<p class="has-text-align-center"><strong>Option for fixation of pay on Promotion</strong></p>



<p>Extension of Time &#8211; limit for exercise of Option for fixation of pay on Promotion by a period of three (3) months from the date of issue of MoF, DoE, New Delhi OM dated 04/07/2023 i.e. upto 03/09/2023.</p>



<h3 class="wp-block-heading">Message Title: Extension of Time-limit for exercise of Option for fixation of pay on Promotion.</h3>



<p><strong>Message:</strong></p>



<p>As per GoI, MoF, DoE OM No. 4-21/2017-IC/E.III.A dated 04/07/ 2023* read with in conjunction to MoF /DoE, New Delhi OM No.4-21/2017 IC/E-IIIA dated 15/04/2021*, the time limit for exercise/ re-exercise of Option on promotion has been further extended, by a period of three (3) months from the date of issue of MoF, DoE, New Delhi OM dated 04/07/ 2023 i.e. upto 03/09/2023.</p>



<p>Accordingly, Officers who have been promoted or granted financial upgradation on or after 01.01.2016 and <em><strong>desire to exercise/ re-exercise option for pay fixation from DNI may opt within three months from the date of issue of MoD, New Delhi OM dated 04/07/2023 i.e. by 3rd Sept 2023</strong></em>. Officers to publish Part II Orders and forward it through HRMS 2.0 along with option Form which can be downloaded from the website</p>



<p class="has-text-align-center"><strong>#The Last date of exercising option shall be 3rd Sept 2023.</strong></p>



<p>**Further, the ‘Option Calculator’ provided by office of the PCDA(O), Pune may please be referred to, for further necessary guidance while exercising your Option.</p>

<p><strong>Note</strong>: The provisions of re-exercising Option under the said OM is only for fixation of pay on promotion from the DNI in the lower grade and should not to be construed for switching over of pay to the revised pay structure in 7th CPC.</p>

<p>Department of Personnel &amp; Training (DoPT), Ministry of Personnel has approved the mass promotion of 1,592 officials working in the capacity of Assistant Section Officers (ASOs) to the post of Section Officers on adhoc basis with immediate effect.</p>



<p>Announcing this here today, Union Minister of State (Independent Charge) Science &amp; Technology; MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh said that the Promotion orders will be issued soon by the respective Cadre Controlling authorities.</p>



<p>The Promotions had been expedited at the directions of the Minister Incharge DoPT, Dr Jitendra Singh who personally reviewed the entire process.</p>



<p>“Government has been granting mass promotions to employees in order to motivate them and overcome the problem of long stagnation. Another 2,000 promotions in ASO and other Grades are in process and hopefully they will get promoted by this year end,” the Minister said.</p>



<p>Dr Jitendra Singh said that in the last nine years, under the guidance of Prime Minister Narendra Modi, the Government has periodically reviewed the longstanding stagnation issues in the various Central Ministries that are a legacy of the past due to pending court cases, lack of vacancies in higher grades and other personnel issues.</p>



<p>The Minister said, last year also about 9,000 mass promotions were made and prior to that the DoPT granted 4,000 promotions in the preceding three years.</p>



<p>Dr Jitendra Singh said, he himself personally feels disturbed to come across cases where some of the employees working in the lowest rung of administration spend their entire service tenure of 30 to 35 years without securing a single promotion. He said, he has discussed the issue with all the senior officers in the Ministry and several innovative means have been evolved to avoid stagnation at middle and lower rungs of the administration.</p>



<p>Dr Jitendra Singh also regretted that in a large number of cases, stagnation in promotions was the result of litigation amongst the employees themselves and even though the DoPT tries its best to put forward its view in the court of law, the delay becomes inevitable.</p>



<p>“PM Modi has made efforts to ensure that government jobs are available to the maximum extent possible. It is extremely painful and disheartening to see employees sometimes superannuating in the same grade as promotions remained stuck,” said the Minister.</p>



<p>The orders for mass promotion of these employees belonging to the Central Secretariat Service (CSS) have been issued after several rounds of high-level meetings in DoPT chaired by Dr Jitendra Singh in the last few months. The Minister said, even legal experts were consulted as some of the orders are subject to the outcome of pending writ petitions.</p>



<p>Dr Jitendra Singh said, in order to bring in the ease of governance as well as objectivity in empanelment, the government has, in the last nine years, improvised upon the procedures so as to ensure that there are no subjective preferences involved in carrying out the promotions.</p>



<p>“Procedures have been made more hi-tech using sophisticated technology tools to minimize the human interface,” he added.</p>



<p>The DoPT Minister said that the government has done away with over 1,600 rules which were either obsolete or had become irrelevant with the passage of time.</p>



<p>Dr Jitendra Singh said, “All this is meant not only to ensure effective and timely delivery of outcomes for the public, but also to enable the employees to perform to the best of their ability”.</p>

<p>References from Zonal Railways and NFIR have been received in Board’s office seeking clarifications regarding reckoning of 30% pay element for fixation of pay of such Running Staff who have been selected to the Stationary Post i.e non-running post upon promotion through General Selection.</p>



<ol class="wp-block-list" start="2">
<li>The matter has been examined in consultation with Establishment and Finance Directorate(s) of Railway Board. It is advised that in absence of specific orders from the Board to this effect, the benefit of reckoning of 30% pay element for the purpose of fixation of pay of running staff on their promotion/appointment to the posts filled through General Section is not admissible. Further, the General Selection is voluntary in nature and the concerned staff are aware of the mode of fixation of pay on promotion/appointment to a post under General Selection. Hence in such cases, pay fixation has to be effected without taking into account the ‘pay element’.</li>



<li>This issues with the concurrence of the Finance Directorate of the Ministry of Railways.</li>

<h2 class="wp-block-heading">Cabinet approves the incentive scheme for promotion of RuPay Debit Cards and low-value BHIM-UPI transactions (P2M)</h2>

<p>The Union Cabinet, chaired by the Hon&#8217;ble Prime Minister Shri Narendra Modi, has approved the incentive scheme for promotion of RuPay Debit Cards and low-value BHIM-UPI transactions (person-to-merchant) for a period of one year from April 2022.</p>



<ul class="wp-block-list">
<li>The approved incentive scheme for promotion of RuPay Debit Cards and low-value BHIM-UPI transactions (P2M) in FY 2022-23 has a financial outlay of ₹ 2,600 crore. Under the said scheme, acquiring banks will be provided financial incentive, for promoting Point-of-Sale (PoS) and e-commerce transactions using RuPay Debit Cards and low-value BHIM-UPI transactions (P2M) for the current financial year FY 2022-23.</li>



<li>The Finance Minister, in her speech on the Budget for FY2022-23, announced Government’s intent to continue the financial support for digital payments announced in the previous Budget, with a focus on promoting use of payment platforms that are economical and user-friendly. The scheme has been formulated in compliance with the aforesaid Budget announcement.</li>



<li>In FY2021-22, the government had approved an incentive scheme in compliance with the budget announcement of FY2021-22 to give a further boost to digital transactions. As a result, total digital payments transactions have registered a year-on-year growth of 59%, rising from 5,554 crore in FY2020-21 to 8,840 crore in FY2021-22. BHIM-UPI transactions have registered a year-on-year growth of 106%, rising from 2,233 crore in FY2020-21 to 4,597 crore in FY2021-22.</li>



<li>Various stakeholder in the digital payments systems and the Reserve Bank of India (RBI) expressed concerns regarding potential adverse impact of the zero MDR regime on the growth of the digital payments ecosystem. Further, the National Payments Corporation of India (NPCI) requested, among other things, for incentivisation of BHIM-UPI and RuPay Debit Card transactions to create a cost-effective value proposition for ecosystem stakeholders, increase merchant acceptance footprints and faster migration from cash payments to digital payments.</li>



<li>The Government of India is taking various initiatives for promotion of digital payments across the country. Over past years, digital payment transactions have witnessed tremendous growth. During the Covid-19 crisis, digital payments facilitated functioning of businesses, including small merchants, and helped in maintaining social distancing. UPI has achieved a record of 782.9 crore digital payment transactions with a value of ₹ 12.82 lakh crore in the month of December 2022.</li>
</ul>



<p>This incentive scheme will facilitate building of a robust digital payment ecosystem and promoting RuPay Debit Card and BHIM-UPI digital transactions. <h3 class="wp-block-heading">Dr Jitendra Singh thanked Prime Minister Shri Narendra Modi for this kind decision and said the secretariat services are an essential tool of governance</h3>

<p>Union Minister of State (Independent Charge) Science &amp; Technology; Minister of State (Independent Charge) Earth Sciences; MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh today announced the DoPT (Department of Personnel &amp; Training) decision of granting mass promotion to over 8,000 government employees in one go. The promotees belong to three key secretariat services.</p>



<p>Dr Jitendra Singh said the orders for mass promotion of these employees belonging to the Central Secretariat Service (CSS), Central Secretariat Stenographers’ Service (CSSS) and Central Secretariat Clerical Service (CSCS) have been issued after several rounds of high-level meetings in DoPT chaired by him in the last two-months. The Minister said, even legal experts were consulted widely as some of the orders were subject to the outcome of pending writ petitions.</p>



<p>Dr Jitendra Singh said, it was disheartening to see government employees attaining retirement from service without getting one’s due promotion and thanked Prime Minister Shri Narendra Modi for this kind decision. Of the total of 8,089 promoted employees, 4,734 are from CSS, 2,966 from CSSS and 389 from CSCS.</p>



<p>Dr Jitendra Singh also met delegations of Central Secretariat officials on several occasions to thrash out the issue, as he considered that these three services – CSS, CSSS and CSCS form the backbone of the central secretariat administrative functioning.</p>



<p>Dr Jitendra Singh also recalled that over three years back, DoPT had carried out mass promotions of nearly 4,000 officials in different departments at different levels, which had been widely hailed. Many of these promotion orders were also issued, subject to the outcome of pending writ petitions, he recalled.</p>



<p>Dr Jitendra Singh said that the secretariat services are an essential tool of governance, since the notes and drafts prepared by them form the bedrock of Government policies as the proposals pass through various stages in the government hierarchy.</p>

<p><strong>After completing six months of service, Central Government Employees who are promoted to the next level and whose promotion pay fixation was completed on January 1 or July 1 will get the next increment.</strong></p>



<p>The next raise will be given to those who had their promotion pay fixed on the annual increment date, which was this year&#8217;s first of January, on July 1, 2022.</p>



<p>On 31.7.2018, the Department of Expenditure first issued an order addressing this issue. According to CCS (Revised Pay) Rules 2016 Rule 10.</p>



<p><em>&#8220;It is clarified that in case an employee is promoted or granted financial upgradation including upgradation under the MACP scheme on 1st January or 1st July, where the pay is fixed in the Level applicable to the post on which promotion is made in accordance with the Rule 13 of the CCS(RP) Rules, 2016, the first increment in the Level applicable to the post on which promotion is made shall accrue on the following 1st July or 1st January, as the case may be, provided a period of 6 months’ qualifying service is strictly fulfilled. The next increment thereafter shall, however, accrue only after completion of one year.“</em></p>

<h2 class="wp-block-heading">Next Increment after Promotion Under Rule 10 of CCS (Revised Pay) Rules 2016</h2>



<p>However, due to the order&#8217;s ambiguity, many departments have struggled to implement it. Many departments requested clarification regarding the validity of the decree dated 31.7.2018. The DoE later offered clarification on November 28, 2019, stating that the first increase following a promotion must be given upon the completion of six months of service if pay fixation for a promotion is done on the annual increment date.</p>



<p>Therefore, this Clarification</p>



<ol class="wp-block-list"><li>Whether the date of the following increase will be January 1 or July 1 after a promotion on July 1 and the fixation of pay with two increments.</li><li>Accrual of next increment in the event that an employee receives a regular promotion or financial upgrade on a date other than the date of the yearly increment and exercises their right to pay fixing under FR 22(1)(a) (1).</li></ol>



<p>In the above case he may be allowed the 1st increment in promotional grade on 1st January/ 1st July as the case may be after completion of 6 months’ qualifying service after such fixation on 1st July/1st January (i.e., the date of increment in lower grade) on the analogy of Department of Expenditure’s OM dated 31.07.2018. The next increment, thereafter, shall however, accrue only after the completion of one year.</p>



<p>Therefore, it should be ensured that the next increase is granted on July 1, 2022, if any government employee whose DNI was on January 1 had their Promotion pay fixed on that date in 2022.</p>

<p>Respected Sir,</p>



<p>Department’s kind attention is invited to our letter No.CHQ- 07/MSA-(2022) dated 31st January, 2022 on the subject matter vide which a detail comments of stake holders along with a complete proposal in respect of Ministerial Cadre of Survey of India has been submitted to the Surveyor General of India, Dehradun along with a copy to the DST for their necessary action. A copy of the same is again submitted for your perusal and Department’s further necessary action.<ins></ins></p>



<p>2. In this regard, it is submitted that it has come to the notice of our Association that final Cadre Restructuring Proposal of Group ‘B’ &amp; ‘C’ cadre has been submitted to the Department by the Survey of India. However, no official information is available with us. We are not aware the facts that whether the Survey of India has considered our demands/proposal submitted under above referred letter or not. It was also requested by the association in above letter that the association may be heard before denial of points, if any, submitted by association on draft proposal report. The Department is well aware that the last meeting with association on the subject matter was held on 20.10.2010 i.e. 12 years before as already mentioned in the proposal. During that time when the meeting was held entire proposal of Cadre Restructure was different from this proposal. We have submitted several requests to permit us a meeting with Surveyor General of India to discuss our numbers of pending issues. But till today no meeting have yet been permitted by the Surveyor General’s Office.</p>



<p>3. Before submitting comments of stake holders by the Ministerial Staff Association on behalf of our Cadre, we were approached all office bears of MSA and after several detailed discussions through virtual meeting and telephonic conversation we proposed the cadre with full comments and justifications. Department is aware that our intake in the cadre is through SSC in the grade of UDC and LDC. As such graduate level entry in the Cadre is there so that considering facts of functional requirement, educational qualifications and emerging new technology in the Organisations we have proposed creation of new posts right from LDC to Director, up-gradations of pay level and change in nomenclature. So that highly educated and specially trained Technical officers of Survey of India should keep away from the day to day administrative jobs like accounts, establishment etc. The matter was also discussed from time to time with the presiding authority of Department as well with Organisation of Survey of India.<ins></ins></p>



<p>4. On perusal of cadre restructuring proposal submitted by a board of officers, it was found that even the recommendations of Sixth Central Pay Commission for subordinate/ non-secretariat administrative cadre starting from LDC/UDC has not been taken into consideration. <strong>The recommendation of the merger of Assistant and Office Superintendent and further grant of pay scale of PB-2 Grade Pay Rs. 4800 (Level-8) with NFU after 4 years in PB-2 Grade Pay Rs. 5400 (Level-9) to promotional post of merged grade.</strong> It is also a basic need of the Organisation on the functional requirement to create adequate posts to serve present and future administrative needs of SoI. During re-Organization of Survey of India in 2002-2003 it was also left. The new posts in Ministerial cadre must be created as proposed by the Association so that all administrative and accounts functions should be done by Ministerial Staff only along with store, estates, steno, reception and security functions on need base. It is again reiterated that Cadre Restructuring of Ministerial Staff should be done to utilise higher qualifications. <p>The undersigned is directed to bring to your notice the judgement dated 28.01.2022 of the Supreme Court of India in the case of <em><strong>Jarnail Singh and Ors. V. Lachhmi Narain Gupta and Ors.</strong></em> (Civil Appeal No. 629 of 2022 arising out of SLP (C) No. 30621 of 2011) and other connected matters. Pursuant to this judgement, the Ld. Attorney General for India has rendered his considered opinion in the matter.</p>



<p>2. In the judgement dated 28.1.2022, the Supreme Court has set out the conditions that are to be satisfied by the Government for the purpose of implementing the policy of reservation in promotions. These conditions are :</p>



<ul class="wp-block-list"><li>(i) Collection of quantifiable data regarding inadequacy of representation of Scheduled Castes and Scheduled Tribes;</li><li>(ii) Application of this data to each cadre separately; and</li><li>(iii) If a roster exists, the unit for operation of the roster would be the cadre for which the quantifiable data would have to be collected and applied in regard to the filling up of the vacancies in the roster.</li></ul>



<p>This judgement currently holds the field.</p>



<p>3. All the Ministries/Departments are required to ensure that the above conditions are complied with before implementing the policy of reservation in promotions and carrying out any promotions based thereon.</p>



<p>4. For this purpose, all Ministries/Departments are also required to ensure the following:</p>



<ul class="wp-block-list"><li>(a) In terms of DoPT OM No.43011/153/2010 -Estt (Res.) dated 4.1.2013, the Liaison Officer shall ensure that the reservation rosters are strictly maintained as per the instructions/ guidelines, laid down in DoPT OM No. 36012/2/96-Estt (Res.), dated 2.7.1997.</li><li>(b) In order to ensure maintenance of efficiency of administration, the DPC shall carefully assess the suitability of the officers, being considered for promotion.</li><li>(c) The Appointing Authority shall issue the appointment/ promotion orders only after satisfying itself that the conditions mentioned in paragraph 2 and sub-para (a) &amp; (b) of this paragraph have been fully complied with.5. Since the <em><strong>Jarnail Singh</strong></em> batch of cases is pending in the Supreme Court of India, any promotion order issued shall be subject to further orders that may be passed by the Supreme Court in the said batch of cases.</li></ul>



<p>6. All Ministries/Departments are requested to urgently bring these – instructions to the notice of all their attached/subordinate offices as also the Public Sector Undertakings and Statutory Bodies etc. for adherence and strict compliance.</p>

<h2 class="has-text-align-center wp-block-heading">STEPPING UP OF PAY &#8211; REGARDING</h2>



<ol class="wp-block-list"><li>Consolidated Guidelines on Stepping Up of Pay was issued vide GoI, MoP, PG&amp;P OM No 4/3/2017-Estt(Pay-I) dated 26/10/2018 which have since been made applicable to Indian Armed Forces Personnel vide MoD, New Delhi ID Note No 1(12)/2020/D(Pay/Services) dated 19/11/2020, which interalia stipulates that cases where Senior Army Officers draws less pay than the Junior Army Officer, the Pay of the Senior Army Officer will be stepped up with effect from the date of Promotion of the Junior Officer.</li><li>Consequent upon implementation of GoI, MoD, New Delhi OM No 1(20)/2017/D(Pay/ services)-Part-I dated 02/11/2020 read in conjunction with MoF, New Delhi OM No. 4-21/2017-IC/E/IIIA dated 28/11/2019, under which first increment after fixation of pay on Promotion is to be granted after successful completion of Six (6) months qualifying service in the promoted grade, anomaly in Pay has arisen wherein Senior Army Officers are drawing less pay than the Junior Officers from the date of next increment earned by the Junior Army Officer after fixation of Pay in the promoted grade.</li><li>In absence of any Specific/Special orders for Stepping Up of Pay from a date other than date of Promotion of Junior Officer, the matter has been referred by the CGDA, New Delhi to MoD, New Delhi for seeking clarification. Hence such cases for Stepping Up of Pay may be referred to the O/o the PCDA (O), Pune only after receipt of clarification from MoD, New Delhi in this regard.</li><li>This has been put up for the kind information of the Indian Army Officers, so that queries on the above issue are avoided.</li></ol>
