<p>Subject- <strong>Revised rates of Dearness Allowance to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/ Grade Pay as per 6th Central Pay Commission w.e.f. 01.07.2021</strong></p>



<p>The undersigned is. directed to refer to this Department&#8217;s O.M. No. 1/3(1}/ 2008-E.1{B) dated 25 October 2019 revising the rate of Dearness Allowance (DA) w.e.f. 01.07.2019 in respect of employees of Central Government. and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 6th Central Pay Commission and to this Department&#8217;s OM No. 1/1/2020- E.I(B) dated 23.04.2020 vide which instalments of Dearness Allowance to Central Government employees due from 01.01.2020, 01.07.2020 and 01.01.2021, were frozen.</p>



<ol class="wp-block-list" start="2"><li>The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing <strong>164% to 189%</strong> of the Basic Pay with effect from 01.07.2021. The increase subsumes the additional instalments arising on 01.01.2020, 04.07.2020 and 01.01.2021, <strong>The rate of Deamess Allowance for the period from 07.04.2020 till 30.08.2024 shall remain at 164%.</strong></li><li>The provisions contained in paras 3, 4 and 5 of this Ministry&#8217;s O.M.No.1(3)/2008-E.|I(B) dated 29 August, 2008-shall continue to be applicable while regulating Dearness Allowance under these orders. .</li><li>The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.</li></ol>

<p>West Bengal 6th Pay Commission implementation &#8211; Revised Pay Structure from January 2020</p>

<p>On 13th September 2019, the State Chief Minister Mamta Banerjee stated in Kolkata that the Pay Panel Committee submitted its first report to the Government and the recommendations of the report will accept, she added.</p>
<p>The minimum basic pay may be raised to Rs.17.990 from the existing of level of Rs. 7000.</p>
<p>As per the recommendations of the Pay Commission report, the minimum gross salary will be more than Rs. 20,000 and the Gratuity ceiling will be increased to 10 lakh.</p>

<p>The Pay Commission also recommended to Dearness allowance merge with basic pay with new pay bands.</p>
<p>About then thousand crore rupees will be spent additionally from State exchequer for implementing all the recommendations of 6th pay commission including new pay structure to West Bengal Government Employees.</p>

<p style="text-align:center"><strong>ORDER<br />01.05.2019</strong></p>



<ol class="wp-block-list"><li>There are three prayers in this writ petition &#8211; one is for a direction to the Respondents to grant the Petitioner the benefit of the first Assured Career Progression (&#8216;ACP&#8217;) Scheme with effect from October, 1999, when the Petitioner had actually completed 12 years of service instead of 30th December, 2000. The second is that the benefit of the MACP should be granted with effect from October, 2007 (instead of 1st September, 2008), when the Petitioner completed 20 years of service. The third prayer is that the benefit of the MACP should be given by placing the Petitioner in the scale of Sub Inspector (&#8216;SI&#8217;) i.e. Rs.5500-9000 (pre-revised).</li><li>As far as the first prayer is concerned, the same has already been granted by the Respondents to the Petitioner. As far as the second prayer is concerned, the issue is covered in favour of the Petitioner by the judgment dated 8th December, 2017 of the Supreme Court in <strong>Union of India v. Balbir Singh Turn (2018) I I SCC 99.</strong> The Supreme Court has in the above judgment clarified that the benefit of the MACP which was on the basis of the recommendations of the Sixth Central Pay Commission to be extended with effect from 1st January, 2006 and not from 1st September, 2008, as was directed by the Respondents.</li><li>As regards the fixing of the correct pay scale of the Petitioner, it is seen that in BSF/General Duty, there is no post of ASI/General Duty in the pay scale of Rs.4000-100-6000 (pre-revised) which had been converted into Pay Band-I i.e. 5200-20200 in the grade pay of Rs.2800 having pay band of 8560 with the total pay (basic pay) of Rs.11360. Thus, in the case of the Petitioner, the second financial upgradation was required to be given in the pay scale of Rs.5500-9000 (pre-revised). Since this was not granted to other similarly placed as the Petitioner, writ petitions were filed in this Court. A series of judgments have been passed by this Court in those writ petitions, as a result of which the Respondents extended the benefit of financial upgradation in the pay scale of Rs.5500-9000 to all personnel who had completed 24 years of regular service during the period 9th August, 1999 to 31st August, 2008.</li><li>The counter affidavit of the Respondents does not dispute the applicability of the judgment of the Supreme Court in <strong>Union of India v Balbir Singh Turn</strong> (supra) or the applicability of the other orders of this Court, including the order dated 18th December, 2015 in W.P.(C) No.11725 (<strong>Digamber Singh ASI v UOI</strong>) concerning the appropriate pay scale for the purposes of grant of the MACP benefits.</li><li>Consequently, this Court directs as under: <br /><br />i) The Petitioner would be given the benefit of the MACP with effect from October, 2007 instead of 1st September, 2008; and<br />ii) The above benefit will be given by placing the Petitioner in the pay scale of of Sub Inspector i.e. 5500-9000 (pre-revised).<br />iii) The appropriate orders will be issued and the arrears will be paid to the Petitioner within a period of 12 weeks from today, failing which the Respondents will be liable to pay simple interest @ 6% per annum on the arrears for the period of delay.<br /></li><li>The petition is disposed of in above terms. No costs.</li></ol>

<p>The undersigned is directed to refer to this Department&#8217;s O.M. of even No. dated 26th September, 2017 regarding revision of the rate of Dearness Allowance w.e.f 1.7.2017 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 6th Central Pay Commission.</p>
<p>2. The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing 139% to 142% w.e.f. 1.1.2018.</p>

										<content:encoded><![CDATA[<p><strong>Pension to IAF Veterans </strong></p>
<p>Pension of pre-2006 retired Junior Commissioned Officers/ Other Ranks (JCOs / ORs) have been assessed on the basis of rank continuously held for 10 months or more. However, protection of minimum of fitment table under 6th Pay Commission for the last rank held has been provided.</p>
<p>A Junior Warrant Officer (JWO) who has not served for 10 months or more continuously in the rank is entitled to receive initial pension in the rank of Sergeant. However, where the revised pension as on 01.07.2014 worked out in terms of OROP order, happens to be less than the existing pension as on 01.07.2014, the pension has not been revised to the disadvantage of the pensioner.</p>
<p>Further, the issue whether in the case of JCOs / ORs, the pension is to be paid on the basis of the last rank held instead of last rank pensioned under OROP was referred to the Judicial Committee on OROP. The Committee has submitted its report to the Ministry which is under examination.</p>
<p>This information was given by Minister of State for Defence Dr. Subhash Bhamre in a written reply to Dr. P. Venugopal in Lok Sabha today.</p>

<p>Subject: <strong>Rate of Dearness Allowance applicable w.e.f.1.1.2017 to employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/grade pay as per 6th Central Pay Commission</strong><br />
The undersigned is directed to refer to this Department’s O.M.of even No. dated 9th November, 2016 revising the rates of Dearness Allowance w.e.f.01.07.2016 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/grade pay as per 6th Central Pay Commission.</p>
<p>2. The rate of DA admissible to above categories of employees of Central Government and Central Autonomous Bodies shall be enhanced from the existing rate of 132% to 136% w.e.f.1.1.2017.</p>
<p>3. The provisions contained in paras 3,4 and 5 of this Ministry&#8217;s O.M.No. 1(3)/2008-E.II(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.</p>

<p>Kolkata: The West Bengal Government has constituted the 6th Pay Commission for its own staff members and certain other categories of employees in the state to revise their salaries.</p>
<p>&nbsp;</p>
<p>Economist Abhirup Sarkar, who is a professor of the Indian Statistical Institute, has been appointed chairman of the eight-member Pay Commission, which is scheduled to submit its report within six months.</p>
<p>The state Assembly elections are slated for next year and the setting up of the pay panel was made eight days after the Central Pay Commission submitted its report.</p>
<p>&nbsp;</p>
<p>A Finance Department resolution yesterday said the decision was taken considering changes taken place in the structure of emoluments of state government employees in several respects since the 5th Pay Commission submitted its report.</p>
<p>&nbsp;</p>
<p>The Commission will also cover employees of local bodies, panchayats, public undertakings, teaching and non-teaching staff of government aided and sponsored educational institutions.</p>
<p>&nbsp;</p>
<p>As per its Terms and Reference, the Pay Commission would examine the present structure of pay and conditions of service, among other things.</p>
<p>&nbsp;</p>
<p>It would examine the existing promotion policies and related issues and suggest suitable changes.</p>
<p>It would also examine various allowances, besides issues relating to retirement benefits.</p>
<p>&nbsp;</p>
<p>To make recommendations on each of the above, the factors which will be considered included the prevailing pay structure under Central government, PSUs and other state governments, the economic condition of the country and the resources of the state government.</p>
<p>&nbsp;</p>
<p>The Pay Commission will devise its own procedures and may take help of other departments and make estimate of the cost involved in implementing their recommendations.</p>
<p>&nbsp;</p>
<p>“The Commission will submit their recommendations as expeditiously as practicable but preferably within a period of six months from the date of order notifying the constitution of the Commission,” the resolution said.</p>
<p>The Pay Commission may submit interim recommendations if found necessary or if so desired by the state government, it added.</p>

										<content:encoded><![CDATA[<p><strong>Status of MACP in the 7th pay commission</strong></p>
<p>Newspapers continuously update us with news about the recommendation of the 7th Pay Commission which holds the highest expectation levels at present. From such sources, we come to know that the recommendations of the 7th Pay Commission are going to be submitted on 31st of October and they may come to force from 1/4/2016.</p>
<p>Pay structure is very important and equally important is the promotion policy.<br />
Assured Career Progression (ACP) which was introduced in the 5th Pay Commission, provided some comfort for the employees who suffered from lack of promotions for long years. Before this, promotion was just an illusion. Labour Unions and Federations of the Central government employees got these benefits for us after much struggle.</p>
<p>In the recommendations of the 6th Pay Commission, which came after this, ACP was changed to MACP (Modified Assured Career Progression) and it provided an opportunity for employees who were not promoted for the last ten years to enter the next Grade Pay.</p>
<p>In this, the benefit was very small as 1800, 1900, 2000, 2400, 2800, 4200, 4600, 4800 (excluding 2800-4200). Many issues in this method of Grade Pay still lie unresolved before the National Anomaly Committee.</p>
<p>Hence, lakhs of Central Government employees expect a favourable change in MACP at least through 7th Pay Commission. During his or her service period, an employee must have at least five promotions. This has been an important plea of the Central Trade Unions.</p>
<p>The benefit of the first MACP has to be given after 8 years of continuous service and the benefit of the successive MACP has to be given after 7,6,5 and 4 years of continuous service.</p>
<p>If the benefits of MACP were such, certainly all the central government employees will be highly encouraged and will work hard to make all the Central Government plans and activities a great success.</p>
<p>This will definitely increase the productivity of the Central Government and the associated industries. Due to this, the relationship between the government and the employees will become more harmonious and there will be a peaceful working environment.</p>

										<content:encoded><![CDATA[<p>New Delhi,: The Seventh Pay Commission headed by Justice Ashok Kumar Mathur is likely to submit its report to Union Finance Minister Arun Jaitley in December, presumably recommending a 40 per cent hike in salary for the central government employees.</p>

<p>Justice Mathur already told PTI on August 25, “The Commission may submit its report by the end of September.”</p>
<p>“We are likely to recommend something for the good of central government employees, after observation of inflation, the government’s financial position and salary structure of government employees in other countries. The Finance Minister will give the latest highlights,” a top official of the pay panel said, speaking on condition of anonymity.</p>
<p>He also said it has been mandated to recommend incentive schemes to reward excellence in productivity, performance and integrity, which it will do.</p>
<p>“Though previous Pay Commissions have talked about linking pay with productivity, the earlier governments have not accepted such recommendations. Since this government has shown strong political will, we hope they will accept our recommendations,” he added.</p>
<p>Over 5 million central government employees are expecting a bounty from the report which is likely to recommend major changes in salaries and terms of employment, including performance-linked pay and incentives.</p>
<p>“A joint secretary gets now Rs 128,000 as monthly salary with dearness allowance. I do not expect it to go up to more than Rs 160,000,” a joint secretary-level official of the Central Government said.</p>
<p>In his pre-budget speech in February, Jaitley said,“the Seventh Pay Commission impact may have to be absorbed in financial year 2016-17.”</p>
<p>The salary outgo of central government employees will increase in financial year 2016-17 at 15.79 per cent to Rs 1.16 lakh crore with the likely implementation of the Seventh Pay Commission award, said the statement tabled by Finance Minister Arun Jaitley in Parliament on August 12.</p>
<p>The Seventh Pay Commission, which was set up by the UPA government, was required to submit its report by August-end. The government constitutes the Pay Commission almost every 10 years to revise the pay scale of its employees and often these are adopted by states after some modifications.</p>
<p>The Commission has already completed discussions with various stakeholders, including organisations, federations, groups representing civil employees as well as Defence services and is in the process of finalising its recommendations.</p>
<p>The recommendations of the Seventh Pay Commission are scheduled to come into effect from January 1, 2016.</p>
<p>The Sixth Pay Commission was implemented with effect from January 1, 2006, the fifth from January 1, 1996 and the fourth from January 1, 1986.</p>
