Hon'ble Supreme court declared URC employees Government employees vide Judgment dt 04 Jan 2001, accordingly Ministry of Defence formulated Rules dt 28 April 2003 which were implemented from the retrospective dt. The rules para 18(a) saya" Minimum scales available to employees in CSD(I) will be granted to Unit Run Canteen employees". The CSD Employees are getting scales at par Government employees but the ministry till date not allowed the Minimum scales to URC employees.
The Judgment of RR Pillay came in April 2009 and the Md Aslam Judgment Came in 2001. The Md Aslam Judgment not quashed by the Supreme court. Hence the ratio of Md Aslam Judgment is still applicable. In any case The RR Pillay's judgment came in 2009 hence the URC employees wsere govt employees from Jan 2001 to 2009 and they are entitled for Pay and allowance at par CSD from Jan 2001 to 2009. The RR Pillay's Judgment did not mentioned that the effect of Judgment is from retrospective from Jan 2001, hence its implement is from prospective effect ie from 28 April 2009.
It is therefore the reply by the Hon'ble Defence Minister is incorrect and in fact URC employees are being victimized by the Ministry since last 13 years.
