<h3 class="wp-block-heading"><strong>Sub: Rate of Dearness Allowance applicable w.e.f. 01.07.2021 and 01.01.2022 to those Railway employees who continue to draw their pay in the pre-revised pay scale/ grade pay as per 6th Central Pay Commission.</strong></h3>



<p>Please refer to this Ministry’s letter of even number dated 07.09.2021 (PC-VI/406, RBE No.65/2021) revising the rates of Dearness Allowance w.e.f. 01.07.2021 in respect of railway employees continuing to draw their pay in the pre-revised pay scale/ grade pay as per 6th Central Pay Commission.</p>



<p>2. The rate of DA admissible to railway employees of above category shall be enhanced from the existing rate of&nbsp;<strong>189% to 196% w.e.f. 01.07.2021</strong>&nbsp;and from&nbsp;<strong>196% to 203% w.e.f. 01.01.2022</strong>.</p>



<p>3. The provisions contained in Paras 3, 4 &amp; 5 of this Ministry’s letter of even number dated 09.09.2008 (S.No. PC-VI/3, RBE No.106/2008) shall continue to be applicable while regulating Dearness Allowance under these orders.</p>

<p>The Ministerial Staff Association, Survey of India has requested the Secretary to the Govt. of India, Ministry of Science &amp; Technology, Department of Science &amp; Technology, New Delhi to consider the comments/ facts/ proposal submitted by the association to grant of Level 8/9 on promotion after merger of Assistant &amp; Office Supdt. posts as per 6th CPC recommendations. MSA has also requested Department to heard the association before finalizing the Cadre Review, if considered necessary.</p>

<p>Respected Sir,</p>



<p>Department’s kind attention is invited to our letter No.CHQ- 07/MSA-(2022) dated 31st January, 2022 on the subject matter vide which a detail comments of stake holders along with a complete proposal in respect of Ministerial Cadre of Survey of India has been submitted to the Surveyor General of India, Dehradun along with a copy to the DST for their necessary action. A copy of the same is again submitted for your perusal and Department’s further necessary action.<ins></ins></p>



<p>2. In this regard, it is submitted that it has come to the notice of our Association that final Cadre Restructuring Proposal of Group ‘B’ &amp; ‘C’ cadre has been submitted to the Department by the Survey of India. However, no official information is available with us. We are not aware the facts that whether the Survey of India has considered our demands/proposal submitted under above referred letter or not. It was also requested by the association in above letter that the association may be heard before denial of points, if any, submitted by association on draft proposal report. The Department is well aware that the last meeting with association on the subject matter was held on 20.10.2010 i.e. 12 years before as already mentioned in the proposal. During that time when the meeting was held entire proposal of Cadre Restructure was different from this proposal. We have submitted several requests to permit us a meeting with Surveyor General of India to discuss our numbers of pending issues. But till today no meeting have yet been permitted by the Surveyor General’s Office.</p>



<p>3. Before submitting comments of stake holders by the Ministerial Staff Association on behalf of our Cadre, we were approached all office bears of MSA and after several detailed discussions through virtual meeting and telephonic conversation we proposed the cadre with full comments and justifications. Department is aware that our intake in the cadre is through SSC in the grade of UDC and LDC. As such graduate level entry in the Cadre is there so that considering facts of functional requirement, educational qualifications and emerging new technology in the Organisations we have proposed creation of new posts right from LDC to Director, up-gradations of pay level and change in nomenclature. So that highly educated and specially trained Technical officers of Survey of India should keep away from the day to day administrative jobs like accounts, establishment etc. The matter was also discussed from time to time with the presiding authority of Department as well with Organisation of Survey of India.<ins></ins></p>



<p>4. On perusal of cadre restructuring proposal submitted by a board of officers, it was found that even the recommendations of Sixth Central Pay Commission for subordinate/ non-secretariat administrative cadre starting from LDC/UDC has not been taken into consideration. <strong>The recommendation of the merger of Assistant and Office Superintendent and further grant of pay scale of PB-2 Grade Pay Rs. 4800 (Level-8) with NFU after 4 years in PB-2 Grade Pay Rs. 5400 (Level-9) to promotional post of merged grade.</strong> It is also a basic need of the Organisation on the functional requirement to create adequate posts to serve present and future administrative needs of SoI. During re-Organization of Survey of India in 2002-2003 it was also left. The new posts in Ministerial cadre must be created as proposed by the Association so that all administrative and accounts functions should be done by Ministerial Staff only along with store, estates, steno, reception and security functions on need base. It is again reiterated that Cadre Restructuring of Ministerial Staff should be done to utilise higher qualifications. The engineering and technical cadre of the Organisation should be utilized to complete the important projects like <a href="https://svamitva.nic.in/" target="_blank" rel="noreferrer noopener">SWAMITTVA</a>, NAMAMI GANGE, NHP etc.</p>



<p>It is requested to kindly consider the comments/facts/proposal submitted by the association. If Department consider necessary, to heard the association kindly intimate the earliest, please.</p>

<p>The undersigned is directed to refer to this Department’s O.M. No. 1/3(1)/2008-E.II(B) dated 1st November, 2021 on the subject mentioned above and to say that <strong>the rate of Dearness Allowance in respect of employees of Central Government and Central Autonomous Bodies who are continuing to draw their pay in the pre-revised Pay Scale/Grade Pay as per 6th Central Pay Commission, shall be enhanced from the existing rate of 196% to 203% of Basic Pay w.e.f. 01.01.2022.</strong></p>

<p>(a) &amp; (b): No, Sir. However, under the provisions of the Minimum Wages Act, 1948, both the Central and the State Governments are mandated to fix, review and revise the minimum wages of the employees employed in the scheduled employments in public and private sector under their respective jurisdictions. In order to protect the minimum wages against inflation, the Central Government revises the Variable Dearness Allowance (V.D.A) on basic rates of minimum wages every six months effective from 1st April and 1st October every year on the basis of Consumer Price Index for Industrial workers and accordingly it was last revised w.e.f. 01.10.2021. Statement showing increased rates of wages on account of revision in VDA from 01.04.2021 to 01.10.2021 is at Annexure.</p>

<p>Will the Minister of DEFENCE be pleased to state:-</p>



<p>(a) whether disability pension being is granted to the lower ranks/sepoy in the military and if so, the details thereof;</p>



<p>(b) whether some discrimination has been reported in sanctioning disability pension to some lower ranks/sepoy in the military;</p>



<p>(c) if so, the details thereof;</p>



<p>(d) whether the Ministry has received any grievance/request from lower ranks/sepoy in this regard; and</p>



<p>(e) if so, the details thereof and the action taken by the Ministry thereon?</p>



<p><strong>ANSWER</strong></p>

<p>(a) Yes, Sir. As per extant orders, Armed Forces Personnel including Sepoy who is invalided out from service on account of a disability which is attributable to or aggravated by Military service is being granted disability pension consisting of service element and disability element. The rate of disability element for 100% disability shall be 30% of emoluments last drawn by the individual. For lower percentage of disability, the disability element reduces proportionately.</p>



<p>(b) &amp; (c): No, Sir.</p>



<p>(d) &amp; (e): Saabka Sainik Sangarsh Committee submitted various representations regarding calculation of disability element on slab based system as had been recommended by 7th Central Pay Commission (CPC).</p>



<p>The 7th CPC recommended a return to the slab based system. The 7th CPC, however, in respect of Civilian Employees of Central Government had not made any recommendation. Civilian Employees of Central Government were getting disability pension under 6th CPC on percentage based system as such they will continue to get disability element on percentage based system. It created an anomalous situation. Therefore, the Service Headquarters requested to maintain Status quo i.e. to be continued the calculation method of disability element on percentage basis as per 6th CPC regime. The concerns of Services were examined in this Department and the matter was referred to Anomaly Committee on Pension through Department of Expenditure, Ministry of Finance.</p>



<p>Department of Expenditure, Ministry of Finance conveyed the approval of the Cabinet regarding recommendation of Anomaly Committee in the matter that parity with Civilian for grant of Disability Element which was granted to Defence Forces under 6th CPC regime, shall be maintained. Accordingly, orders were issued on 04.09.2017 for continuing Disability Element on percentage basis.</p>



<p>Saabka Sainik Sangarsh Committee was replied on the lines of existing position.</p>

<p>Dear Sir,</p>



<p>This Office is receiving representations from individual employees as well as from the employees organisation of various Ministries / Departments with regard to an unsettled anomaly in the date of increment which has cropped up after the implementation of 6th CPC recommendations. Details of the case with illustration is given below for your favorable consideration as a onetime measure.</p>



<p>During the year 2006 prior to publication of 6th CPC recommendations several promotions MACP / appointment took place in the month of January-2006. Accordingly individuals who have been promoted/MACP granted in Jan-2006 were supposed to get next increment in Jan’2007. But due to fixation of uniform annual increment fixed as 15t July of the every year by 6th CPC, The individuals got next increment in July-2007 instead of Jan-2007 ie. after 17 months ( more than 12 months) Instead of 12 months.</p>

<p>In order to address the such 6th CPC anomalies, vide ref(3) DoE has given an option of annual increment twice in a year 1.e. Jan &amp; July vide CC5(RP) rules,2016 and FR&amp;SR part-I w.e.f. 01/01/2016. But for the cases of MRCP/ Promotion/ Appointment between 2-jan to 3O June 2006 to 2015 whoever was granted the benefit of Entry Pay are not addressed. This batch got its first Increment after completion of 13 to 17 months service Instead of 12 months. But in same years i.e, between 2006¬2015 the individuals got MACP/PromotioniAppolntment between 2nd July to 31 December got the benefit July increment within the year. This situation is resulting the financial loss, incremental seniority loss and terminal benefits loss to the retiring employees.</p>



<p>In view of the above position we propose the following two option for the favorable consideration of the DOP&amp;T and Department of Expenditure for issuing of necessary government orders.</p>



<p><strong>Option 1:</strong></p>



<p><strong>The above illustration is self-explanatory that the individual if given increment in Jan/July-2007 will get next increment in reasonable period. Therefore, such individuals may be given an increment on next Jan/idly to rectify the anomaly risen w.e.f. 1/1/2006 onwards, The issue may be considered by amending the effect date of ref(3) OM retrospectively from 01/01/2006 in place of existing 01/01/2016</strong></p>



<p>Or</p>



<p><strong>Option 2:</strong></p>



<p><strong>Option may be given to those whose date of increment fallen beyond one year i.e. on 2-jan to 30 th June 2006 to 2015 entry pay due to 6th CPC uniform increment (July of every year) to switch over from 6th CPC to 7thCPC on 01/01/2016, so that their DNI can be January as per the guidelines of ref (3) M0F/DoE memorandum.</strong></p>

<h3 class="wp-block-heading">Subject: Payment of DA to the CDA pattern employees of CPSEs on 6th CPC pay scales governed by HPPC recommendations w.e.f. 01.07.2021.</h3>



<p>The undersigned is directed to refer to Para No. 2 and Annexure-III to this Department’s O.M. dated 14.10.2008 wherein the rates of DA payable to the employees of CPSEs who are following CDA pattern pay scales had been indicated.</p>



<p>2. The DA payable to the employees may be enhanced from the existing rate of <strong>189% to 196%</strong> with effect from <strong>01.07.2021.</strong></p>



<p>3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.</p>

<p>5. All administrative Ministries/Departments of Government of India are requested to bring this to the notice of Central Public Sector Enterprises under their administrative control for necessary action at their end.</p>
