<p>Dear Sir,</p>
<p>I solicit your kind attention to my letter in No.NC/JCM/2014 dated 16 th December, 2014, wherein we had conveyed the decisions taken at the National Convention of representatives of the organisations participating in the JCM. We are distressed that you have chosen not to respond to our letter till date. We have so far not received any communication from any quarter of the convening of the National Council of the JCM. No effort has also been taken by any Ministry to convene the Departmental Councils.</p>
<p>We have now been given to understand that the Government has taken serious steps to set up a corporation to carry on the functions of the 41 ordnance Factories, presently functioning under the Ministry of Defence. We have also noted that the report of the Committee set up by the Government to corporatize the functions of the Postal Department. The inordinate delay in settling the demands for Interim Relief and Merger of DA is causing distress amongst the Central Government employees. The Railwaymen are particularly agitated over the decision of the Government to induct FDI to the extent of 100% in Railways, which we are aware cannot be done without privatisation of the Railways. The declaration of the Convention, which we had forwarded to you vide our letter cited had amply explained the anguish of the Central Government employees.</p>
<p>In order to register our opposition to the recent decision of the Government to corporatize the functions of the Ordnance factories, we have amended Item No.2 of the charter of demands. We send herewith the revised charter of demands.</p>
<p>The National JCA met today and took note of the silence on the part of the Government to our pleadings. The meeting has, therefore, decided to go ahead with the agitational programmes, the first phase of which will culminate in a massive March to Parliament by Central Government employees on 28th April, 2015. If no settlement is brought about on the 10 point charter of demands, we will be constrained to go for an indefinite strike action, the date of commencement of which will be decided on 28 th April, 2015.<br />

<p>Dear Comrades,</p>
<p>As scheduled, the meeting of the National JCA was held at the Staff Side office today, i.e. 11th January, 2015. The list of members who attended the meeting is annexed to this communication. The meeting was chaired by Com. M. Raghavaiah, General Secretary, National Federation of Indian Railwaymen. The meeting made the following observations and took the following decisions:</p>
<p>The Statement made by Shri Narendra Modi, Honourable Prime Minister of the country at Varanasi to the effect that the Railways would not be privatised was misleading and intended to create confusion in the minds of the Railwaymen, especially in the background that the proposal to induct FDI in Railways to the extent of 100% is being pursued vigorously.<br />
The Government has decided to set up a Corporation to carry on the functions of the 41 ordnance factories under the Ministry of Defence.<br />
Except in a few States, the steps required to be taken for form the State level Committees of the JCA have not been undertaken.<br />
In order to expedite the formation of such committee in all States, the NC JCM website will carry the names and addresses of the State leaders of the participating organisations<br />
The Zonal Secretaries of AIRF will be asked to ensure that such committees are formed at all State Capitals before the end of this month and the convention is held on a mutually convenient date for all but before 15th February, 2014.<br />
District conventions or March to Collectorates will be organised by the Committee in all District capitals of the country.<br />
The entire month of March and the first half of April will be utilised for campaigning amongst the employees at all work- spots.<br />
The March to Parliament will be organised on 28th April, 2015.<br />
Every effort will be taken to reach a target of 5 lakh workers to participate in the said March. Target quota for each organisation will be fixed.<br />
The State Committees will advise the National Convenor as to which organisations (those CGE organisations who are not presently participating in the JCM must be addressed to join the movement.<br />
The State Committees after the convention will hold Press Conferences to give media publicity to the decisions taken including the decision to go on indefinite strike action.<br />
The National JCA will hold a Press Conference at Delhi prior to the March to Parliament programme.<br />
The Charter of demands will be amended (Item No.2) to include the following words: “and ordnance factories under the Ministry of Defence.”<br />
Reminder letter will be sent to the Cabinet Secretary expressing distress over his silence and the non convening of the National Council, Anomaly Committee and Departmental Councils of the JCM.<br />
The Convenor reported that the 7th CPC has informed him of their intention to convene the meeting of the organisations for tendering oral evidence in the month of February, 2015.</p>

CGEC, NOCGE, INTUC<br />
To observe “NATIONAL PROTEST DAY” ON 5th December, 2014<br />
All Over India along with all Central Trade Unions in India</p>
<p>New Delhi, Nagpur,Mumbai,Ranchi, Bangalore, Cochin; 24/10/2014<br />
Central Government Employees Confederation (CGEC); National Organisation of Central Government Employees (NOCGE) and INTUC have unanimously resolved to observe “NATIONAL PROTEST DAY” on 5th December, 2014 all over India along with all Central Trade Unions in India (Viz: INTUC, BMS, CITU, HMS, AITUC, TUCC, AIUTUC, AICCTU, UTUC, SEWA, LPF and all Federations of Banks, Railways (NFIR &amp; AIRF), Defence (INDWF &amp; AIDEF), Insurance, Central/State Govt. and other Service Establishments Employees).<br />
<strong>Demands</strong></p>
<p>1. Central Govt. should desist from its unilateral move to amend Labour Laws and consult and honour the views of Central Trade Unions.</p>
<p>2. Central Govt. should withdraw the retrograde move in allowing/hiking Foreign Direct Investment (F.D.I.) in Defence Sector, Railways, Insurance, PSUs and other Sectors.</p>
<p>3. Restore minimum wages of Rs.15,000/- to all the Unorganised/Contract Workers and Minimum Wages of Rs.26,000/- to the lower paid employees of Central Government.</p>
<p>4. Demands of Bank Officers and Bank Employees should be immediately accepted in respect of their Wage Revision and other privileges and social security measures, which are over due (Go through the Circulars dated 14/10/2014 &amp; 16/10/2014 issued by the UFBU, AIBOBOA, INBOC, INBEC and INBEF etc.)</p>
<p>5. Strict implementation of existing Labour Laws concerning the Welfare of the Working Class all over India.</p>
<p>6.Benefits of Regular Workers should be given to all Contract Workers.</p>
<p>7. Compulsory Registration of Trade Unions within 45 days and all the ILO Conventions meant for the Workers should be ratified by the Govt. Of India.</p>
<p>8. 50% D.A. of Central Staff should be merged with Pay and Interim Relief should be paid to all employees, pending finalisation of the 7th Central Pay Commission.</p>
<p>9. Minimum 4 Promotions should be given to all Central Govt. Officials, without the hindrances of Departmental Examinations and DPC proceedings, on or before their respective date of retirements.<br />
10. MACP/ACP benefits should be extended to all Central Government Employees, including the staff of Autonomous Body/Semi-Govt. Departments.</p>
<p>11. Bonus eligibility and Bonus Ceiling should be raised as per the present Price Index Cost of Living and Updated Model of Pay Structure.</p>
<p>12. Present quantum of Pension should be raised with adequate Medical facilities/Medical Allowance and the New Pension Scheme should be liberalised as Worker-Friendly.</p>
<p>Accordingly, all the Unions, Associations and their Federations are requested to observe “NATIONAL PROTEST DAY” on 5th December, 2014 by way of Mass Demonstrations and Mass Protest Meetiungs &amp; Rallies all over India and give wide publicity through Newspapers, T.V. Channels and AIR/Doordarshan etc. Concerned Office-bearers are requested to send a report after observing the above programme of action to the undersigned on or before 15/12/2014.</p>

										<content:encoded><![CDATA[<p><strong>CG Employees Launch Countrywide Stir Demanding 7th Pay Commission Interim Relief</strong></p>
<p>The Central Government employees are going to launch nationwide protests, stressing that their 11-point demands, including interim relief for the 7th Pay Commission, be granted.</p>
<p>Duraipandian, the General Secretary of Central Government Employees Federation, said, whenever the Pay Commission is constituted, interim reliefs are announced. But this time, when the 7th Pay Commission was announced, we weren’t given interim relief.</p>
<p>We want the new pension scheme to be revoked and old pension scheme to be reinstated. Outsourcing of Central Government jobs to private firms must stop. And, we want the more than 6 lakh vacancies in various central government agencies, like the Railways, Income Tax Departments, to be filled up.</p>
<p>We are going to launch nationwide Dharna protests (except Jammu and Kashmir), demanding that these 11 conditions be fulfilled.</p>

<div>The Confederation of Central Government employees and workers is the apex level organisation of all Federation/Association/Unions of CGEs other than in the Railways and Defence Departments. It was in the wake of a strike action in 1960s by the Central Govt. Employees, the Govt. of India set up permanent negotiating machinery called JCM so that the employees will be able to raise their demands and grievances and seek settlement thereof through dialogue. This machinery has now come to a standstill as the Govt.does not convene the meetings of the councils at the National and Departmental levels on one pretext or the other. A new set of rules for grant of recognition of service associations were promulgated in 1993. Many Ministries, despite the employees organizations abiding by the stipulated conditions, have not afforded recognition to the Associations/Federations, thereby closing all channels of communication. The JCM had the facility of referring the issues on which the Government could not agree upon to the Board of Arbitration. The decision/award of the Board was binding on all parties. Still the Government had been rejecting the awards in favour of the employees on the specious plea of adverse impact on national economy by presenting resolutions in the Parliament. We need not emphasise the unethical character of this approach which undermines the confidence of the employees in the fairness of the system.</div>

<div>The 6th CPC recommendations and its implementation had given rise to various anomalies. The employees genuinely felt that the said anomalies would be removed through discussions for which the Government had set up a committee. The Committee despite meeting on four occasions had not been able to settle the issues; nor could it be referred to the Arbitrator. No decision has been taken by the Government so far as to the fate of these anomalies.</div>

<div>The Government set up the 7th CPC in September last. Its notification was issued early this year. Despite assurance being held out, the terms of reference was not subjected to discussion with the staff side with the result the demand of the employees to include the Gramin Dak Sewaks within the ambit of the Commission was not acceded to. The 6th CPC recommendations were implemented with effect from 1.1.2006. The revision of wages was due on 1.1.2011 having completed five years. Wage revision is permitted in the Public Sector undertaking every five years. The value of wages fixed in 2006 has been eroded significantly during the period due to the high rate of inflation and price rise.</div>
<div></div>
<div>The new contributory pension scheme was introduced by the Government on the plea that the pension liability has become unbearable and is a drag on the exchequer. In our Memorandum to the then Prime Minister, we had raised several issues and had pointed out that the financial outflow on account of the new scheme will be much more than the existing defined benefit scheme. We had indicated in our memorandum quite a number of aspects which would be detrimental to the interest of workers. The Government has decide allow FDI in pension fund operations. This will only result in the flow of Indian Savings for investment outside the country.</div>

<div>We submit herewith the charter of demands which requires settlement urgently. We have also appended a Note on each of the issues included in the charter of demands, which is self explanatory. We shall be grateful if these issues are caused to be considered by the concerned departments of the Government of India and brought before the negotiating forum for settlement.</div>

										<content:encoded><![CDATA[<p><strong>Confederation declares Nationwide Agitational Programme – Demands including DA Merger and Interim Relief</strong></p>
<p>Confederation publishes  an organized series of agitational programme on its portal toady including the burning issues DA Merger and Interim Relief.</p>
<p style="text-align: center;"><strong>CONFEDERATION DECLARES NATIONWIDE AGITATIONAL PROGRAMMES</strong></p>
<p>Dear Comrades,</p>
<p>The National Sectt. of the Confederaton met at New Delhi on 11.08.2014 to consider the follow up action required in the matter of some of the pressing issues on which Confederation had organized series of agitational programmes prior to the commencement of the Election process of the 16th Lok Sabha. The CHQ has received reports from various affiliaties to the effect that they have all endorsed the common memorandum, the Confederation had submitted to the 7th CPC. Most of the affiliates have emailed copies of the respective memorandum to the CHQ. Those who have not sent copies are requested to do so without further loss of time. This will enable the Confederation to write to the 7th CPC to provide an opportunity to these organisations to tender oral evidence to explain and elucidate their submissions in the memorandum.</p>
<p>The meeting noted that there has been only negative response from the Government on the issues of Interim Relief and merger of DA.</p>
<p>We have already sent to you a copy of our letter addressed to the Seretary, Staff Side, JCM National Council, (Com. Shivgopal Mishra) which is yet to be responded. The meeting considered the following issues as important, the pursuance of which must not brook any delay, especially in the background that the 7th CPC has formally written to the Government asking it to indicate the course of action required to be taken on the memorandum of the staff side on Interim Relief and marger of DA.</p>
<p><strong>CHARTER OF DEMANDS</strong></p>
<blockquote><p><strong>1. Merger of DA with pay for all employees with effect from 01.01.2014 including Gramin Dak sewaks and pensioners.</strong></p>
<p><strong>2. Grant of Interim Relief to all employees including Gramin Dak Sewaks and Pensioners.</strong></p>
<p><strong>3. Inclusion of Gramind Dak sevaks under the purview of 7th Central pay Commission.</strong></p>
<p><strong>4. Scrap PFRDA Act and grant of statutory pension to all.</strong></p>
<p><strong>5. Date of effect of 7th CPC recommendations should be 01.01.2014.</strong></p>
<p><strong>6. Regularisation and revision of wages of casual laboures and contract workers.</strong></p>
<p><strong>7. Removal of 5% condition for compassionate appointments.</strong></p>
<p><strong>8. Fill up al vacant posts and creation of new posts wherever justified.</strong></p>
<p><strong>9. Stop downsizing, outsourcing, contractorisation and privatisation of Government functions.</strong></p>
<p><strong>10. Grant Productivity linked Bonus to all without ceiling; compute Bonus as weighted average of PLB for those not covered by PLB agreement.</strong></p>
<p><strong>11. Revise OTA and NDA and implement arbitration awards.</strong></p></blockquote>
<p>The meeting also considered the policy perception of the new Government in the light of the administrative price hike in petroleum products, the proposals in the Railway and General Budget, the steep hike in the freight and passenger fares of Railways, the decision to hike FDI in Defence Production, Railway Infrastructure and Insurance sectors, disinvestment of public sector including nationalized banks and have come to the inescapable conclusion that under Narendra Modi dispensation, the neo-liberal policies, as expected, will only be intensified and the promised “Achche Din” is for the Corporate giants of the country. The last session of the Parliament witnessed the determination of the NDA Government in changing the labour laws on the lines of the enactment made by Rajasthan Government of Vasundhara Raje Scindhia by virtue of which in almost 90% of the manufacturing units in India, the employers are permitted to indulge in hire and fire policy, for the existing regulations will be dispensed with.</p>
<p>The meeting came to the decision that the confederation must organise serious and prolonged campaign, preferably in unison with the Railway and Defence Federations. We will pursue our consultation with those Federations to reach a common approach in the matter. Since it might take some more time, the meeting decided to pursue the demands through a demonstrative programme.</p>
<p><strong>11th September 2014 –</strong> Submission of the Charter of Demands along with a brief Note to all heads of offices by arranging demonstration in front of all offices; the branch level/district/divisional/state level leaders will explain the demands especially the memorandums on interim relief, DA merger and GDS issues.</p>
<p><strong>19th September 2014 –</strong> Dharna between 10 AM to 3 PM at all important state/districts/divisional centres.</p>
<p><strong>25th September 2014</strong> – Dharna between 10 AM to 3 PM at New Delhi with participation of the leaders of all affiliates and the members working in the city of Delhi (at a central place-to be decided by the Confederation Delhi State committee).</p>
<p>Confederation office Bearers will meet again at Delhi on 26.09.2014, 5 PM to decide further course of action. Confederation will bring out pamphlets and bulletins to explain various issues like minimum wage, DA, Bonus, GDS problems etc. shortly as part of an education campaign. The detailed campaign programe to be undertaken after Diwali festival will be intimated later.</p>

<p>Government of India totally failed to take effective measures to arrest the spiraling price rise and contained inflation. Dearness allowance which is paid to neutralize the inflation is not sufficient and employees are facing hardship.</p>
<p>Their is delay to announce the recommendation of <em>7th CPC</em>.</p>
<p>BRMS demand that Government should announce atleast Rs. 7000.00 as interim relief to meetout the arrogant expenses due to inflation.</p>

<p style="text-align: center;"><strong>Merger of 50%DA allowances into Basic Pay.</strong></p>
</blockquote>
<p>5th CPC has recommended that whenever the dear allowances exceeds 50% , it should be merged in the basic pay. While 6th CPC had also observed that a portion (25%) of DA should be merged whenever it exceeds of 50% for certain part of the pay packet.</p>
<p>BRMS has been demanding that it should be automatic as and when dearness allowance crosses 50% mark and it should be merged with the basic pay as there is no pay revision after 4 or 5 years as in the case of public sector/financial sector employees. It is stated that NDA Government had already merged the 50% DA of serving and retired employees for all purposes when it cross 50%.<br />

<p>In Parliament Minister of State for Finance Shrimati.Nirmala Sitharaman said in a written reply to a question on 5th August 2014 regarding grant of interim relief to Central Government employees.</p>
<p>She said that there is no proposal for grant of Interim Relief to Central Government employees is at present under consideration of the Government.</p>
<p>She also added, the 7th Central Pay Commission has already been set up vide Resolution dated 28th February, 2014. The Commission has started functioning.</p>

</blockquote>
<p>It is strongly recommended that whenever DA cross the 50% mark, it should be merged with the basic Pay and all perquisites be given after adding the merged portion of DA.</p>
<p>It also recommended that in the eventuality of DA crossing the 100% mark with Pay commission recommendations awaiting, then a system should be evolved for automatic merger of the DA and also grant of Interim Relief at 10% of the revised emoluments.</p>
