<h4 class="wp-block-heading">Sub: Implementation of Government’s decision on the recommendations of the Seventh Central Pay Commission &#8211; Revision of pension of pre-2016 retired Medical Officers of Army Medical Corps/ Army Dental Corps/ Remount &amp; Veterinary Corps-reg.</h4>



<p>Sir,</p>



<p>The undersigned is directed to refer to this Ministry’s letter No. 17(01)/2017/ (02)/D(Pension/ Policy) dated 5 September 2017. In accordance with Para-4 of this letter, the revised pension/ family pension of all Armed Forces Personnel who retired/ died prior to 01.01.2016, shall be revised by notionally fixing their pay in the pay matrix recommended by the 7t CPC in the level corresponding to the pay in the pay scale/pay band and grade pay at which they retired/ died. This will be done by notional pay fixation under each intervening Pay Commissions based on the formula for revision of pay. The revised rates of Military Service Pay, Non-Practice Allowance, where applicable, and ‘X’ Group. Pay &amp; Classification Allowance for JCO/ORs, if applicable notified in terms of 7th CPC orders, shall also be added to the amount of pay notionally arrived at under the 7th CPC pay matrix and shall be termed as notional reckonable emoluments as of 01.01.2016 while fixing pay on notional basis. It was further decided at para-6 of the letter that higher of the two formulations ice. the pension/ family pension already revised in accordance with this Ministry’s letter No. 17 (01)/ 2016-D(Pen/Pol) dated 29.10.2016 or the revised pension/family pension as worked out in accordance with Para-5 of the MoD letter dated 05.09.2017 referred above, shall be granted to pre-01.01.2016 ‘Armed Forces pensioners as revised pension/family pension w.e.f. 01.01.2016.</p>



<p>2. Department of Pension &amp; Pensioners’ Welfare vide their OM No. 38/37/16-P&amp;PW(A){iii) dated 11th September 2017 have decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay as of 01.01.2016 to arrive at pension/ family pension of retired medical officers w.e.f. 01.01.2016 and the <a href="https://centralgovernmentnews.com/category/pension/" target="_blank" rel="noreferrer noopener">pension</a>/ family pension of retired medical officers shall be further revised w.e.f, 01.07.2017 by adding NPA @ 20% to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 subject to the condition that the notional pay as on 01.01.2016 plus NPA does not exceed the average of basic pay of the revised scale applicable to the Apex Level and the level of Cabinet Secretary.</p>



<p>3. The matter regarding revision of all kinds of pension/ family pension of medical officers of Armed Forces who have retired/ died prior to 01.01.2016 has been examined by the Govt. and it has been decided that NPA at the rate as applicable as of 01.01.2016 shall be added to notional pay worked out in terms of Para-4 of the MoD letter No. 17(01)/2017/(02)/D (Pension/ Policy) dated 5th September 2017 to arrive at notional reckonable emoluments as on 01.01.2016 for calculation of pension/ family pension of pre-01.01.2016 retired/ died Medical Officers of Armed Forces, w.e.f. 01.01.2016. All kinds of pension/ family pension of pre-01.01.2016 retired/ died medical officers of Armed Forces Pensioners/ family pensioners shall be further revised w.e.f. 01.07.2017 by adding NPA @ 20% of notional pay in VIIth CPC scale to the notional pay as on 01.01.2016, instead of NPA admissible as on 01.01.2016 (which was 25% of pre-revised scale).</p>



<p>4. The fixation of pension/ family pension of retired Medical officers of Armed Forces in the above manner, shall be further subject to the condition that emoluments (ie. Basic Pay + MSP + NPA) to be reckoned for pension do not exceed Rs. 2,37,500/- (Rupees two lakh thirty seven thousand five hundred only). Amount of Gratuity and CVP which has already been notified, shall remain unchanged.</p>

<p>5. This issues with the concurrence of the Ministry of <a href="https://centralgovernmentnews.com/category/defence/" target="_blank" rel="noreferrer noopener">Defence</a> (Finance/ Pension) vide their ID No. 10(8)/2018/Fin/Pen dated 23.12.2020.</p>

<p>I am directed to refer to references being received from the various Ministries / Departments of Central Government and from the State Governments, on the above-mentioned Subject and to say that Rule 4 (A) (ii) (a) &amp;(b) of AS (Pay) Rules, 2016 state that:</p>



<h4 class="wp-block-heading"><strong><a href="https://centralgovernmentnews.com/7th-cpc-pay-fixation-method-for-all-central-government-employees-with-illustration/" target="_blank" rel="noreferrer noopener">7th CPC Pay Fixation Method for all Central Government Employees with Illustration</a></strong></h4>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>“(a) where, in the fixation of pay, the pay of members of the Service drawing pay at two or more stages in pre-revised Pay Band and Grade Pay or scale, as the case may be, get fixed at same Cell in the applicable Level the Pay Matrix, one additional increment Shall be given for every two stages bunched and the pay of member of Service drawing higher pay in pre-revised structure shall be fixed at the next vertical Cell in the applicable Level.</p><p>(b) For this purpose, pay drawn by two members of the Service in a given pay Band and Grade Pay or scale where the higher pay is at least 3% more than the lower pay Shall constitute two stages. Officers drawing pay where the difference is less than 3% shall not be entitled for this benefit.”</p></blockquote>



<p>2. Accordingly, it is stated that the bunching benefits are granted to an officer when his/ her pay arrives equal to his/her junior due to revision of pay as per the new Pay Commission and not in the case when the junior gets equal pay due to promotion to next promotional grade. Hence. the bunching benefits do not apply to the cases where the junior officer is drawing equal pay to that of his/ her senior due to pay fixation in the promotional grade. However, a comparative chart worked out for indicating instances, wherein junior officer gets equal to that of his senior and senior office not being eligible for bunching, is enclosed for ready reference.</p>



<p>3. This issues with the approval of the competent authority.</p>

<p><strong>Subject: Clarification on Children Education Allowance / Hostel subsidy.</strong></p>



<p>Consequent upon the implementation of <a href="https://centralgovernmentnews.com/7th-pay-commission-latest-news/" target="_blank" rel="noreferrer noopener">Seventh Pay Commission</a> Allowances after the Reorganization of the State of Jammu &amp; Kashmir, Finance Department has issued Govt. Order No. 473-F dated: 28.11.2019 wherein CEA /Hostel Subsidy was granted in favour of the employees of Union Territory of Jammu &amp; Kashmir. Various queries have been received in the Finance Department from certain quarters regarding CEA/Hostel Subsidy.</p>



<p>After examining the issue, it has been decided to issue the following clarification on the subject of Children Education Allowance and Hostel Subsidy:-</p>

<p>1. The maximum ceiling amount for <strong>reimbursement of Children Education Allowance is Rs 2250/-per month per child and Rs 6750/- per month </strong>per child for hostel subsidy. The CEA amount is fixed irrespective of actual expenses incurred, but for claiming Hostel subsidy a certificate from the institute, where the child is studying shall indicate the amount of lodging and boarding charges paid by the employee to the residential educational institute. The reimbursable amount of the Hostel subsidy will be the actual expenses incurred or Rs 6750/- per month whichever is less.<br />2. Children Education Allowance and Hostel subsidy can be claimed by only one employee if both spouses are employed.<br />3. The reimbursement of CEA and Hostel subsidy will be made only once in a year after the completion of Financial year i.e., in the month of April/May. For example claim of CEA and Hostel subsidy for the financial year 2020-21 shall be submitted in April /May 2021.<br />4. The application for claiming the reimbursement is attached as Annexure &#8220;A&#8221;. In addition a bonafide certificate is to be obtained from Head of Educational Institution confirming that the child studied in the school during the period of the claim (Annexure &#8220;B&#8221;). In case such a certificate cannot be obtained, a self attested copy of the report card and receipt/ e- receipt of the institute can be produced as a supporting document.</p>

<p>Subject: <strong>Implementation of Government decision on 7th CPC’s recommendations on Night Duty Allowance (NDA).</strong></p>



<p>Consequent upon the decision taken by the Government on the recommendations made by the 7th Central Pay Commission on the subject of Night Duty Allowance, the following instructions are being issued in supersession of this Department’s O.M.s No. 12012/4/86-Estt. (Allowances ) dated 04.10.1989 and OM No.15020/2/92- Estt .(Allowances) dated 05 .05 .1994</p>



<ul class="wp-block-list"><li>Wherever the working hours have been arrived at after taking into account the night weightage factor, no further compensation may be admissible.</li><li>Night Duty will be defined as duty performed between 22:00 hours and 6:00 hours</li><li>A uniform weightage of 10 minutes shall be given for every hour of night duty performed.</li><li>The ceiling of basic pay for entitlement of Night Duty Allowance shall be Rs. 43600/-  per month.</li><li>The hourly rate of NDA equal to [(BP+DA)/200] will be paid and the basic pay and DA for the calculation of NDA rates shall be the basic pay and DA prevalent as per 7th CPC.</li><li>This formulation will extend to all employees across all Ministries/ Departments who were already in receipt of NDA.</li><li>The amount of NDA will be worked out separately for each employee depending upon the basic pay the concerned employee is drawing on the date of performing the night duty. The existing practice for giving same rate of NDA to all employees with a particular Grade Pay should be discontinued.</li><li>A certificate should be given by the supervisor concerned that Night Duty is essential.</li></ul>

<p>Ref: (i) Railway Board’s letter No.PC VIII/2017/ 1/7/5/4 dated 10/08/2017 (RBE No. 87/2017).<br /> (ii) Railway Board’s clarification issued to GM (P), E.C. Railway vide letter No.PC VII/ 2017/1/7/5/4 dated 25/10/2018.<br /> (iii) GS/NFIR’ s letter No. IV/NFIR/7 CPC(Imp)/2016/ Allowance/ Part II dated 24/12/2018 to the Secretary (E), Railway Board and sent to AM(CE) &amp; EDPC-II, Railway Board.</p>



<p>While enclosing copy of NFIR’s letter No.IV/NFIR/ 7 CPC (Imp)/2016/Allowance/Part II dated 24/12/2018 on the subject, the Federation expresses its disappointment over continued denial of Risk &amp; Hardship Allowance to the Track Maintainers working in Construction Organizations on Indian Railways. The Federation in its letter dated 24/12/2018 had elaborately explained the merits, justifying payment of Risk &amp; Hardship Allowance to the Track Maintainers of Construction Organizations also. Sadly, due to Railway Board’s clarification issued to the General Manager (P), E.C. Railway vide letter dated 25th October, 2018, the payment of Risk and Hardship Allowance to the Construction Organizations Track Maintainers has been denied and wherever paid for the previous period, the same is being recovered.</p>

<p>Though nearly ten months passed from the date of letter of Federation, there has been no reply indicating action taken on this issue. This has compelled the Federation to seek intervention of Railway Board (ME &amp; MS) for reviewing the case and allowing payment of Risk and Hardship Allowance to the Track Maintainers working in the Construction Organizations.</p>



<p>NFIR, therefore, requests the Railway Board (ME &amp; MS) to kindly consider the matter objectively and accord approval for payment of Risk &amp; Hardship Allowance to those Track Maintainers working in Construction Organizations over Indian Railways. It may kindly be appreciated that this issue deserves to be settled immediately without waiting for the report of EDs Committee in view of the merits involved for payment.</p>

<p>After the Parliament passed the Jammu and Kashmir Reorganization Bill, 2019, Prime Minister, Shri Narendra Modi addressed the nation on 8th August, 2019, wherein he announced that all the financial facilities being given to the employees of other Union Territories (UT), as per the recommendations of 7th CPC, would soon be extended to the employees of UT of Jammu &amp; Kashmir and UT of Ladakh. </p>

<p>Accordingly, Union Home Minister, Shri Amit Shah has approved the proposal of payment of all 7th CPC allowances to the Government employees of UT of Jammu &amp; Kashmir and UT of Ladakh, which shall come into existence from 31st October, 2019.  Union Home Ministry has issued orders in this regard.  The move will benefit 4.5 lakh Government employees, who are working in the existing State of Jammu &amp; Kashmir and will become the employees of UT of Jammu &amp; Kashmir and UT of Ladakh from 31st October, 2019.</p>



<p>The annual financial implication of 7th CPC allowances like Children Education Allowance, Hostel Allowance, Transport Allowance, LTC, Fixed Medical Allowance etc. in respect of 4.5 lakh Government employees of existing State of Jammu &amp; Kashmir shall be Rs. 4800 crore tentatively:</p>

<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (ii) NFIR’s letter No. I/I 1/Part I dated 07/09/2018.</p>



<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; (iii) NFIR’s letter No. I/11/Pt. II dated 11/02/2019.</p>



<p>&nbsp;
 Federation vide its communications dated 07/09/2018 &amp; 11/02/2019 
brought to the notice of Railway Board a specific case of wrong fixation
 of pay in favour of Shri Satyendra Kumar Lal, Chief Typist, DLW, 
Varanasi. Along with its communication, Federation also provided a chart
 highlighting the pay fixation done (Drawn) by the DLW/Varanasi 
vis-à-vis the pay due to be fixed in pursuance of Board’s instructions 
contained in RBE No. 40/2012 and requested that suitable instructions be
 issued to the GM/DLW, as also to other Zonal Railways etc., for proper 
implementation of Board’s orders (RBE No. 40/2012). Federation is 
disappointed to note that though period of over one year has passed, no 
action has been taken in the matter, while the employee continues to 
draw less salary.</p>



<p>NFIR, therefore, once again requests the <strong>Railway Board</strong>
 to connect Federation’s letters dated 07/09/2018 and 11/02/2019 and 
issue suitable clarification to the Zones etc in general and 
DLW/Varanasi in particular to ensure correct implementation of the 
instructions contained in RBE No. 40/2012 so as to avoid financial loss 
to employees on their pay fixation in 7th CPC Pay Matrix.</p>



<p>A copy of the instructions issued may be endorsed to the Federation.</p>

<p>S.R.O. 08(E).- In exercise of the powers conferred by the proviso to Article 309, and Clause (5) of Article 148 of the Constitution, the President hereby makes the following rules to amend the Civilians in Defence Services (Revised Pay) Rules, 2016, namely :-</p>



<p>(1) These rules may be called the Civilians in Defence Services (Revised Pay) (Amendment) Rules, 2019.</p>



<p>(2) They shall be deemed to have come into force on the 1st day of January, 2016.</p>



<p>In the Civilians in Defence Services (Revised Pay) Rules, 2016,-</p>



<p>(a) in Rule 5, the following amendment be made;</p>



<p><strong>For</strong>:<br /> “Provided further that in cases where a government servant has been placed in a higher grade pay or scale b/w I&#8221; day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.”</p>



<p><strong>Read as</strong>:<br /> “Provided further that in cases where a government servant has been placed in a higher grade pay or scale b/w 1&#8243; day of January, 2016 and the 25&#8243; day of July, 2016 on account of promotion or upgradation, the government servant may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.”</p>
