<p>Subject: <strong>Revision of pay of the Chairpersons and Members of the Regulatory Authorities / Bodies consequent to the implementation of the 7th Central Pay Commission recommendations.</strong></p>
<p>This Department had, vide OM No. 3/ 6/ 97-Estt.(Pay-II) dated 29th January 1998, issued guidelines regarding perquisites and some important terms and conditions for the Chairpersons and Members of the Regulatory Authorities and allied matters.</p>
<p>2. These guidelines were applicable to Chairpersons and Members of existing Regulatory Authorities also, appointed subsequent to the issue of these guidelines, unless there is a constitutional or statutory obligation to the contrary. As per the aforesaid guidelines, the Chairperson would be eligible for pay not exceeding Rs. 26,000/ &#8211; p.m. (fixed) and Members would be eligible for pay scale not exceeding Rs.22400-525-24500. The pay will be fixed in accordance with the prevailing orders, i.e. pay minus pension.</p>
<p>3. After implementation of the Sixth Pay Commission, in order to attract expertise available outside the Government, the full time Members of TRAI, CERC, IRDA, SEBI and CCI were granted consolidated pay packages vide orders of Ministry of Finance, Department of Expenditure. Replacement scales of Rs.80,000/- p.m. and Rs.37400-67000 (PB-4) with Grade Pay of Rs. 12000/- (since replaced with HAG scale of Rs.67000-79000) were granted respectively to Chairpersons and Members of all other Regulatory Authorities / Bodies.</p>
<p>4. The 7th CPC has looked into the emoluments structure, including pay, allowances and other facilities/benefits, in cash or kind of the members of Regulatory Bodies (excluding the Reserve Bank of India) set up under Acts of Parliament, and have given their recommendations in Chapter-13 of their Report. As per recommendations of the 7th CPC, as accepted by Government of India, and also as intimated by Department of Expenditure vide OM No. 394959/ E.IIIA/ 2017 dated 211d March 2017, the pay and allowances of Chairperson and fulltime Members of Telecom Regulatory Authority of India (TRAI), Insurance Regulatory and Development Authority (IRDA), Central Electricity Regulatory Commission (CERC), Securities and Exchange Board of India (SEBI), Competition Commission of India (CCI), Pension Fund Regulatory and Development Authority (PFRDA), Petroleum and Natural Gas Regulatory Board (PNGRB), Warehousing Development and Regulatory Authority (WDRA), Airports Economic Regulatory Authority of India (AERAI), Railway Development Authority (RDA) and Insolvency &amp; Bankruptcy Board of India (IBBI) which have been de-linked from Government salaries will be governed by the orders issued by the Department of Expenditure.</p>
<p>5. In respect of existing Members of remaining Regulatory Bodies set up under the Acts of Parliament, the 7th CPC has recommended normal replacement pay. This has also been accepted by the Government of India vide Resolution No.1-2/ 2016-IC dated 25th July, 2016. Accordingly, the existing Chairpersons as well as future appointees would be eligible for basic pay not exceeding Rs. 2,25,000/- (Level 17 of Pay Matrix) in revised pay structure and the existing Members as well as future appointees would be eligible for basic pay not exceeding Level 15 of Pay Matrix in the revised pay structure.</p>
<p>6. Existing instructions provide that Chairperson and Member(s) who on the date of his / her appointment to the Regulatory Authority/ Statutory Body/ Tribunal was in the service of the Central/ State Government shall be deemed to have retired from such service with effect from the date of his / her respective appointment as such Chairperson/ Member. In case such officers are in receipt of pension, the same shall be deducted in accordance with the prevailing orders applicable to the reemployed pensioners.</p>
<p>7. The rates of all allowances shall be as admissible to Government employees of corresponding Level from time to time.</p>
<p>8. These orders shall take effect from 01.01.2016.</p>

<p>The Union Cabinet chaired by the Prime Minister Shri Narendra Modi approved important proposals relating to modifications in the 7th CPC (Central Pay Commission) recommendations on pay and pensionary benefits in the course of their implementation. Earlier, in June, 2016, the Cabinet had approved implementation of the recommendations with an additional financial outgo of Rs 84,933 crore for 2016-17 (including arrears for 2 months of 2015-16).</p>
<p>The benefit of the proposed modifications will be available with effect from 1st January, 2016, i.e., the date of implementation of 7th CPC recommendations. With the increase approved by the Cabinet, the annual pension bill alone of the Central Government is likely to be Rs.1,76,071 crore.  Some of the important decisions of the Cabinet are mentioned below:</p>
<p><strong style="color: #f00;"> 1. Revision of pension of pre &#8211; 2016 pensioners and family pensioners</strong></p>
<blockquote><p>The Cabinet approved modifications in the recommendations of the 7th CPC relating to the method of revision of pension of pre-2016 pensioners and family pensioners based on suggestions made by the Committee chaired by Secretary (Pensions) constituted with the approval of the Cabinet.  The modified formulation of pension revision approved by the Cabinet will entail an additional benefit to the pensioners and an additional expenditure of approximately Rs.5031 crore for 2016-17 over and above the expenditure already incurred in revision of pension as per the second formulation based on fitment factor.  It will benefit over 55 lakh pre-2016 civil and defence pensioners and family pensioners.</p>
<p>While approving the implementation of the 7th CPC recommendations on 29th June, 2016, the Cabinet had approved the changed method of pension revision recommended by the 7th CPC for pre-2016 pensioners, comprising of two alternative formulations, subject to the feasibility of the first formulation which was to be examined by the Committee.</p>
<p>In terms of the Cabinet decision, pensions of pre-2016 pensioners were revised as per the second formulation multiplying existing pension by a fitment factor of 2.57, though the pensioners were to be given the option of choosing the more beneficial of the two formulations as per the 7th CPC recommendations.</p>
<p>In order to provide the more beneficial option to the pensioners, Cabinet has accepted the recommendations of the Committee, which has suggested revision of pension based on information contained in the Pension Payment Order (PPO) issued to every pensioner.  The revised procedure of fixation of notional pay is more scientific, rational and implementable in all the cases.  The Committee reached its findings based on an analysis of hundreds of live pension cases.  The modified formulation will be beneficial to more pensioners than the first formulation recommended by the 7th CPC, which was not found to be feasible to implement on account of non-availability of records in a large number of cases and was also found to be prone to several anomalies.</p></blockquote>
<p><strong style="color: #f00;"> 2. Disability Pension for Defence Pensioners</strong></p>
<blockquote><p>The Cabinet also approved the retention of percentage-based regime of disability pension implemented post 6th CPC, which the 7th CPC had recommended to be replaced by a slab-based system.</p>
<p>The issue of disability pension was referred to the National Anomaly Committee by the Ministry of Defence on account of the representation received from the Defence Forces to retain the slab-based system, as it would have resulted in reduction in the amount of disability pension for existing pensioners and a reduction in the amount of disability pension for future retirees when compared to percentage-based disability pension.</p>
<p>The decision which will benefit existing and future Defence pensioners would entail an additional expenditure of approximately Rs. 130 crore per annum.</p></blockquote>

<p><em><strong>Subject: Grant of Advances- Seventh Central Pay Commission recommendations-Amendment to rules on Computer Advance to Railway servants.</strong></em></p>
<p>Consequent upon the decision taken by the Government on the recommendations of Seventh Central Pay Commission, the Ministry of Finance vide their OM No. 12(1)/E.II(A)/2016 dated 07.10.2016 have amended the eligibility criteria in the existing provisions relating to the grant of Personal Computer Advance.</p>
<p>2. Amendment conditions of grant of Computer Advance are as follows:</p>

<td colspan="3">The other terms and conditions governing the grant of Personal computer advance shall remain unchanged.</td>

<p>3. Further, Ministry of Finance in their ibid OM have also decided that the other interest bearing advances relating to Motor Car Advance and Motorcycle/Scooter/Moped Advance will stand discontinued.</p>
<p>4. The above mentioned OM of Ministry of Finance relating to grant of interest bearing advances will apply mutatis-mutandis to Railway employees also.</p>
<p>4.1 So far as the interest free advances are concerned, Bicycle and Warm clothing advances stands abolished for Railway employees also in terms of MoF’s decision.</p>
<p>4.2 Orders relating to other interest free advances will be issued separately by concerned Directorates.</p>
<p>5. Necessary Advance Correction Slip to the chapter XI of the Indian Railway Establishment Manual, Vol.I Revised Edition, 1989 will follow.</p>
<p>6. The revised orders are effective from 07.10.2016 i.e. the date of the issue of the aforesaid OM of the Ministry of Finance. Past cases where the advances have already been sanctioned under the provisions of earlier rules on the subject need not be reopened.</p>

The undersigned is directed to refer to the OM of even number dated 03.10.2016 on the above mentioned subject informing about the meeting scheduled to be taken by Joint Secretary (Establishment) to review the position with respect to the amendment in Service Rules/Recruitment Rules for various posts.</p>
<p>2. In this regard it is stated that the meetings scheduled to be held on 25.10.2016 and 26.10.2016 for the Ministries starting with alphabets R-V and W-Z respectively has been postponed due to some unavoidable circumstances. The fresh date for the meeting will be communicated in due course of time.</p>

<p>Ref: (i) This office circular of even No. dated 11 Aug, 2016.</p>
<p>Please refer to this office Part I office order No. AT/02 circulated vide No. Pay/Tech 01 /7th CPC I dated 11.08.2016 through which a copy of CGDA New Delhi No. AT/II/2701/0rders dated 10 Aug, 2016 has been forwarded for necessary action.</p>
<p>2. It has been stated therein to ensure completion of post audit of fixation of pay/arrear claims within 3 months and the work relating to post audit should be monitored at PCsDA/CsDA level by instituting suitable reporting system for watching the progress of work. A Monthly Report in this regard in a format prescribed therein is required to be furnished to Headquarters office so as to reach by 15th of every month. The first report showing the position as on 31.08.2016 was due to reach HQrs office by 15th Sep, 2016. Kindly confirm its timely submission to HQrs office. Also please forward a copy of the said report to this office for our record &amp; reference.</p>
<p>3. Please ensure submission of the report for the subsequent months within scheduled date with a copy endorsed to this office.</p>

<strong>Dated 2nd September 2016</strong></p>
<p>The initial report received at the Confederation Central Head Quarters indicate the participation of about ten lakhs Central Government employees in today’s nationwide general strike action of the Indian Working Class. Earlier, endorsing the call of the Central Trade Unions, the Confederation of Central Government employees and workers had called upon the Central Government employees to take part in the one-day strike to compel the Government to withdraw the anti-people and anti-labour neo-liberal policies pursued by the Central Government.</p>
<p>Offices of the Postal, Income Tax, Ground Water Board, Survey of India, Geological Survey of India, Printing and Stationery department, Botanical Survey of India, Indian Bureau of Mines, RMS offices, census department, Indian Space Research organization, Central Government Health Scheme, Atomic Energy, Medical Stores depots, Film Institute of India, AGMARK, Indian Council for Medical Research, Film division and various other autonomous scientific and research institutions etc. remained closed and the work completely paralysed.</p>
<p>The strike also affected the functioning of various offices of Indian Audit &amp; Accounts department, Civil Accounts, Central Excise and Customs, CPWD etc. Total civilian employees of various Defence organisations and Defence Accounts Departments participated in the strike. The Strike was total in Kerala, West Bengal, Tamilnadu, Andhra, Telangana, Jharkhand, Chattisgarh, Odisha, Assam, North Eastern states, Karnataka, Maharashtra, Punjab, Madhya Pradesh and 70 to 80% in other states.</p>
<p>The Central Government employees were particularly unhappy over the totally negative attitude of the NDA Government towards their demands while implementing 7th Central Pay Commission recommendations. Ban on creation of new posts, non-filling up of about six lakhs vacant posts, introduction of New Contributory Pension Scheme, non-regularisation of Gramin Dak Sevaks and casual, contract workers, ceiling on compassionate appointments, rejection of the demand for increase in the minimum wage and fitment formula, reduction in the percentage of House Rent Allowance, abolition of 52 allowances etc. are some of the retrograde measures taken by the Central Government.</p>

<p>New Delhi: The Union Cabinet will take a decision on the suggestions of a special committee which has been set up to look into the provision of allowances under the 7th Central Pay Commission recommendations, Finance Minister Arun Jaitley said Tuesday.</p>
<p>Replying to a question on the pay commission in Rajya Sabha, the minister said the government has decided that the recommendations on allowances, other than dearness allowance, will be examined by a committee headed by Finance Secretary as Chairman and Secretaries of Home Affairs, Defence, Health and Family Welfare among others as its members.</p>
<p>The committee, which was constituted on July 22, has been asked to submit its report within four months. Its first meeting took place on August 4.</p>
<p>“As far as allowances are concerned, 51 have been abolished while 37 have been subsumed. As the measures are radical in nature, even the employees’ unions have given their suggestions in the matter and therefore a special committee has been formed to look into it. Whatever the committee decides, it will go to the Cabinet,” Jaitley said.</p>
<p>The matters relating to pay and pension as decided by the government have been implemented with effect from January one this year.</p>
<p>Replying to a related question, Jaitley said it was the responsibility of the state governments to pay the salaries of their employees from their internal resources.</p>
<p>“So they will have to manage it from their own resources,” he said.</p>
<p>Digvijaya Singh (Congress) said the banking industry was in a crisis and lakhs and crores of rupes have gone into NPAs, willfull defaulters’ list and restructured loans.</p>
<p>So in this changed scenario, was the government planning to amend the section 45(E) of RBI Act 1934 which prohibits disclosing credit information, he asked.</p>
<p>“Transparency is a very popular word and it is being accepted all over the world. With transparency and with the coming of RTI Act, even then in some matters it is balanced with commercial confidentiality..There are some laws which are there since long time like the Income Tax..</p>
<p>“Therefore, the government will have to work under the framework of these laws. Currently, the government has no proposal to change this provision,” Jaitley said.</p>
<p>As per 45(E) of RBI Act 1934, RBI is prohibited from disclosing credit information except under certain conditions.</p>
<p>Jaitley said the RBI gives detailed guidelines to banks on how to deal with the non-performing assets, stressed assets and how restructuring could be done.</p>
<p>To a question from KTS Tulsi, Jaitley said “trading and industrial advances” amount for larger NPAs in the country.</p>
<p>“As far as different sectors are concerned, there has been an experience that in case of smaller loans the level of NPAs have been much lesser. For example in the macro financing etc, the recoveries are to the extent of 99 per cent and therefore NPAs are much lesser. The higher NPAs are really in relation to much larger trading and industrial advances,” he said.</p>
<p>As of March 31, the gross NPAs of public sector banks stood at Rs 4.76 lakh crore, Jaitley said.</p>
<p>On hearing this, Tulsi said “that’s why farmers are killing themselves.”</p>
<p>Jaitley said the “farmers were killing themselves because the prices are not remunerative, the cost of cultivation has gone up and they are not able to pay off debts. This is the principle reason why the farm sector was in distress”.</p>
<p>Replying to a separate question, Jaitley said RBI had ordered an asset quality review of entire banking system which has been done on basis of which NPAs are now openly stated.</p>
<p>“And that is why in each quarterly asessment a provision is being made by classifying the NPAs as NPAs which was otherwise not being done. Therefore the accounts and balancesheets are now being cleaned up under the asset quality review which is being undertaken,” he said.</p>
