<h3 class="wp-block-heading">Subject: Payment of DA to the CDA pattern employees of CPSEs on 5th CPC pay scales governed by HPPC recommendations w.e.f. 01.01.2022 &#8211; reg.</h3>



<p>The undersigned is directed to refer to Para No. 2 and Annexure-III to this Department’s O.M. dated 24.10.1997 wherein the rates of DA payable to the employees of CPSEs following CDA pattern pay scales, who are governed by HPPC recommendations had been indicated.</p>



<p>2. In continuation of this Department’s OM of even number dated 24.08.2021, the rates of Dearness Allowance payable to the employees of CPSEs governed by the recommendations of HPPC, which have <strong><span style="text-decoration: underline;">not</span></strong> revised their pay scales in terms of DPE O.M. No. 2(54)/2008-DPE(WC) dated 14.10.2008 may be as follows:-</p>



<ul class="wp-block-list"><li>a) In case of CPSEs who have <strong><span style="text-decoration: underline;">not</span></strong> allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees, the DA payable may be enhanced from existing rate of <strong>418% to 431%</strong> w.e.f. 01.01.2022.</li><li>b) In case of CPSEs who have allowed the benefit of merger of 50% of DA with basic pay as contained in DPE O.M. dated 24.05.2005 to their employees, the DA payable may be enhanced from existing rate of <strong>368% to 381%</strong> w.e.f. 01.01.2022.</li></ul>

<p>3. The payment of Dearness Allowance involving fractions of 50 paise and above may be rounded off to the next higher rupee and the fractions of less than 50 paise may be ignored.</p>



<p>4. All administrative Ministries/Department of Government of India are requested to bring the foregoing to the notice of the Central Public Sector Enterprises under their administrative control for necessary action at their end.</p>

<p>The undersigned is directed to refer to this Department’s O.M. No. 1/3(2)/2008-E.II(B) dated 1st November, 2021 on the subject mentioned above and to say that the rate of Dearness Allowance (DA) in respect of <strong>employees of Central Government and Central Autonomous Bodies who are continuing to draw their pay in the pre-revised Pay Scale/Grade Pay as per 5th Central Pay Commission, shall be enhanced from the existing 368% to 381% w.e.f. 01.01.2022.</strong></p>

<p>2. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M.No.1 (13)/97-E.II(B) dated 3rd October, 1997 shall continue to be applicable while regulating Dearness Allowance under these orders.</p>



<p>3. The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries / Departments which have adopted the Central Government scales of pay.</p>

<h3 class="wp-block-heading">Sub:- Grant of Dearness Relief in the 5th CPC series effective from 01.07.2021 to CPF  beneficiaries in receipt of basic ex-gratia payment-reg</h3>



<p>The undersigned is directed to refer to this Department’s OM of even no. dated 20.09.2021 and to say that the President is pleased to decide that the Dearness Relief admissible to the CPF beneficiaries in receipt of basic ex-gratia payment in the 5th CPC series shall be enhanced w.e.f <strong>01.07.2021</strong> in the following manner :</p>



<ul class="wp-block-list"><li>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and are entitled to basic ex-gratia @ Rs.3000, Rs.1000, Rs.750 &amp; Rs.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&amp;PW(E) dtd. 27th June, 2013 shall now be entitled to enhanced Dearness Relief from <strong>356%</strong> of the basic ex-gratia to <strong>368%</strong> of the basic ex-gratia w.e.f <strong>01.07.2021</strong>.</li></ul>



<ul class="wp-block-list"><li>(ii) The following categories of CPF beneficiaries shall be entitled to enhanced Dearness Relief from <strong>348%</strong> of the basic ex-gratia to <strong>360%</strong> of the basic ex-gratia w.ef <strong>01.07.2021</strong>:-<ul><li>(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are entitled to revised ex-gratia @ Rs.645/-p.m w.e.f 04 June, 2013 vide OM No 1/10/2012-P&amp;PW(E) dated 27th June,2013.</li><li>(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs.659/-, Rs.703/- and Rs.965/-.</li></ul></li></ul>



<p>2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>



<p>3. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>



<p>4. In so far as the persons serving in the Indian Audit and Accounts Department, are concerned, these orders are issued in consultation with the Comptroller and Auditor General of India, as mandated under Article 148(5) of the Constitution of India.</p>



<p>5. This issues in pursuance of Ministry of Finance, Department of Expenditure OM No. 1/3(2)/2008-E.11(B) dated 1st November, 2021</p>

<h3 class="wp-block-heading">Subject : Implementation of the Government decision on the recommendations of the fifth CPC regarding casualty pensionary awards for the Armed Forces Officers and JCOs &amp; Other Ranks.</h3>



<p>Sir,</p>



<p>The undersigned is directed to refer to this Ministry’s letter No. 1(2)/97/D(Pen-C) dated 31st January 2001. In terms of Para 4.1 of this letter, various categories have been enumerated for determining the pensionary benefits for death or disability under different circumstances due to attributable or aggravated by military service causes. One of the circumstances enumerated under Category ‘E’ (f) (ii) of the said para of the above mentioned MoD letter is ‘battle inoculation training exercises or demonstration with live ammunition.</p>



<p>2. Subsequently, it was decided to vide MoD letters No. 1(11)/2006-D (Pen-C)/PC dated 8th September 2009 and No. 1(11)/2006- D(Pen-C)/PC dated 5th March, 2010 that the term &#8216;Battle Inoculation Training Exercises&#8217; would cover the following six categories :</p>



<ul class="wp-block-list"><li>(i) Flying operation involved in rehearsing of war plans and implementation of OP instructions inclusive of international exercises.</li><li>(ii) All combat and Tactical Sorties in preparation of war.</li><li>(iii) Valley flying and missions involving operating at ultra low levels.</li><li>(iv) All operational missions undertaken during peace like Special operations, Live ORP, Recce, Elint, Survey and induction trials of new weapons.</li><li>(v) Missions undertaken in support of troops and security forces deployed in forward areas.</li><li>(vi) Flying missions involving landings on the ALGs.</li></ul>



<p>3. Para 2 of the MoD letter dated 08th September 2009 states that “cases already settled prior to the date of issue of this letter will not be reopened”.</p>



<p>4. The matter has been examined in this Ministry and it has been decided that the flying accidents cases that occurred on or after 01.01.1996 and which fall strictly under six categories mentioned at para 2 above may also be considered for grant of pensionary benefits in terms of MoD letter No. 1(2)/97/D(Pen-C) dated 31.01.2001. Accordingly, Para 2 of the MoD letter No. 1(11)/2006/D (Pen-C)/PC dated 8th September 2009 stands removed.</p>

<p>5. Service Hqrs./Record Offices concerned are advised to re-examine each such case strictly in accordance with six categories mentioned at para 2 above in consultation with PCDA without any deviation.</p>



<p>6. This issues with the concurrence of MoD(Fin/Pen) vide their UO No. 10(4)/2010/FIN/PEN dated 30.06.2021.</p>

<p>Subject- <strong>Revised rates of Dearness Allowance to the employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 5th Central Pay Commission from 01.07.2021</strong></p>



<p>The undersigned is directed to refer to this Department&#8217;s O.M. No. 1/3(2)/2008-EII(B) dated 25 October, 2019 revising the rate of Dearness Allowance (DA) w.e.f. 01.07.2019 in respect of employees of Central Government and Central Autonomous Bodies continuing to draw their pay in the pre-revised pay scale/Grade Pay as per 5 Central Pay Commission and to this Department&#8217;s OM No. 1/1/2020-E.I(B) dated 23.04.2020 vide which instalments of Dearness Allowance to Central Government employees due from 01.01.2020, 01.07.2020 and 01.01.2021, were frozen.</p>



<ol class="wp-block-list" start="2"><li>The rate of DA admissible to above categories of employees of Central Government and CentralAutonomous Bodies shall be enhanced from the existing <strong>312% to 356% of the Basic Pay with effect from 01.07.2021.</strong> The increase subsumes the additional instalments arising on 01.01.2020, 01.07.2020 and 01,01.2021. The rate of Deamess Allowance for the period from 01.01.2020 till 30.06.2021 shall remain at <strong>312%</strong></li><li>The provisions contained in paras 3, 4 and 5 of this Ministry&#8217;s O.M.No.1(13)/97-E.1I(B) dated 34 October, 1997 shall continue to be applicable while regulating Dearness Allowance under these orders.</li><li>The contents of this Office Memorandum may also be brought to the notice of all organisations under the administrative control of the Ministries/Departments which have adopted the Central Government scales of pay.</li></ol>

<p>Sir,</p>



<p>On the recommendations of the V CPC, Transport Allowance was introduced subsuming CCA W.e.f 1st January, 1997. After two revisions at par recommendation of VI and <strong><a href="https://centralgovernmentnews.com/category/7cpc/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">VII CPC</a></strong>, at present, admissibility of Transport Allowance under different conditions viz. Leave, Deputation, Tour and Suspension etc. is regulated under G.O.I, Min. of Finance, Dept. of Expenditure OM No. 21/5/2017E.II (B) dated 07.07.2017, as par Para 3(a) the Allowance will not be admissible for the calendar month(s) wholly covered by leave.</p>



<p>Incidentally it may kindly be noted that Govt. of India, Min. of Finance, Dept. of Expenditure has not yet clarification of “leave” as in the OM dated 17.07.2017 in the context of changed situation. Under normal dispensation Dept. of Expenditure is the competent authority to clarify/ interpret or modify and provision relation to <strong><a href="https://centralgovernmentnews.com/tag/transport-allowance/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">Transport Allowance</a></strong>.</p>



<p>On scrutiny of various OMs issued on different dates by MHA containing Guidelines, Advisories and Standard Operation Procedure as part of measures for containment of <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">COVID-19</a></strong>, it is revealed that Offices of the Govt. of India, its Subordinate Offices other than exempted category are to function with 100% attendance of Deputy Secretary and levels above that. Remaining officers and staff are to attend up to 33%. Moreover, above guideline is subject to strict adherence to restrictions applicable to RED ZONE/ CONTAINMENT ZONE. As per instructions, employees residing in such Zones can attend office only when allowed by the local authorities of concerned State Govt. etc. or restriction is relaxed. As per the above OMs the public transports including suburban train services were under total suspension till first 4 phases of lockdown. Further, as per Standard Operation Procedure of Min. of Health &amp; Family Welfare, the period of work from home shall not be treated as leave.</p>



<p>A good number of employees who commute from considerable distant places could not attend the office during the months making own arrangement, although, they were inclined to attend their duties being physically present in the offices premises. Further, according to the guidelines of Min. of Health &amp; Family Welfare as well as Ministry of Home Affairs is “to stay at home”, “work from home” to the extent possible, so as to curb the spread /outbreak of the COVID-19. During this period the entire surroundings of the National Library was under Containment Zone as per Govt. of West Bengal notification. In the Ministry of Home Affairs Order dated 15.04.2020 it was also clearly stated, “In these containment zones, the activities allowed under these guidelines will not be permitted….. that there is no unchecked inward/outward movement of population from these zones….. The guidelines issued in this regard…… will be strictly implemented….” Therefore some employee, though willing, could not come, even they have tried their best to join their duties.</p>



<p>This being an unprecedented situation, the condition of one-day attendance in a month, for payment of Transport Allowance, needs to be dispensed with and Transport Allowance for the month of April &amp; May 2020 should not be disallowed.</p>



<p>Your immediate intervention in this matter is highly solicited with a request to issue revised direction to the administration of the National Library and Central Reference Library for payment/ settlement of Transport Allowance for the month of April 2020, etc.</p>

<p>With due regards, it is submitted that after implementation of recommendations of 5th CPC, Ministry of Finance (Department of Expenditure) vide its Notification G.S.R. 552 (E), Dated 28th July 2009 amended the Central Civil Service (Revised Pay) Rules, 2008 whereby Master Craftsmen were granted the Grade Pay of Rs. 4200/- and Highly skilled Workers were split in a ratio of 50 : 50 and re-designated as Highly Skilled Worker Grade-II (Grade Pay of Rs. 2400 in Pay Band PB &#8211; 1) and Highly Skilled Worker Grade-I (Grade Pay of Rs. 2800/- in Pay band PB &#8211; 1).</p>

<p>Accordingly the pay scale of Master craftsman was revised from Rs. (4500 &#8211; 7000) to Rs. (5000 &#8211; 8000) vide MOD letter F. No. 11(5)/2008/D (Civ-I) Dated 28th Aug , 2009 as per SRO &#8211; 11 E and the post of Highly Skilled (4000 &#8211; 6000) was bifurcated in the ratio of 50 : 50 whereby 50 per cent incumbents had been upgraded as Highly Skilled grade &#8211; I in the pay scale of Rs. (4500 &#8211; 7000). As per above notification, the artisan staff in MOD is restructured w.e.f. 01.01.2006 as under :</p>



<ul class="wp-block-list"><li>Skilled (5200 &#8211; 20200) plus 1900 Grade pay</li><li>Highly Skilled &#8211; II ( &#8211; Do &#8211; ) plus 2400 Grade pay</li><li>Highly skilled &#8211; I ( &#8211; Do &#8211; ) plus 2800 Grade pay</li><li>Master Craftsman (9300 &#8211; 34800) plus 4200 Grade pay</li><li>According to above, the grade structure of Skilled, Highly Skilled -II, Highly Skilled-I and Master Craftsman has been revised vide MOD letter No. 11 (5)/2009-D(Civ.I), dated 14th June 2010 as under w.e.f . 01.01.2006 : ‘</li></ul>



<p><strong>(i) Skilled 45 %<br />(ii) Highly Skilled Grade II 20.625 %<br />(iii) Highly Skilled Grade I 20.625 %<br />(iv) Master Craftsman 13.75 %</strong></p>



<p>It is worth to mention here that MoD is taking all necessary action to further revise the structure/inter grade ratio of artisan cadre whereas Coast Guard organization under Ministry of <strong><a rel="noreferrer noopener" href="https://centralgovernmentnews.com/category/defence/" target="_blank">Defence</a></strong> has not implemented the existing structure/ inter grade ratio which is effected from 01.01.2006. This is causing very much disappointment in the artisan cadre incumbents.</p>

<p>Sub:- <strong>Grant of Dearness Relief in the 5th CPC series effective from 01.01.2019 to CPF beneficiaries in receipt of ex-gratia payment &#8211; reg</strong></p>



<p>In continuation of this Department’s OM No. 42/06/2018-P&amp;PW(G) dated 08.10.2018, the President is pleased to decide that the Dearness Relief w.e.f 01.0 l.20 19 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner :-</p>



<p>(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and were sanctioned ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&amp;PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000, Rs.750 &amp; RS.650 for Group A, B, C &amp; D respectively w.e.f 4th June,2013 vide OM No. 11l0/2012-P&amp;PW(E) dtd. 27th June, 2013 shall be entitled to enhanced Dearness Relief from 284% to 295% w.e.f 01.01.2019.</p>



<p>(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No.45/52/97-P&amp;PWCE) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 276% to 287% w.e.f 01.01.2019.</p>



<blockquote class="wp-block-quote is-layout-flow wp-block-quote-is-layout-flow"><p>(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and were sanction ex-gratia payment of Rs. 605/- p.m. and revised to Rs.645/-p.m w.e.f  04 June, 2013 vide OM No 1110/2012-P&amp;PW(E) dated 27th June, 2013.</p><p>(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs.659/-, Rs.703/- and RS.965/-</p></blockquote>



<p>2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.</p>



<p>3. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.</p>



<p>4. In their application to the Indian Audit and Accounts Department, these orders issue after the concurrence of % C&amp;AG.</p>



<p>5. This issues in pursuance of Ministry of Finance, Department of Expenditure OM No. 1/3/2008- E.II(B) dated 08th March, 2018.</p>

<p>Ref: Railway Board’s letter No.F(E)III/2008/PN1/l2 dated 04/02/2019</p>



<p>Kind attention of Railway Board is invited to the instructions issued vide Board’s letter dated 04/02/2019 relating to revision of pension of pre-2006 pensioners/family pensioners w.e.f.01/01/2006 who had retired from Railway service while in 5th CPC scale of Rs.6500-10500 duly enclosing Department of pension and pensioners’ Welfare (DoP&amp;PW’s) O.M.No.38/33/12-P&amp;PW(A) dated 4th January, 2019 stating that these instructions shall apply mutatis mutandis on Railways also.</p>



<p>ln this connection, NFIR desires to state that the pensioners who had retired from Railway service in 5th CPC pay scale Rs.6500-10500 and family pensioners continued to be aggrieved over DoP&amp;PW O.M. dated 4th January, 2019 and Railway Board’s letter dated 04/02/2019 as mentioned below:-</p>



<p>Vide Dop&amp;PW’s O.M. dated 4th January, 2019, an example has been mentioned which allows revision of only minimum Pension/Family Pension to Rs.8345/5007 respectively.</p>



<p>The O.M. does not cover the cases of Pensioners/Family Pensioners who had drawn higher pay at various stages upto maximum of Rs. 10500 in 5th CPC Pay Scale Rs.6500-10500.</p>



<p>The V CPC pay scale of Rs. 6500-10500, although initially treated as equivalent to GP 4200 (PB-2), subsequently the Government had granted replacement Grade Pay 4600 (PB-2) w.e.f.01/01/2006. Therefore, last pay drawn by the pre-2006 retired Railway employees in the Pay Scale should have been the criteria for revising the pension/family pension duly calculating notional Pay in GP 4600 (PB-2)</p>



<p>The O.M. dated 04/01/2019 needs to be modified suitably for covering all cases of pre-2006 pensioners/family pensioners as proposed below:-</p>



<p>Last pay drawn in pay scale Rs. 6500-10500 at the time of retirement/death to be calculated notionally in 6th CPC in PB-2 + GP 4600, and Pension/Family Pension re-fixed based on i.e. 50% / 30% of such notional pay respectively. These pensioners/family pensioners are to be paid arrears accrued from 01/01/2016, similar to all other pre-2006 pensioners/family pensioners as per RBE No.l7/2019 dated 04/02/2019.</p>



<p>Separate concordance table needs to be prepared and circulated on the basis of pay drawn by the pensioners/Family pensioners in V CPC Pay Scale of Rs.6500-10500 vis-a-vis GP 4600 in PB-2. Based on para 4.2 of Railway Board’s circular dated 04/09/2008 new revised concordance table say 25A is to be prepared/introduced to cover all cases.</p>



<p>While undertaking revision of pension/family pension cases as per RBE No. 17/2019 dated 04/02/2019, Zonal Railways have been facing difficulties as the revision in GP 4600/- under 6th/7th CPC has not been systemized under ARPAN. In absence of proper concordance table for notional pay fixation of pensioners/family pensioners, as on 01/01/2006, the Zonal Railways etc., have also been facing difficulty in undertaking revision of pension/family pension. It is also suggested that the concordance table No.26 available with Board’s letter dated 11/07/2018 for GP 4600 (corresponding 5th CPC Scale Rs. 7450-11500) may be made applicable in the instant case of pension/family pension revision. Federation cites Western Railway’s reference to Railway Board vide letter No. Pen/05372/E789/ARPAN/PRE-2016 dared 18/02/2019 seeking guidelines.</p>



<p>Federation requests the Railway Board to take note of genuineness of the case for highlighting to DoP&amp;PW / MoF to review and render justice to these pensioners/family pensioners of pre-2006 era. A new concordance table 25-A needs to be created/incorporated for the V CPC pay scale Rs. 6500-10500 vis-a-vis GP 4600 (PB-2).</p>



<p>NFIR, therefore, requests the Railway Board to approach DoP&amp;PW/MoF for getting the O.M, dated 04th January, 2019 modified with a view to revise pension to those pensioners who were in puy scale Rs. 6500-10500 (V CPC) and drew higher pay at various stages upto Rs. 10500 and above (including stagnarion increment) to ensure equal treatment with other pensioners. A.copy of the proposal sent to the DoP&amp;PW may be endorsed to the Federation for follow up action.</p>
