<h2 class="has-text-align-center wp-block-heading">AICPIN for April 2020</h2>



<p>The All-India CPI-IW for <strong>April, 2020 increased by 3 points and stood at 329 </strong>(three hundred and twenty nine). On 1-month percentage change, it increased by (+) 0.92 per cent between March and April, 2020 compared to (+) 0.97 per cent increase between corresponding months of previous year.</p>

<p>The maximum upward pressure in current index came from Food group contributing (+) 2.43 percentage points to the total change. At item level, Rice, Wheat, Wheat Atta, Arhar Dal, Moong Dal, Mustard Oil, Fish Fresh, Goat Meat, Poultry (Chicken), Brinjal, Cabbage, Cauliflower, French Bean, Green Coriander Leaves, Lady’s Finger, Palak, Potato, Radish, Tomato, Banana, Lemon, Mango (Ripe), Sugar, Cooking Gas, etc. are responsible for the increase in index. However, this increase was checked by Garlic, Onion, Parval, Petrol, Flowers/Flower Garlands, etc., putting downward pressure on the index.</p>



<p>Year-on-year inflation based on all-items stood at 5.45 per cent for April, 2020 as compared to 5.50 per cent for the previous month and 8.33 per cent during the corresponding month of the previous year. Similarly, Food inflation stood at 6.56 per cent against 6.67 per cent of the previous month and 4.92 per cent during the corresponding month an year ago.</p>



<p>At centre level, Doom-Dooma Tinsukia recorded the maximum increase of 14 points followed by Salem (12 points) and Surat (10 points). Among others, 9 points increase was observed in 2 centres, 8 points in another 2 centres, 7 points in 3 centres, 6 points in 2 centres, 5 points in 5 centres, 4 points in another 5 centres, 3 points in 11 centres, 2 points in 10 centres and 1 point in 18 centres. On the contrary, Chhindwara, Vadodara, Bhilai, Yamunanagar and Jamshedpur recorded a decrease of 1 point each. Rest of 12 centres’ indices remained stationary.</p>

<p>The indices of 33 centres are above All-India Index and 44 centres’ indices are below national average. The index of Rourkela centre remained at par with All-India Index.</p>



<p>The next issue of CPI-IW for the month of May, 2020 will be released on Tuesday 30th June, 2020. The same will also be available on the office website www.labourbureaunew.gov.in.</p>

<p>Sub: <strong>Freezing of Dearness Allowance to Central Government Employees and Dearness Relief to Central Government Pensioners &#8211; Hardships &amp; legal implications thereof.</strong></p>



<p>Ref.: (i) MoF(Dept of Exp.)’s O.M. No.1/1/2020=E-II(B) dated 23.04.2020<br />(ii) Our earlier memorandum No.NC-JCM-2020/CS/PM dated 23.04.2020</p>



<p>This is in continuation of our earlier memorandum cited above regarding unjust decision taken by the Government to freeze the rates of DA and DR up to July 2021, over-riding earlier decision of the <strong>Union Cabinet to grant 4% additional DA and DR from 01.01.2020</strong>, and arbitrarily changed Cabinet decision through an executive order of the MoF(DoE) vide its O.M. dated 23.04.2020 by Freezing DA and DR as on January 1, 2020. This had put the Central Government employees and Central Government Pensioners in severe hardship. Cost escalation of Essential Commodities, in the wake of <strong><a href="https://centralgovernmentnews.com/tag/covid-19/" target="_blank" rel="noreferrer noopener">Covid-19</a></strong> crisis period, has further aggravated stressful situation.</p>

<p>We submit the following points for your consideration:-</p>



<ul class="wp-block-list"><li>Hon’ble Finance Ministerhas recently announced series of financial boost-ups for Rs.20.97 lakh crores as stimulus under “Atmnirbhar Bharat Package” covering certain sectors to boost economic activities.</li><li>As a result of above mentioned economic packages, the business and rich sections of the society got motivational packages, in one form or the other, except the workers, poor people, Government Employees and Pensioners, who have to bear the brunt of the COVID-19 lockdown and its severe impact on the inflation and consequential price rise of all commodities. Instead of providing some relief to them to meet with the higher inflation, it is regrettable that, inspite of the protests by the JCM Staff Side, vide its letter cited above, the Government has not yet withdrawn its orders of 23.04.2020 to freeze DA and DR rates as on 01.01.2020 upto July 2021 and not to pay the arrears for the three installments of additional DA and DR falling due from 01.01.2020, 01.07.2020 and 01.01.2021. This has adversely affected the morale of the Employees and Pensioners, besides causing serious hardship to them and their families, especially from the lower and middle income groups.</li><li>DA and DR are the part of Pay and Pension respectively. DA and DR provide protection against erosion of Wages and Pension due to price rise and inflation. DA and DR are having great importance in wage structure for the Central Government Employees and Pensioners. All Central Pay Commissions decided pay structure by merging DA and DR with the Pay and Pension, treating them as zero from the date of implementation of its report and linking them with the revised base of Price Index from the said date of implementation of its recommendations. Subsequent rise in DA and DR installments are being released to compensate the inflation there-onwards.</li><li>The First Central Pay Commission(1946-48) recommended that, “As long as cost of living is continued to be substantially higher, some system of dearness allowance over and above pay must continue in operation”. Thereafter, every Central Pay Commissions recommended grant of DA and DR to compensate for inflation.</li><li>Third Pay Commission onwards all the Central Pay Commissions had recommended for Revision of DA and DR every six months as per percentage rise of Price Index over the base point on the date of implementation of the respective CPCs.Moreover, DA and DR is linked with the Consumer Price Index, as already accepted by the Government, cannot be freezed.</li><li>DA and DR is the Fundamental Right of an Employee and Pensioner respectively, therefore, withholding this Compensation Package, meant for sustenance against price rise, is unacceptable under any circumstances. The government should take note that, DA and DR provision is meant to facilitate survival of the Employee and Pensioner against erosion of Wages and Pension.</li><li>In its recommendations, vide Para 8.17.37, the 7th CPC continued the same formula of revision of DA and DR every 6 months from 1st January and 1st July.The recommendations of the 7th Pay Commission were accepted by the Union Cabinet. The same cannot be changed or taken away unilaterally through an executive order.</li><li>Fair Wages Committee recommended that, “It is clearly necessary for this country to continue to pay dearness allowance to neutralize wholly or atleast substantially the increase in the cost of living”.</li><li>Payment of Salary/Pension and DA or DR thereon to an employee and Pensioner are not a matter of bounty. It is a vested right of an employee and a Pensioner to receive the salary and Pension(Pension is a deferred wage as held by the Apex Court in DS Nakara’s Case and Major General SPS Bain’s case). DA and DR are part of Salary and Pension. It is also a statutory right as it flows from the Service Rules. Right to receive Salary and Pension every month is part of the service conditions emanating from Article 309 of the Constitution of India.</li><li>In the case of State of MP Vs. Ranojirao Shinde [AIR (1968) SC 1053], it has been held that, right to a sum of money is ‘property’. In the decision in Deokinandan Prasad Vs. State of Bihar &amp; Others [AIR 1971 SC 1409], it has been held that, right to receive pension is a property and the same cannot be taken away or withheld by a mere executive order.</li><li>Freezing of Dearness Allowance and Dearness Relief is a blatant violation of the provision of Article 360 of the Constitution of India.</li><li>Article 300A of the Constitution of India, which confers a Constitutional Right to Property, includes within its purview, salary as a right to property and as a sequel thereof, it applies to Pension and the DA and DR thereon.</li><li>It is pertinent to mention that, neither Epidemic Diseases Act 1897 nor Disaster Management Act 2005 specify or confer any power upon any Government to defer the Salary or Allowances due to its Employees and Pensioners. DA and DR cannot be denied under any circumstances.</li><li>As per Settled Law, financial difficulty is not a ground for the Government to defer or freeze the Payment of Salary/Allowances or Pension by an executive order.</li></ul>

<p>It is, therefore,requested that, the O.M. dated 23.04.2020 of the Department of Expenditure, for freezing of Dearness Allowance and Dearness Relief to the Central Government Employees and Pensioners, may please be withdrawn and arrears of Additional <a href="https://centralgovernmentnews.com/category/dearness-allowance/" target="_blank" rel="noreferrer noopener">DA</a> and <a href="https://centralgovernmentnews.com/category/dearness-relief/" target="_blank" rel="noreferrer noopener">DR</a> @ 4% w.e.f. 01.01.2020 may please be paid at the earliest as per decision of the Union Cabinet taken prior to the said O.M. on freezing of DA and DR.</p>



<p>In conclusion, I would like to add that, like other employees, the Central Government Employees are also equally subjected to undue hardship due to COVID-19 epedemic, and the resultant economic downfall. Many economic demands of the Central Government Employees, including the ones which are approved by the Union Cabinet, are also remaining unimplemented since Government orders are not issued, especially on revision of Night Duty Allowance and Risk Allowance on 7th CPC pay scales, and <strong><a href="https://centralgovernmentnews.com/category/7cpc/" target="_blank" rel="noreferrer noopener">7th CPC</a></strong> anomalies, including assurance given by the Group of Ministers during Strike Demand Negotiations, are all remaining unsettled. In this situation freezing DA/DR for 18 months and not paying the arrears is not at all a justified decision. As many prominent economists have suggested to the Government that, money should be given to the people, to improve liquidity and purchasing power in the market, may be considered by the Government in its true spirit, and, therefore, I once again request you to kindly bring all the above justifications for releasing Additional DA/DR to the notice of the Hon’ble Prime Minister, and a favourable decision may be taken in this regard, considering the fact that, a good number of Government Employees are working during the entire lockdown period, taking risk of not only their life, but also their family members.</p>

<p class="has-text-align-center"><strong>Press Release Consumer Price Index for Industrial Workers (CPI-IW) &#8211; March, 2020</strong></p>



<p>The All-India CPI-IW for March, 2020 decreased by two points and stood at 326 (three hundred and twenty six). On 1-month percentage change, it went down by (-) 0.61 per cent between January and February, 2020 compared to (+) 0.65 per cent increase between corresponding months of previous year.</p>

<p>The maximum downward pressure to the change in current index came from Food group contributing (-) 1.28 percentage points to the total change. At item level, Onion, Garlic, Poultry Chicken, Eggs-Hen, Brinjal, Cabbage, Carrot, Drum Stick, French Bean, Potato, Tomato, Petrol, Flowers/Flower Garlands, etc. are responsible for the decrease in index. However, this decrease was checked by Wheat, Grinding Charges, Moong Dal, Goat Meat, Fish Fresh, Milk-Buffalo, Pure Ghee, Tamarind, Gourd, Parval, Apple, Coconut, HOt Drink-Tea (Readymade), Cooking Gas, etc., putting upward pressure on the index.</p>



<p>Year-on-year inflation based on tall-items stood at 5.50 per cent for March, 2020 as compared to 6.84 per cent for the previous month and 7.67 per cent during the corresponding month of the previous year. Similarly, Food inflation stood at 6.67 per cent against 8.33 per cent of the previous month and 3.96 per cent during the corresponding month an year ago.</p>

<p>At centre level, Tiruchirapally, Vishakhapathnam and Salem recorded the maximum decrease of 8 points each followed by Mysore (7 points) and Bengaluru, Coimbatore and Madurai (6 points each). Among others, 5 points decrease was observed in 5 centres, 4 points in another 5 centres, 3 points in 6 centres, 2 points in 11 centres and 1 point in 10 centres. On the contrary, Rajkot, Lucknow and Kodarma recorded a maximum increase of 5 points each followed by Goa (4 points). Among others, 3 points increase was observed in 3 centres, 2 points in another 3 centres and 1 point in 5 centres. Rest of 19 centres’ indices remained stationary.</p>



<p>The indices of 33 centres are above All-India Index and 45 centres’ indices are below national average.</p>



<p>The next issue of CPI-IW for the month of April, 2020 will be released on Friday 29th May, 2020. The same will also be available on the office website <a href="http://www.labourbureaunew.gov.in/" target="_blank" rel="noreferrer noopener">www.labourbureaunew.gov.in</a>.</p>

<p>(a) Whether it is a fact that <strong>Daily Allowance (DA) and Dearness Relief (DR) </strong>for Central Govt. employees and pensioners have become due with effect from 4th January, 2020.</p>



<p>(b) If so, the details thereof</p>



<p>(c) Whether <strong>DA/DR</strong> is based on rise in inflation and increase in prices of essential commodities; and</p>



<p>(d) If so, whether the increase in <strong>DA allowance</strong> is in line with increase in price of essential items and if not, the reason therefore?</p>

<p><strong>(a) &amp; (b): Yes Sir</strong>. <strong>Dearness Allowance and Dearness Relief</strong> are granted to serving employees and pensioners of the Central Government respectively each year with effect from 1st January and 1st July and normally paid in the month of March and September respectively.</p>



<p><strong>(c) &amp; (d): Yes Sir.</strong> The level of inflation for the purpose of <strong>DA/DR</strong> to Central Government employees/pensioners is calculated on the basis of All India Consumer Price Index for Industrial Workers which is issued by Labour Bureau, Shimla</p>

<p>The <a href="https://centralgovernmentnews.com/tag/AICPIN/" target="_blank" rel="noreferrer noopener" aria-label="AICPIN (opens in a new tab)">AICPIN</a> All-India CPI-IW for December 2019 increased by 2 points and pegged at 330 (three hundred and thirty). On 1-month percentage change, it increased by (+) 0.61 per cent between November and December 2019 when compared with the increase of (-) 0.33 per cent for the corresponding months of last year.</p>



<p>The maximum upward pressure to the change in current index came from Food group contributing (+) 1.87 percentage points to the total change. At item level, Onion, Jowar, Rice, Wheat &amp; Wheat Atta, Arhar Dal, Moong Dal, Urd Dal, Mustard Oil, Egg (Hen), Fish Fresh, Goat Meat, Fresh Milk, Chillies Dry, Drum Stick, Potato, Cooking Gas, Electricity Charges, Fire Wood, Employees State Insurance (ESI) Contribution, Petrol, Flowers / Flower Garland etc. are responsible for the increase in index. However, this increase was checked by Chillies Green, Ginger, Banana, Brinjal, Cabbage, Carrot, Cauliflower, Green Coriander leaves, Guava, Lemon, Methi, Palak, Peas, Radish, Tomato, Toilet Soap, etc., putting downward pressure on the index.</p>

<p>Year-on-year inflation based on all-items stood at 9.63 per cent for December 2019 as compared to 8.61 per cent for the previous month and 5.24 per cent during the corresponding month of the previous year. Similarly, Food inflation stood at 12.22 per cent against 9.87 per cent of the previous month and (-) 0.96 per cent during the corresponding month of an year ago.</p>



<p>At centre level, Tiruchirapally observed the maximum increase of 12 points followed by Goa (11 points), Giridih and Belgaum (9 points each) and Ludhiana and Puducherry (8 points each). Among others, 7 points increase was observed in 4 centres, 6 points in 5 centres, 5 points in another 5 centres, 4 points in next another 5 centres, 3 points in 11 centres, 2 points in 12 centres and 1 point in 13 centres. On the contrary, Sholapur and Surat recorded a maximum decrease of 3 points each. Among others, 4 centres observed a fall in index by 2 points and 6 centres recorded a decline of 1 point. Rest of 5 centres indices remained stationary.</p>



<p>The indices of 34 centres are above All-India Index and 44 centres indices are below national average.</p>



<p>The next issue of CPI-IW for the month of January 2020 will be released on Friday 28th February, 2020. The same will also be available on the office website <a href="http://www.labourbureaunew.gov.in/">labourbureaunew.gov.in</a>.</p>

<p>According to a press release issued by the Labor Office on 31.12.2019, the <strong>AICPIN </strong>(Consumer Price Index for Industrial Workers by 2001=100) for the month of November 2019 has been raised to 328 from the current level of 325.</p>

<p><strong>Consumer Price Index for Industrial Workers (CPI-1W) &#8211; November, 2019</strong></p>



<p>The All-India CPI-IW for November, 2019 increased by 3 points and pegged at 328 (three hundred and twenty eight). On 1-month percentage change, it increased by (+) 0.92 per cent between October and November, 2019 whereas no change observed during corresponding months of last year.<br /> The maximum upward pressure to the change in current index came from Food group contributing (+) 1.98 percentage points to the total change. At item level, Rice, Arhar Dal, Moong DaI, Urd Dal, Goat Meat, Poultry Chicken, Milk Cow, Garlic, Onion, Cabbage, Carrot, Green Coriander Leaves, Lady Finger, Potato, Hot Drink- Tea Readymade, Cooking Gas, Fire Wood. Etc. are responsible to the increase in index.</p>

<p>However, this increase was checked by Fish Fresh, Chillies Green, Ginger, Banana, Cauliflower, Coconut, French Beans, Gourd, Lemon, Orange, Peas, Radish, Tomato, Electricity Charges, Toilet Soap, etc., putting downward pressure on the index. Year-on-year inflation based on all-items stood at 8.61 per cent for November, 2019 as compared to 7.62 per cent for the previous month and 4.86 per cent during the corresponding month of the previous year. Similarly, Food inflation stood at 9.87 per cent against 8.60 per cent of the previous month and (-) 1.57 per cent during the corresponding month of an year ago.</p>



<p>At centre level, Rourkela observed the maximum increase of 14 points followed by Kodarma (12 points), Madurai (9 points) and Salem (8 points). Among others, 7 points increase was observed in 3 centres, 6 points in 4 centres, 5 points in 6 centres, 4 points in 7 centres, 3 points in 10 centres, 2 points in 11 centres and 1 point in 15 centres. On the contrary, Chhindwara and Kanpur recorded a maximum decrease of 3 points each followed by Ahmedabad and Jaipur (2 points each). Other 4 centres observed a fall in index by 1 point. Rest of 10 centres’ indices remained stationary. The indices of 31 centres are above All-India Index and 46 centres’ indices are below national average. The index of Warangal centre remained at par with All-India Index.</p>



<p>The next issue of CPI-IW the month of December, 2019 will be released on Friday 31st January. 2020. The same will also be available on the office website www.labourbureaunew.gov.in.</p>

<h4 class="wp-block-heading">DA Calculation January 2020 </h4>



<p>The index is an important element in the calculation of the percentage of the Dearness Allowance (DA) for government employees with effect from 1.1.2020. </p>



<p>In order to finalize the additional percentage of the Dearness Allowance (DA and DR) from January 2020 for <strong><a href="https://centralgovernmentnews.com/" target="_blank" rel="noreferrer noopener" aria-label=" (opens in a new tab)">CG employees</a></strong> and pensioners, AICPIN for 6 months from July to December 2019 is required. The data for the 5th month of November was released on 31.12.2019. </p>

<p><strong>Dearness Allowance calculation&#8217;s 3rd stage is over! Central Government Employees</strong></p>



<p><strong>What does Expected DA mean?</strong><br />The assumption on the Dearness Allowance calculation method. Twice a year, DA is given. So, it&#8217;s going to be revised once in six months. DA will be calculated according to CPI (IW) data every month. The percentage will be listed as additional DA without decimal at the end of each June and December.</p>



<p><strong>Expected DA January 2020</strong><br />There is a need for six months of CPI (IW) statistical data for 2001=100 from July to December 2019 to calculate the additional DA with effect from January 2020. The Labor Office today released the press release of the CPI (IW) for the month of September and the index is increased by two points from 320 to 322. This is the third stage in the &#8216;Expected DA January 2020 &#8216; process. The calculation for the months of July and August has already been completed.</p>



<p><strong>What is Expected DA Table’?</strong><br /> The expectation reflected in the table on the DA calculation process is &#8216; <strong><em>Expected DA Table</em></strong> &#8216;. Three table calculations are finalized in the specified tables and the other three table calculations are predicted. For the months of Oct, Nov and Dec 324, 326 and 328, we have given an imaginary CPI (IW) index.</p>

<p>Subject: <strong>Consumer Price Index for Industrial Workers (CPI-IW) – September, 2019</strong></p>



<p>The All-India CPI-IW for September, 2019 increased by 2 points and pegged at 322 (three hundred and twenty two). On 1-month percentage change, it increased by (+) 0.63 per cent between August, 2019 and September, 2019 which was static between the same two months a year back.</p>

<p>The maximum upward pressure to the change in current index came from Food group contributing (+) 2.20 percentage points to the total change. At item level, Rice, Wheat, Wheat Atta, Coconut Oil, Groundnut Oil, Goat Meat, Dairy Milk, Milk Buffallo, Milk Cow, Pure Ghee, Chillies Dry, Garlic, Onion, Brinjal, Cauliflower, Peas, Potato, Radish, Coconut, Lemon, Sugar, Cooking Gas, Soft Coke, Under Garments, Medicine (Allopathic), Petrol, etc. are responsible for the increase in index. However, this increase was checked by Ginger, Cabbage, Carrot, French Bean, Green Coriander Leaves, Tomato, Apple, Hair Oil, Toilet Soap, etc., putting downward pressure on the index.</p>



<p>The year-on-year inflation based on CPI-IW stood at 6.98 per cent for September, 2019 as compared to 6.31 per cent for the previous month and 5:61 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 7.05 per cent against 5.10 per cent of the previous month and 0.00 per cent during the corresponding month of the previous year.</p>



<p>At centre level Bokaro, Raniganj, Mumbai, Ahmedabad and Agra observed the maximum increase of 8 points each followed by Jalandhar (7 points) and Godavarikhani (6 points). Among others, 5 points increase was observed in 3 centres, 4 points in 10 centres, 3 points in 6 centres, 2 points in 11 centres and 1 point in 19 centres. On the contrary, Goa recorded a maximum decrease of 4 points followed by Chennai (3 points). Among others, 2 points decrease was observed in 2 centre and 1 point in 4 centres. Rest of the 14 centres’ indices remained stationary.</p>



<p>The indices of 31 centres are above All-India Index and 46 centres’ indices are below national average. The index of Ernakulam centre remained at par with All-India Index.</p>
