Increment is a reward for the past service rendered and hence 12 months service rendered by them can not be ignored just for one day which happens to be their date of birth. Both High Court and Supreme Court have upheld the same. The Central Govt has not implemented the same on the ground that judgements are in individual cases and others affected should also file a legal case. Govt knows that pensioners do not have financial resources to fight legal battle with the Govt in courts . Natural justice demands that central Govt should implement court order in letter and spirit and issue orders accordingly.Pensioners should not be compelled to go for litigation. It should also be kept in view that pay rules 2016 in accordance with 7th cpc have stipulated increment dates as 1. January and 1 July in place of single date 1 July earlier, realising anomalies it had created. The minimum length of service for annual increment is now 6 months. The Central Govt should act fast to protect genuine interests of those pensioners who were born on 1 July and retired during implementation of 6th cpc.
