The Delhi High Court deferred delivering an interim ruling on petitions challenging the six-year minimum age for admission to Kendriya Vidyalayas in the coming academic year after discovering that the deadline for online registrations would be extended by three weeks.
Justice Rekha Palli recorded the Kendriya Vidyalaya Sangathan’s (KVS) statement that the March 21 application deadline would be extended to April 11. S. Rajappa, KVS’s lawyer, said, “We are willing to extend the deadline by three weeks.”
In light of the delay, the court gave the Central government and KVS 10 days to file their counter-affidavits and adjourned the case until April 5.
“Prima facie,” Justice Palli noted, “there was something” in the petitions, and the authorities couldn’t make a modification “at the last minute.” The court stated that the National Education Policy (NEP) will not be affected, but that the way in which it should be implemented “must be straightened out.”
Instead of giving an interim injunction, Apoorv Kurup, a lawyer representing the federal government, feels the court should resolve the issue at hand. According to Ashok Agarwal, one of the petitioners’ lawyers, certain other central government institutions require a minimum age of five years, not six, for admission to class one.
The city cannot have two sets of schools for the same curriculum, one needing six years as the minimum age for applying for class 1 and the other requiring five years, according to a court ruling earlier this week. It had noted that a reasoned order on the matter of giving interim relief to the petitioners will be made after respondent counsel had filed relevant papers on the record.
The Centre’s counsel justified the increased age eligibility for class 1 admission at KV, arguing that it was in line with the National Education Policy, which was “designed to address this disparity,” and that it had written to the State authorities demanding that it be implemented.
According to government counsel, the age requirement for admission to class 1 in Delhi government schools is still five years, and it has “nothing to do” with KVs.
“In Delhi, you can’t have two different sorts of schools giving the same curriculum.” This sort of difference isn’t possible in NCT. “You (Centre) must think it out and apply your mind,” the court said.
