions laid down under FR 22-B(1) to Central Government employee who is appointed as probationer in another service or cadre either carrying higher responsibilities or not, as the case may be and subsequently confirmed in that service or cadre, in the manner as illustrated below:</p>



<p><strong>(A) MANNER OF FIXATION OF PAY OF GOVERNMENT SERVANT UNDER<br />FR 22-B(1) CONSEQUENT TO HIS APPOINTMENT IN LOWER POST<br />THROUGH DIRECT RECRUITMENT, WHERE HIGHER DUTIES AND<br />RESPONSIBILITIES ARE NOT INVOLVED</strong></p>



<p>A Central Government Employee on his appointment to a post in lower<br />Level in different service or cadre in Central Government which does not carry duties and responsibilities of greater importance than those attached to the post held earlier by him on regular basis before such appointment and having a provision of probation period in new post, may during probation draw the presumptive pay of the post held earlier by him on regular basis, if it is higher than the minimum of the Time Scale of the new post. He would also draw annual increments on such presumptive pay. However, it is to be ensured that during probation, presumptive pay should always be greater than the pay of the new post after drawl of increment(s). Subsequently, on successful completion of his probation, his pay will be fixed under FR 22(l)(a)(2).</p>



<p>Protection of Pay in the above manner should not, at any of these stages,<br />exceed the maximum of the Level of the new post in Pay Matrix.</p>



<p><strong>Illustration</strong></p>



<p><strong>An officer was drawing pay of Rs.78,500 in Cell 6 in Level 11 (with DNI 01.07.2018) before his appointment to a post in Level 10 on 01.04.2018 which does not carry duties and responsibilities of greater importance than those attached to the post held earlier by him before such appointment. There is a provision of 2 years probation period in new post.</strong></p>



<p>Since the first Cell Value in Level 10 (Rs.56,100) is less than the Last Basic<br />Pay i.e. Rs. 78,500/- in Level 11. Hence during probation, he will draw the<br />presumptive pay i.e. Rs.78,500/- in Level 11 and would also draw annual<br />increments according to the pay drawn in his previous post in Level II.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>On 01 .04.2018- Rs. 78,500 (Level 11)<br />On 01 .07.2018- Rs. 80,900 (Level 11)<br />On 01.07.2019- Rs. 83,300 (Level 11)</strong></p></blockquote>



<p>On successful completion of his probation period and on confirmation w.e.f. 01.04.2020, the pay of the officer would be fixed under FR 22(l)(a)(2). Since no such Cell of Rs. 83,300/- is available in Level 10, his pay would be fixed at next higher cell i.e. Cell 15 in Level 10 at Rs. 84,900 with next date of increment 01.01.2021.</p>



<p><strong>(B) MANNER OF FIXATION OF PAY OF CENTRAL GOVERNMENT EMPLOYEE UNDER FR 22-B(1) CONSEQUENT TO HIS APPOINTMENT TO A POST IN HIGHER LEVEL THROUGH DIRECT RECRUITMENT, WHERE HIGHER DUTIES AND RESPONSIBILITIES ARE INVOLVED</strong></p>



<p>A Central Government Employee on his appointment to a post in higher level in different service or cadre in Central Government carrying duties and responsibilities of greater importance than those attached to the post held earlier by him on regular basis before such appointment and ha ing a provision of probation period in new post, may during probation draw the presumptive pay of the post held earlier by him on regular basis if it is higher than the minimum of the Time Scale of the new post. He would also draw annual increments on such presumptive pay. However, it is to be ensured that during probation presumptive pay should always be greater than the pay of the new post after drawl of increment(s). Subsequently, on successful completion of his probation, his pay will be fixed under FR 22(l)(a)(1).</p>



<p>Protection of Pay in the above manner should not, at any of these stages,<br />exceed the maximum of the Level of the new post in Pay Matrix.</p>



<p><strong>Illustration</strong></p>



<p>An officer was drawing pay of Rs.58,600 in Cell 10 of Level 7 before<br />his appointment on 01.04.2018 in Level 10 (with DNI 01.07.2018) which<br />carries duties and responsibilities of greater importance than those<br />attached to the post held earlier by him on regular basis before such<br />appointment. There is a provision of 2 years probation period in new post.<br />Since the first Cell Value of Level 10 (Rs. 56,100) is less than the Last Basic<br />Pay drawn in Cell 10 of Level 7 i.e. Rs. 58,600/-, hence during probation, he will draw the presumptive pay of the post held earlier by him on regular basis and would also draw annual increments in the Level 7 of his previous post as shown below:-</p>

<p>On successful completion of his probation period and on confirmation w.e.f.<br />01 .04.2020, the pay of the officer would be fixed under FR 22(l)(a)(1) read with Rule 13 of CCS (RP) Rules, 2016. Accordingly, an increment will be added in his pay in Level 7 and his pay will reach at Rs. 64,100/-. Since, there is no cell value equal to Rs. 64,100 available in Level 10, his pay will be fixed in Level 10 in Cell 6 at Rs. 65,000/- with next date of increment 01.01.2021.</p>



<p><strong>(C) MANNER OF FIXATION OF PAY OF CENTRAL GOVERNMENT<br />EMPLOYEE UNDER FR 22-B(1) CONSEQUENT TO HIS APPOINTMENT TO A POST IN EQUIVALENT LEVEL POST THROUGH DIRECT RECRUITMENT,<br />WHERE HIGHER DUTIES AND RESPONSIBILITIES ARE NOT INVOLVED</strong></p>



<p>A Central Government Employee on his appointment to a post in Equivalent Level in different service or cadre in Central Government through direct recruitment where higher duties and responsibilities are not involved and<br />having a provision of probation period in new post, may during probation draw the presumptive pay of the post held earlier by him on regular basis. He would also get his increments on such presumptive pay. On successful completion of his probation, his pay will be fixed under FR 22(l)(a)(2). However, Protection of Pay in the above manner should not, at any of these stages, exceed the maximum of the Level of the new post in Pay Matrix.</p>

<p><strong>An officer was drawing pay of Rs. 58,600 in Cell 10 of Level 7 before<br />his appointment on 01.04.2018 in the same Level 7 (with DNI 01.07.2018). There is a provision of 2 years probation period in new post.</strong></p>



<p>Since the first Cell Value of Level 7 (Rs. 44,900) is less than the Last Basic<br />Pay i.e. Rs. 58,600/- in Level 7 drawn by Government Servant, hence during<br />probation, he will draw the presumptive pay and also get his increments in the same Level of his previous post as shown below:-</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p><strong>On 01.04.2018- Rs. 58,600 (Level 7)<br />On 01.07.2018- Rs. 60,400 (Level 7)<br />On 01.07.2019- Rs. 62,200 (Level 7)</strong></p></blockquote>



<p>On successful completion of his probation period and on confirmation<br />w.e.f. 01.04.2020, the pay of the officer would be fixed under FR 22(I)(a)(2).<br />Since no increment would be admissible under FR 22(l)(a)(2), there will be no change in his pay on the date of confirmation i.e. 01.04.2020. Accordingly, his pay in Level 7 on 01 .04.2020 would be Rs. 62,200 (Level 7) with next date of increment on 01.07.2020, as Level remains same.</p>



<ol class="wp-block-list" start="4"><li>The above mentioned pay protection under FR 22-B(1) will.be available to the Government servant if he holds a lien on his previous permanent post.</li><li>No stepping up of pay of senior Government servant shall be allowed on the basis of the pay protection granted under FR 22-B(1) to junior Government servants of that particular service/ cadre.</li><li>This order takes effect from 01 .01 .2016.</li><li>In their application to the employees of Indian Audit and Accounts<br />Department, these orders are issued after consultation with the Comptroller &amp; Auditor General of India, as mandated under Article 148(5) of the Constitution.</li><li>Hindi version will follow.</li></ol>

<p>Sub: <strong>Recommendation of 7th Central Pay Commission &#8211; Grant of Conveyance Allowance at the revised rates to Railway Medical Officers.</strong></p>



<p>Consequent to the recommendations of the 7th Central Pay Commission, the Ministry or Health &amp; Family Welfare, vide their O.M. No.A-45012/04/2017-CHS-V (Pt.) dated 9th April, 2019 (copy enclosed), have decided in consultation with Ministry of Finance that revised rates of Conveyance Allowance admissible to Central Health Service Doctors working under the Central Health Service may be granted as per the rates mentioned in the DOE’s OM No. 1903903/2017-E.IV dated 19th July, 2017 (circulated vide Board’s letter No. F(E)/2017/AL-4/3 dated 10.08.2017). MoH&amp;FW’s O.M. dated 9th April, 2019 shall apply <strong><a href="https://centralgovernmentnews.com/tag/mutatis-mutandis/" target="_blank" rel="noreferrer noopener">mutatis-mutandis</a></strong> to Railway Medical Officers also.</p>
