<h3 class="wp-block-heading"><strong>Release of Stagnation Increment notionally for the purpose of Pension under the 10th Bipartite Settlement/ Joint Note</strong></h3>



<p>In the 10th Bi-partite settlement / Joint note signed on 25.05.2015, an additional stagnation increment was considered for award staff and certain scales of officers to be notionally released from 1/11/2012 with monetary benefit to be paid from 1/5/2015. Those staff members who continued to be in the service post 30/4/2015 got monetary benefits in wages as well as benefits in their pension eligibility at the time of retirement. It was not explicitly mentioned in the bipartite/joint note that the benefit of notional stagnation increment would also be extended to those staff members who retired during the period from 1/11/2012 and 30/4/2015. While some banks have also extended the benefit to retirees, others have not extended the benefit of notional stagnation increment to those staff members who retired during the period from 1/11/2012 to 30/4/2015.</p>



<p>2. We have been receiving references from few banks, Officers, and Workmen Unions wherein they have stated that there is a need to clarify to banks that the benefit of notional increment should also be extended to all those staff members/officers who retired from the services during the period from 1/11/2012 to 30/4/2015.</p>



<p>3. The matter was placed in the meeting of the IBA Standing Committee on HR held on 11.01.2021. The Committee after detailed deliberations noted that some banks after obtaining a legal opinion, have already extended the benefit of notional stagnation increment for a pension to workmen and officers who retired during the period from 01.11.2012 to 30.04.2015. Accordingly, to have an industry level uniformity, it was decided that the banks with the approval of their respective boards can extend the benefit of notional stagnation increment for the purpose of pension only to the workmen and officers who were otherwise eligible and retired during the period from 01.11.2012 to 30.04.2015, with monetary benefit from 1/5/2015.</p>

<p><strong>Dearness Allowance for Workmen and Officer Employees in banks for the months of August, September &amp; October 2020 under X BPS/ Joint Note dated 25.5.2015</strong></p>



<p>The confirmed All India Average Consumer Price Index Numbers for Industrial Workers (Base 1960=100) for the quarter ended June 2020 are as follows:-</p>



<p class="has-text-align-left"><strong>April 2020 – 7509.72<br />May 2020 – 7532.55<br />June 2020 – 7578.20</strong></p>



<p>The average CPI of the above is 7540 and accordingly the number of DA slabs are 775 (7540 – 4440= 3100/4= 775 Slabs) The last quarterly Payment of DA was at 761 Slabs. Hence there is an increase in DA slabs of 14 i.e. 775 Slabs for payment of DA for the quarter August, September &amp; October 2020</p>



<p>In terms of clause 7 of the 10th Bipartite Settlement dated 25.05.2015 and clause 3 of the Joint Note dated 25.05.2015, the rate of Dearness Allowance payable to workmen and officer employees for the months of August, September &amp; October 2020 shall be 77.50 % of &#8216;pay&#8217;. While arriving at dearness allowance payable, decimals from third place may please be ignored.</p>

<p>Minutes of the discussions held on 22nd July, 2020 between IBA representation Management of banks which are parties to the Bipartite Settlement and Workmen Unions and Officers’ Associations on wage revision.</p>



<p>Discussions were held between the Indian Banks’ Association representing Managements of banks and the authorized representatives of workmen Unions and Officers’ Associations on wage revision for officers and workmen in banks.</p>



<p>The management and the Unions representing Officers and Workmen staff, acknowledge the need for a robust banking system which is representative to the challenges facing the country and the need to improve further the productivity, efficient and responsiveness to the needs of the customers and various state holders. With this commitment, it has been agreed to resolve the pending wage settlement issue and enter into an MoU as under:-</p>



<ol class="wp-block-list"><li>The wage revision will be effective from 1.11.2017.</li><li>The annual wage increase in salary and allowances is agreed at 15% of the wage bill as on 31-3-2017 which works out to Rs.7,898 crores on Payslip components.</li><li>The new pay scales will be constructed after merging Dearness Allowance corresponding to 6352 points (average Index point as applicable for the Quarter of June, July, August 2016) and adding thereon a loading of 2.50% on Basic Pay plus Dearness Allowance as on 31″ March 2017 amounting to around Rs. 1155/- Crores.</li><li>Distribution of annual wage increase between Workmen and Officers will be worked separately and proportionately based on breakup of establishment expenses as on 31.3.2017.</li><li>In today’s Banking scenario, there is stiff competition amongst different category of banks i.e., Public sector, Private sector, Foreign banks. In order to inculcate a sense of competition and also to reward the performance, the concept of Performance Linked Pay is felt to be introduced. After prolonged discussions and deliberations on this matter, it has been agreed to introduce Performance Linked Incentive (PLI) in Public Sector Banks, which will be based on Operating/ Net Profit of the individual bank (optional for private &amp; foreign banks). The PIA is payable to all employees annually over and above the normal salary payable. The PLI matrix decides the amount payable to the employees (in number of days of pay-Basic+DA) depending on the annual performance of the bank. All the employees will get the number of days of pay as incentive depending on where in the matrix the bank’s performance fits in, broadly as per pay Matrix under :</li></ol>

<ol class="wp-block-list" start="6"><li>From the calendar year 2020, besides encashment of PL at the time of retirement and during availment of LFC, PL Encashment would be permitted at 5 days every calendar year (7 days in case of employees/officers of 55 years of age and above) at the time of any festival of their choice.</li><li>It has been agreed to increase the banks contribution to the <a href="https://centralgovernmentnews.com/category/nps/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">NPS</a> fund to 14%, i.e. 14% of Pay &amp; Dearness Allowance instead of the present rate of 10% from the prospective date of signing the settlement subject to approval of the Govt.</li><li>All other issues of the Managements and Unions/Associations discussed during the process of negotiation will be settled to the mutual satisfaction.</li><li>The parties will meet on mutually convenient dates to draw out a detailed Bipartite Settlement / Joint Note on the various issues on which consensus positions have been reached. The parties will endeavor to finalize the Bipartite Settlement / Joint Note within a period of ninety days from the date of this minutes.</li></ol>

<p>Though I did not receive any communication from your office but we understand that a meeting of the Negotiating Committee is slated on 22 July 2020 at Mumbai.</p>



<p>In the wake of recent increase of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" aria-label="undefined (opens in a new tab)" rel="noreferrer noopener">Covid-19</a> pandemic in our country, there are suspension withdrawal of public transport including flight operations effective in different Parts of the country.</p>



<p>So far Kolkata is concerned, all flights connecting six cities including Mumbai are suspended till 31st July 2020. There are similar suspension effective in many of the cities. In such situations, many of us may find it difficult to attend meeting at Mumbai on 22nd duly next.</p>



<p>We feel that a lot of time have elapsed since expiry of 10th settlement. A lot of issues like Merger of Special Allowance with Basic Pay: Loading after merger of DA; 5 day banking; improvement of family pension, updation of pension etc. are yet to be settled. The date of expiry of Mediclaim Insurance Scheme for the year is also fast approaching.</p>

<p>Dearness Allowance for Workmen and Officer Employees in banks for the months of February, March &amp; April 2018 under X BPS/Joint Note 25.5.2015</p>
<p>The confirmed All India Average Consumer Price Index Numbers for Industrial Workers (Base 1960=100) for the quarter ended December 2017 are as follows:-</p>
<p>October 2017 &#8211; 6551.03<br />
November 2017 &#8211; 6573.86<br />
December 2017 &#8211; 6528.21</p>
<p>The average CPI of the above is 6551 and accordingly the number of DA slabs are 527(6551-4440=2111/4= 527 Slabs). The last quarterly Payment of DA was at 516 Slabs. Hence there is an increase in DA slabs of 11, i.e 527 Slabs for payment of DA for the quarter February, March &amp; April 2018.</p>
<p>In terms of clause 7 of the 10th Bipartite Settlement dated 25.05.2015 and clause 3 of the Joint Note dated 25.05.2015, the rate of Dearness Allowance payable to workmen and officer employees for the months of February, March &amp; April 2018 shall be 52.70% of &#8216;pay&#8217;. While arriving at dearness allowance payable, decimals from third place may please be ignored.</p>

<p>Dear Comrades,<br />
We reproduce hereunder the IBA’s Circular No.1120 dated 25-7-2015 providing clarification on the following issues referred to them.</p>
<p>1. Paternity Leave of 15 days can be availed by the employees within 6 months <strong>even if the date of delivery of the child was before 1-6-2015</strong>.</p>
<p>2. <strong>No leave is required to be taken for the purpose of encashment on LFC.</strong></p>
<p>3. For <strong>Re-fixation of Pay for Ex-servicemen employees</strong> joined/joining the Banks on and from 1-11-2012, <strong>Special Allowance of 7.75% + DA will not be reckoned/included.</strong></p>
<p>4. <strong>Special Allowance of 7.75 % + DA thereon will be included for encashment</strong> of PL on LFC/retirement.</p>
<p>5. Benefit of advancement of stagnation increment by one or two years for those who passed JAIIB/CAIIB/Graduation after reaching 19th/20th Stage shall be<strong> effective from 1st November, 2012</strong>.</p>

<p>Dear Sir/Madam,</p>
<p style="text-align: center;"><strong>X BP SETTLEMENT – CLARIFICATIONS</strong></p>
<p>1. <strong>Paternity Leave:</strong><br />
Clause 32 of the X Bipartite Settlement provides the benefit of Paternity Leave w.e.f. 1.6.2015 to male employees with less than two surviving children for 15 days during his wife’s confinement and may be combined with any other kind of leave except Casual Leave. The leave may be availed upto 15 days before or upto 6 months from the date of delivery of the child.</p>
<p><strong>Clarifications</strong>: The leave may be granted to an employee even where the date of delivery of the child was prior to 1.6.2015, provided, however, that the leave is availed within six months from the date of delivery. Further, the leave shall be sanctioned 15 days before the delivery or up to 6 months after the delivery.</p>
<p>2.<strong> Leave Fare Concession:</strong><br />
Clause 19 (iv) of IX Bipartite Settlement dated 27.4.2010 provided that an employee encashing the facility of Leave Fare Concession shall proceed on leave for a <strong>minimum period of one day.</strong></p>
<p><strong>Clarifications:</strong> Clause 19 (iv) of X Bipartite Settlement dated 25.5.2015 does not have this provision and hence with effect from 1.6.2015, employees may be allowed the facility of encashing of Leave Fare Concession without the requirement of availing Leave for this purpose.</p>
<p>3.<strong> Treatment of Special Allowance for fixation of Pay for Ex-Servicemen re-employed in Banks: </strong>Under Clause 9 of the X BPS, Special Allowance at the rate of 7.75% of the Basic Pay with applicable DA thereon will be paid w.e.f. 1.11.2012.</p>
<p><strong>Clarification:</strong> Queries have been received as to whether the same is to be reckoned for the purpose of encashment of PL on LFC/retirement, Overtime, and while pay fixation of Exservicemen joined the service of the Banks on or after 1.11.2012. It is clarified that the Special Allowance is to be reckoned at the time of PL encashment on LFC/retirement, the same shall not be reckoned for the purpose of fixation of pay of Ex-servicemen who are remployed in Banks on or after 1.11.2012.</p>
<p>4. <strong>Adjustment/advancement of stagnation increment to employees who acquire JAIIB/CAIIB/ Graduation: </strong>Clause 11 of X BPS dated 25.5.2015 provides that in case where the non-subordinate employees as on the date of this Settlement, has already acquired JAIIB (Part-I) or CAIIB (Part-II)/ Graduation after reaching maximum of the scale of Pay (in case of JAIIB/ CAIIB/ Graduation) or after reaching 19TH stage of scale of Pay (in case of CAIIB/Graduation), and has not earned increment(s), otherwise entitled on account of acquiring such qualification, when there were no increments to provide in the scale of pay of those employees, the stagnation increment in such cases may be advanced by one year or two years as the case may be.</p>
<p><strong>Clarification:</strong> Non-subordinate employees who acquires such qualification after reaching the 19th or 20th stagnation, their next immediate stagnation increment may be advanced accordingly by one/two years as the case maybe, w.e.f. 1.11.2012 or the actual date of such advancement whichever is later.</p>

I am directed to refer to your letter No. HR&amp;IR/KSC/GOVT/665 dated 25th May, 2015 on the above subject and to say that Government has ‘No objection‘ to IBA authorizing the Banks to pay revised salary and arrears of pay and allowances to serving officers and revised pension and arrears to existing pension optees retired w.e.f. on or after 1.11.2012 as per the provisions at the Joint Note pending amendments to the Officer’s Service Regulations/Pension Regulations subject to the provisions made by the respective banks in the particular year.</p>
<p>2. As regards declaring 2nd and 4th Saturday as holidays and other Saturdays as full working days is concerned. IBA may rater to this Department’s letter No. 4/1/7/2015-IR dated 2.6.2015.</p>

										<content:encoded><![CDATA[<p><strong>PSU bank employees will soon get pay hike, arrears for 30 months</strong></p>
<p>Mumbai, May 22: Employees of public sector banks, old generation private sector banks and some foreign banks will be a happy lot as they will soon get 15 per cent pay hike, arrears for the last 30 months, and other benefits as part of a deal that the unions and bank managements have reached.</p>
<p>Unions, under the aegis of the United Forum of Bank Unions, and bank managements, represented by the Indian Banks’ Association, have worked out a detailed Bipartite Settlement/ Joint Note and the same will be formalised on May 25.</p>
<p>The benefits that about 7.50 lakh bank employees stand to get are a special pay, a new hospitalisation scheme backed up by insurance and holiday on every second and fourth Saturday in a month.</p>
<p>The back wages (arrears) that bank employees will get for the last 30 months will warm the cockles of their heart. Income tax authorities too will be happy as arrears will be taxable.<br />
S Nagarajan, General Secretary, All India Bank Officers’ Association, said “A special allowance has been introduced for employees… there is a new hospitalisation scheme backed up by insurance.” The wage settlement will benefit 3,04,000 odd officers (as on March 31, 2012) in the banking sector.</p>
<p>Officers will get health insurance cover of Rs. 4 lakh and the clerical and sub-staff will get Rs. 3 lakh cover, he added.</p>
<p>A corporate buffer will be created by banks to reimburse hospitalisation expenditure exceeding the abovementioned limits.</p>
<p>Pointing out that the last wage settlement expired in October 2012, Nagarajan, in a lighter vein, observed that “Five years is the tenure of the wage settlement. We have already exhausted 30 months in coming to a settlement. It’s time now to submit the next charter of demands.”</p>
<p>Vishwas Utagi, Vice President, All India Bank Employees Association, said the wage settlement will benefit about 4.50 lakh clerical and sub-staff in the banking sector.</p>
<p>Bank employees will get close a couple of lakh rupees, on an average, as arrears in gross terms, he explained. Since payrolls are computerised, the arrears could be credited to employees’ accounts in a month.</p>
<p>Utagi said the issue of upgradation of pension of retirees and 100 per cent neutralisation of dearness allowance will be taken up by the United Forum of Bank Unions separately.</p>
