<p>The retirement age of state government employees in Tamil Nadu has increased from 59 to 60 years, Chief Minister Edappadi K. Palaniswami announced on Thursday 25.02.2021)</p>

<p>In the Legislative Assembly, issuing a suo motu declaration, he said the order would apply to government and government-assisted school workers, legal and statutory agencies, government sectors, municipal bodies, committees, boards and unions.</p>

<p>He said the announcement would cover all those who were in service and those who would retire on May 31, 2021.</p>



<p>The government extended the retirement age from 58 years to 59 years last year.</p>

<h3 class="has-text-align-center wp-block-heading"><strong><span style="text-decoration: underline;">FOREWORD</span></strong></h3>



<p>Department of Pension and Pensioners Welfare has been leveraging technology year after year, to make the system seamless and more and more convenient for the elderly Pensioners, while taking other steps for bringing about changes in pension policy towards providing a life of dignity for them and their dependents. Some of the major initiatives/support measures taken in this regard include providing Doorstep Service for submission of Digital Life Certificate through Postal Department besides the facility to submit life certificate online through Jeevan Pramaan Portal. This is considered to be a step towards making the Pensioners “Atamnirbhar” as the DLC can now be given from the comfort of one’s home also.</p>



<p>Over the past few years, this Department has also taken a number of decisions to liberalize and simplify the rules and procedures to make the life of our honored pensioners and their dependents simpler and dignified. Rules have been relaxed for divorced daughters to receive Family Pension and now a daughter is entitled to receive the Family Pension even if the divorce has not finally taken place but the divorce petition had been filed by her during the lifetime of her deceased parent employee/ pensioner. Earlier Rule provided for payment of Family Pension to a divorced daughter only if the divorce had taken place during the lifetime of deceased parent pensioner or his spouse. The new Rule not only brings ease to the life of pension receiving individuals but also ensures respectable and equitable rights for the divorced daughters in society. Rule 64 of CCS (Pension) Rules, 1972, was relaxed in order to ensure immediate provisional sanction of pensionary benefits amid the unprecedented situation of <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">COVID-19</a>, wherever an employee is likely to retire before finalization of his dues or is unable to submit the pension claim form. . The Government has very recently made amendment of income criteria for grant of family pension to children/siblings suffering from a mental or physical disability.</p>



<p>While the DOPPW has been striving to bring about, from time to time, necessary changes, it is all the more important to keep the pensioners aware of various developments in the pension administration system. Keeping this in view the Department has now decided to bring about Booklet titled “Know Your Retirement Benefits”, which I am sure, will be helpful in creating awareness amongst pensioners. It will also serve as a guide for officers and dealing staff dealing with pension-related matters in Ministries/ Department/ Organisation.</p>



<p>I am happy and proud to release this Booklet of Department of Pension and Pensioners Welfare which will be a help in determining the retirement benefits entitlements of Pensioners and their dependents.</p>

<p>Sir,</p>



<p>Since the year 1922 onwards FR 56 read with Article 14 of Civil Service Regulations provided that the date of retirement had to be the relevant date of birth on completion of the age of retirement on superannuation. In other words the date of (i) attaining the age of superannuation, (ii) retirement and (iii) commencement of pension used to be the same. <strong>This was the Rule governing retirement on superannuation prior to 3rd CPC.</strong></p>

<p>2 a) Subsequently 3rd CPC recommendation was accepted by the Government of India Based on the accepted recommendation, the then Department ofAdministrative Reforms (now DOPT),issued orders on the 24th November, 1973 laying down that the Government servants shall retire from service with effect from the afternoon of the last day of the month in which their date of retirement fell.</p>



<p>2 b) Clarificatory OM dated 29th June, 1974 was issued without the approval of the concerned State Minister, that all those born on the 1st would retire in the afternoon of the last day of the previous month.Accordingly FR56(a) created.</p>



<p>3. Consequently, those born on the 1st Jan, 1928/1938/1946/1956, were deprived of the benefits of the 4th/ 5th/6th/7th CPC respectively. However, those who could knock the door of the court got favorable judgements.Annexure2 gives the details of court cases with positive outcome.</p>



<p>Latest in the series is the case of <strong>Union Of India</strong> vs M L. Punshi &amp; Am; IN THE HIGH COURT OF DELHI AT NEW DELHI in WP (C) No. 288512000 on the 191hJuly, 2010. In this case the court did not agree with the contention of the Union of India and observed ” In short, we are of the view that in the present cases the effective date of retirement would be 01.04.1995 and not 31.03.1995.” SLP filed by the Government against order of the High Court was dismissed by the Supreme Court.</p>

<p>4. In the case of lnder Pal Yadav Vs Union of lndia [ l985(2) SCC 648), in SLP-IA No. 77457/2017 dated 01.09.2017, in the Civil Appeal No. 3744 of 2016 UOI Vs Balbir Singh Tur &amp; Anr dated 08.12.2017 and UOI VS Prithvi singh dated 24.4.2018 the Hon’ble Supreme Court observed that <strong>” We find that there are several matters in which the aggrieved employees have been going to the Tribunal, then to the High Court and thereafter those matters are brought before this Court. Once the question, in principle, has been settled, it is only appropriate on the part of the Government of India to issue a circular so that people need not unnecessarily travel either to the Tribunal or the High Court or this Court and it will save the time of the Court and the Administrative Departments apart from avoiding unnecessary and avoidable expenditure”.</strong></p>

<p>5. <strong>The DOPT, has not so far honoured the supreme court pronouncement referred to above , consequently it has rendered itself liable to be taken-up for contempt of the court, as well as for putting lot of retirees(Sr Citizens) to financial loss. DOPT, contrary to the observation of the Supreme Court is forcing Pensioners who are in the evening of their lives to knock the doors of CAT, High court/Supreme court. Presently quite a number of cases filed by pensioners born on the 1st January,/ 30th of June are pending in the courts.</strong></p>



<p>6. Kindly look into and ensure that the pronouncement of the Supreme court as brought out in foregoing line is implemented in letter &amp; spirit so that that thousands of aggrieved who do not have means to approach the courts are not deprived of their legitimate dues.</p>

<p>(a) whether the Government proposes to implement any scheme to terminate the services of the Central Government employees before the date of superannuation, for those who have completed thirty years of service or are above 50 years of age, or on any other grounds;</p>



<p>(b) if so, the details thereof;</p>



<p>(c) whether the Government has discussed the issue of termination of employees with the employee organizations and solicited their views and if so, the details thereof;</p>



<p>(d) if not, whether the Government will consider the same and re-think the proposal; and</p>



<p>(e) whether the Government also proposes to amend the service rules to bring efficiency in administration in the wake of the recession in the economy and if so, the details thereof?</p>

<p>MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (DR. JITENDRA SINGH)</p>



<p>(a) to (d): Instructions have been in existence for review of Government employees under the Fundamental Rules (FR) 56(j), the Rule 48 of Central Civil Services (CCS) (Pension) Rules, 1972 and the Rule 16(3) (Amended) of All India Services (Death-cum-Retirement Benefits) [AIS (DCRB)] Rules, 1958 and to pre-maturely retire a Government employee.<br />The objective of the review process is to bring about efficiency and to strengthen the administrative machinery.</p>



<p>e): It is endeavour of the Government to review the service conditions of Central Government employees from time to time so as to respond to the challenges of improving performance, and for bringing efficiency and transparency in administration.</p>

<p>The Department of Personnel and Training has issued an office memorandum on 28th August, 2020 that allows it to prematurely retire government servants even if they are within the 50 to 55 age groups or have completed 30 years of service.</p>

Employees and Workers strongly oppose the move of Government of India to unilaterally and arbitrarily imposition of provisions of rules FR 56 (J) and rule 48 (h) pension rules to retire the Govt Employees prematurely and forcibly vide the OM No. 25013/03/2019-Estt-A IV dated 28. August 2020 issued by Department of Personal and Training, Govt. of India.</p>

<p>The above mentioned OM gives the power to Government to cause premature retirement of any Govt. official who has completed 30 years of service and attained age of 50/55 years on various vague grounds as such “doubtful integrity”, “ineffectiveness” and When petty allegations.</p>



<p>This OM gives infinite power to the authority to pick and choose the targeted employees for such forced premature retirement. The victim employee will not be given any opportunity to explain as natural justice demands. After retirement, he can approach advisory committee appointed by the Govt. of India.</p>



<p>This shows the autocratic attitude of Govt. of India towards the bask rights of employees and unions and in violation of Labour laws.</p>



<p>Confederation of Central Govt. Employees and workers strongly oppose such an authoritarian and arbitrary move of Govt. of India and demand for withdrawal the said OM forthwith.</p>



<p>If this OM is not withdrawn the Central Govt. Employees will be compelled to launch serious agitational programmes.</p>

<p>The Government have decided to increase <strong>the age of superannuation of Government servants from 58 years to 59 years and orders</strong> accordingly. This will apply to all those who are in regular service as on<strong> date and due to retire on superannuation from 31.05.2020</strong>.</p>



<p><a href="https://centralgovernmentnews.com/the-retirement-age-of-tami-nadu-state-government-employees-increased-from-58-to-59/">The retirement age of Tamil Nadu state government employees increased from 58 to 59</a></p>



<p>This order shall also be applicable to all teaching and non-teaching staff working in aided educational institutions and employees of all Constitutional / Statutory Bodies, Public Sector Undertakings including all State Corporations. Local Bodies, Boards. Commissions, Societies, etc.</p>



<p>The relevant provisions under rule 56 of Tamil Nadu Fundamental Rules will be modified to the above extent. Necessary amendment to the above rules will be issued accordingly.</p>

<p><strong>No move to reduce the <a href="https://centralgovernmentnews.com/category/retirement-age/" target="_blank" rel="noreferrer noopener">retirement age of government employees</a>, nor such a proposal discussed or contemplated at any level in the government: Dr Jitendra Singh</strong></p>



<p>Strongly refuting the reports in a section of media that Government has moved a proposal for reducing the age of retirement of government employees to 50 years, Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances &amp; Pensions, Atomic Energy and Space, Dr Jitendra Singh categorically stated here today that there is no such move to reduce the retirement age nor has been such a proposal discussed or contemplated at any level in the government.</p>



<p>Dr Jitendra Singh said, there are certain motivated elements which have been over the last few days, time and again planting such disinformation in a section of media and attributing it to the government sources or DoP&amp;T. He said, each time a prompt rebuttal is sought to be made in order to clear the confusion in the minds of stakeholders. He said, it was unfortunate that at a time when the country is going through Corona crises and the entire world is praising Prime Minister Shri Narendra Modi for his proactive handling of the pandemic, there are certain elements and vested interests which try to underplay all the good work done by the Government by planting such media stories.</p>



<p>On the contrary, right from the beginning of the emergence of the Corona challenge, Government and the DoP&amp;T have, from time to time taken prompt decisions to safeguard the interests of the employees. For example, he said, even before the lockdown was officially announced, <strong><a href="https://centralgovernmentnews.com/latest-dopt-orders-2020/" target="_blank" rel="noreferrer noopener">DOPT</a></strong> had issued an advisory for the offices to work with &#8220;<strong>absolutely necessary or minimum staff</strong>&#8220;. Even though the essential services were exempted from this guideline, DOPT had issued directions to exempt the &#8220;<strong>Divyang employees</strong> even from the essential services&#8221;.</p>



<p>Considering the constraints of the lockdown, he recalled that DOPT<strong> </strong>had postponed the last date for filling of the Annual Performance Appraisal Report (<strong><a href="https://centralgovernmentnews.com/tag/APAR/" target="_blank" rel="noreferrer noopener">APAR</a></strong>) by the government officials.</p>



<p>At the same time, he referred to the UPSC’s decision to reschedule the dates of IAS / Civil Services interview / personality test and also announced that the Civil Services Preliminary Test will be done after May 3rd. Similarly, on the same line, SSC has also postponed its process of recruitment.</p>



<p>As for the Department of Personnel in the Ministry of Personnel, Dr Jitendra Singh said that last week there was fake news that the government had decided to impose a 30% reduction in the <strong><a href="https://centralgovernmentnews.com/category/pension/">pension</a></strong> and discontinue pensions for those who are above the age of 80. However, contrary to this, the truth is that on the 31st of March there was not a single pensioner whose pension did not deposit in his account. Not only this, services of the <strong><a href="https://centralgovernmentnews.com/category/postal-department/" target="_blank" rel="noreferrer noopener">Postal Department</a></strong> were sought to deliver the pension amount at the residence of the pensioners, whenever required.</p>



<p>As for the Department of Personnel, in the last four weeks, the Ministry of Personnel has had Video Conference consultations for <strong>Pensioners</strong> and Senior Citizens across 20 cities where pulmonary advice was given by experts like Dr Randeep Guleria, Director (AIIMS). Similarly, Yoga Sessions on Webinar are also being organised.</p>

<p>In view of the unprecedented situation arising out of country-wide lock down declared by the Government consequent to we outbreak <a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener" aria-label="COVID-19 (opens in a new tab)">COVID-19</a>, it is clarified that the central Government employees who are attaining the <a href="https://centralgovernmentnews.com/tag/age-of-superannuation/" target="_blank" rel="noreferrer noopener" aria-label="age of superannuation (opens in a new tab)">age of superannuation</a> on 31st March, 2020 in terms or Fundamental Rule 56 and due to retire. shall retire from Central Government service on 31st March, 2020, irrespective of whether they are working from home or working from office.</p>
