<h3 class="wp-block-heading">Subject: Productivity Linked Bonus for the Defence civilians employees of the Indian Navy for the financial year 2023-2024.</h3>



<p>Sir,</p>



<p>I am directed to refer to the Productivity Linked Bonus (PLB) Scheme circulated vide this Ministry’s letter No. F-24(9)/80/D(JCM), dated 28th September, 1983 as amended from time to time and to convey the sanction of the President to the payment of 40 days (forty days) wages as PLB for the financial year 2023-2024 to the eligible Defence civilian employees of the Indian Navy.</p>



<p>2. . The entitlement has been worked out on the basis of the working results for the financial year 2023-2024 in accordance with the agreed formula .</p>



<p>3. The PLB shall be paid to all eligible Gp.’B’ (Non-Gazetted) and Gp. ‘C’ civilian employees of Indian Navy who are covered under PLB Scheme for the Accounting Year 2023-2024. The calculation ceiling of Rs.7000/- (7000×40/30.4) and other terms and conditions of the PLB Scheme will remain unchanged.</p>



<p>4. Productivity Linked Bonus (PLB) to the casual labourer will be paid at the assumed wages of Rs.1200/-p.m. (1200×40/30.4) for the Accounting Year 2023-2024 . However, in cases where the actual wages fall below Rs.1200/- p.m., the amount will be calculated on the actual monthly wages . The other conditions remain unchanged .</p>



<p>5. The expenditure on this account will be debitable to Defence Service Estimates under respective Heads to which the pay and allowances of these employees are debited. The entire expenditure on the payment of PLB is to be met out of the sanctioned budget grant for the financial year 2024-2025, without any additionality.</p>



<p>6. This issues with the concurrence of the Ministry of Finance (Deptt. of Expenditure) conveyed vide their I.D. Note No 11.04/2020-E.III-A dated 01.11.2024 and MoD(Fin) ID Note No.28028/02/22 -AG/PD dated 01.11.2024 .</p>

<h2 class="wp-block-heading">ENTITLEMENT RULES FOR CASUALTY PENSION AND DISABILITY COMPENSATION AWARDS TO ARMED FORCES PERSONNEL, 2023</h2>



<p>1.&nbsp;<strong>Title</strong>. These Rules shall be called the Entitlement Rules for Casualty Pension and Disability Compensation Awards to Armed Forces Personnel, 2023 and supersedes the Entitlement Rules for Casualty Pensionary Awards to Armed Force Personnel, 2008.</p>



<p>2. (i) These Rules shall be read in conjunction with the following documents as amended from time to time: –</p>



<p>(a) Pension Regulations for the Army, 2008.<br />(b) Navy (Pension) Regulations, 1964.<br />(c) Pension Regulations for the Air Force, 1961.<br />(d) Guide to Medical Officers (Military Pension), 2023 and subsequent amendments, if any.<br />(e) Government of India, Ministry of Defence policy letters on the subject issued from time to time.</p>



<p>(ii)&nbsp;<strong>Superseding Clause</strong>. These Rules shall supersede all previous Entitlement Rules for Casualty Pensionary Awards to Armed Forces Personnel. Where any provision in these rules is found contrary to the provisions of any previously existing rules, regulations or policies, on the subject of Casualty Pensionary Awards, the provisions given in these rules shall take precedence.</p>



<h3 class="wp-block-heading"><strong>3. Extent of Application.</strong></h3>



<p>(a) These Rules shall apply to all Officers, JCOs, WOs, OR and equivalent ranks in other services including officers, JCOs, WOs and OR of the Territorial Army, when embodied, called out or attached as the case may be.<br />(b) These Rules do not apply in cases where disablement or death, on which the claim to casualty pensionary awards is based, took place</p>



<p>(i) During the period 3rd September, 1939 to 31st March, 1948, which will be dealt with in accordance with the entitlement criteria laid down in&nbsp;<strong>Annexure I</strong>: and</p>



<p>(ii) During the period of emergency post-1948 which will be dealt with in accordance with Annexure II to these Rules.</p>



<p>(c) Cases of death/ disablement of Cadets (Direct), due to causes attributable to or aggravated by military training shall be governed under the provisions contained in the Ministry of Defence letter No 1(5)/ 93/ D (Pen — C) dated 16th April, 1996, amended from time to time in so far as entitlement of ex-gratia is concerned. However, the claims for ex- gratia award shall be governed in accordance with these Rules. A copy of the letter dated 16th April 1996 is appended as Annexure III to these Rules.</p>



<p><strong>4. Definitions</strong>: Unless the context otherwise dictates, the following terms shall mean as under: –</p>



<p>(a)&nbsp;<strong>Categories of Disabilities.</strong>&nbsp;For the purpose of determining the casualty pension and disability compensation for death or disability which is attributable to or aggravated by military service, the circumstances shall be broadly classified from Category A — E as specified in Paragraph 4.1 of Government of India, Ministry of Defence Letter No 1 (2)/ 97/ D (Pen — C) dated 31 Jan 2001.</p>



<p>(b) <strong>Disability</strong>. ‘Disability’ means a condition of a person resulting in long term physical, mental, intellectual or sensory impairment which in interaction with barriers, hinders full and effective participation in society, equally with others. In respect of Armed Forces personnel, a ‘Disability’ also means a functional impairment that inhibits an individual from effectively discharging duties of a military nature or to be provided an alternate employment within the service, even though the individual may otherwise be fit to participate normally in civil society. Two such Illustrations (though not an exhaustive list of the same) could be as given below: –</p>



<p>(i) Amputation of the index finger of the dominant arm, thereby precluding operation of the trigger of a personal weapon.<br />(ii) Personnel affected with seizure, who cannot be issued weapons or detailed on sentry duties.</p>



<p>(c)&nbsp;<strong>Entitlement</strong>. Entitlement is the determination by the Competent/ Appellate Authority, after considering both medical and non-medical evidence, as to whether or not a wound. Injury or any bodily disability has been influenced in its onset or course by conditions of military service or is a War Injury. Disabilities that fall under Categories ‘B’, ‘C’, ‘D’ or ‘E’ are called “Accepted Disabilities” and those that fall under Category ‘A’ are ‘Rejected Disabilities’.</p>



<p>(d) <strong>Assessment</strong>. The term “assessment” defines the process of evaluating the functional impairment suffered by an individual following a disability or disabilities in terms of percentage, for the purpose of calculating disability compensation. Assessment shall be determined by the competent medical authority on the basis of a physical examination of the individual.</p>



<p>(e)&nbsp;<strong>Disability Pension</strong>. A Disability Pension is a monthly composite pension comprising of a Service Element and Disability Element, each calculated separately, as a defined percentage of the last reckonable emoluments. There shall be no condition of minimum qualifying service for earning Service Element.</p>



<p>(f)&nbsp;<strong>Liberalized Disability Pension</strong>. Liberalized Disability Pension is a monthly composite pension comprising of a Service Element and a Disability Element, each calculated separately, as a defined percentage of the last reckonable emoluments, where the aggregate of Service Element and Disability Element shall in no case be less than 80 per cent of the last reckonable emoluments.</p>



<p>(g)&nbsp;<strong>War Injury Pension</strong>. A War Injury Pension is a composite monthly pension comprising of a Service Element and a War Injury Element, each calculated separately, as a defined percentage of the last reckonable emoluments.</p>



<p>(h)&nbsp;<strong>Invalid Pension</strong>. Invalid Pension is a monthly pension equal to the Retiring Pension as on the date of invaliding out of service.</p>



<p>(i)&nbsp;<strong>Impairment Relief</strong>. Impairment Relief is a monthly disability compensation, Calculated as a defined percentage of the last reckonable emoluments, awarded to Armed Forces personnel who are retired or discharged from service voluntarily or otherwise with a disability sustained under circumstances accepted as Category ‘B’ or ‘C’ and assessed not less than 20 per cent. ‘Impairment Relief shall hereinafter replace the term ‘Disability Element’ in as far as disability compensation to Armed Forces personnel who are retired or discharged from service. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(j)&nbsp;<strong>Liberalized Impairment Relief</strong>. Liberalized Impairment Relief is a monthly disability compensation, calculated as a defined percentage of the last reckonable emoluments, awarded to Armed Forces personnel who are retired or discharged from service voluntarily or otherwise with a disability sustained under circumstances accepted as Category ‘D’ and assessed not less than 20 per cent. ‘Liberalized Impairment Relief shall hereinafter replace the term ‘Liberalized Disability Element’ in as far as disability compensation to Armed Forces personnel who are retired or discharged from service. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(k)&nbsp;<strong>War Injury Relief</strong>. War Injury Relief is a monthly disability compensation, calculated as a defined percentage of the last reckonable emoluments, awarded to Armed Forces personnel who are retired or discharged from service voluntarily or otherwise with a disability sustained under circumstances accepted as Category ‘E’ and assessed not less than 20 per cent. ‘War Injury Relief shall hereinafter replace the term ‘War Injury Element’ in as far as disability compensation to Armed Forces personnel who are retired or discharged from service. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(l) <strong>Constant Attendance Allowance</strong>. A Constant Attendance Allowance is a monthly allowance (revised from time to time), paid in addition to Disability Pension/ Liberalized Disability Pension/ War injury Pension or Impairment Relief/ Liberalized Impairment Relief/ War injury Relief, only to Armed Forces personnel whose degree of impairment has been assessed at 100 per cent. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(m)&nbsp;<strong>Capitalized Impairment Relief/ Liberalized Impairment Relief/ War Injury Relief.</strong>&nbsp;&nbsp;A Capitalized Impairment Relief/ Liberalized Impairment Relief/ War Injury Relief (to be hereinafter referred in short as ‘Capitalized Impairment Relief in these rules) is the commuted present value of the future payout of an accepted Impairment Relief/ Liberalized Impairment Relief/ War injury Relief calculated by adopting the current commutation tables. The provision of Broad Banding shall not apply for calculating the percentage of impairment for the award of ‘Capitalized Impairment Relief. The terms Capitalized Impairment Relief/ Liberalized Impairment Relief/ War Injury Relief shall replace the terms Lump-Sum Compensation in Lieu of Disability Element/ Liberalized Disability Element/ War injury Element.</p>



<p>(n)&nbsp;<strong>Special Family Pension</strong>. Special Family Pension is a monthly pension, calculated as a defined percentage of the last reckonable emoluments, awarded to the Next-of-Kin of an Armed Forces personnel whose death occurs in circumstances accepted as Category ‘B’ or ‘C’.</p>



<p>(0)&nbsp;<strong>Liberalized Family Pension</strong>. Liberalized Family Pension is a monthly pension, calculated as a defined percentage of the last reckonable emoluments, awarded to the Next-of-Kin of an Armed Forces personnel whose death occurs in circumstances accepted as Category ‘D’ or ‘E’.</p>



<p>(p)&nbsp;<strong>Ex-Gratia Lump Sum Compensation in Cases of Invalidment.</strong>&nbsp;A one-time Ex-Gratia Lump-Sum Compensation is paid to Armed Forces personnel who are invalided from service on account of a disability held attributable to or aggravated by military service or a war injury, at a fixed rate (that is revised from time to time) for 100 per cent impairment, to be proportionally reduced for lesser degree of impairment up to a minimum of 20 per cent. The provision of Broad Banding shall not apply for calculating the percentage of impairment for the award of Ex-Gratia Lump Sum Compensation.</p>



<p>(q)&nbsp;<strong>Ex-Gratia Lump-Sum compensation to Next-of-Kin of Deceased Armed&nbsp;</strong><strong>Forces&nbsp;Personnel.</strong>&nbsp;An Ex-Gratia Lump-Sum Compensation is paid to the Next-of-Kin of Armed Forces personnel who die under circumstances clearly specified in the relevant policy letter on this subject (duly amended from time to time), at rates specified against each circumstance (duly amended from time to time). However, the aggregate of all Government relief provided for the same circumstance of death of the Armed Forces personnel, shall not exceed a the specified maximum amount of Ex-Gratia Lump-Sum Compensation payable (duly amended from time to time)</p>



<p>(r)&nbsp;<strong>Monthly Ex-Gratia</strong>. Monthly Ex-Gratia is paid to Cadets who are invalided from military training at a monthly rate that is revised from time to time. This is not a pension and shall cease upon the demise of the recipient.</p>



<p>(s) <strong>Ex-Gratia Disability</strong>. Ex-Gratia Disability Award is paid to Cadets who are invalided from military training with a disability held attributable to or aggravated by military training, in addition to Monthly Ex-Gratia, at a monthly rate (that is revised from time to time) for 100 per cent impairment to be proportionally reduced for lesser degree of impairment up to a minimum of 20 per cent. This is not a pension and shall cease upon the demise of the recipient. The provision of Broad Banding shall not apply for calculating the percentage of impairment for the award of Ex-Gratia Disability Award.</p>



<h3 class="wp-block-heading">5.&nbsp;<strong>Invaliding from Service</strong>.</h3>



<p>(a) Invaliding out of service is a condition precedent to considering an individual’s case for the award of Disability Pension, subject to such disability being sustained under circumstances that is accepted by the Competent/ Appellate Authority as Category ‘B’ or ‘C’.</p>



<p>(b) Liberalized Disability Pension or War Injury Pension may be awarded if the impairment has been sustained under the circumstances that is accepted by the Competent/ Appellate Authority, as Category ‘D’ or ‘E’ respectively.</p>



<p>(c) Armed Forces personnel who are invalided out of service with a disability sustained under circumstances that is accepted by the Competent/ Appellate Authority as Category ‘A’ are eligible for the award of Invalid Pension, subject to their completing 10 years reckonable service or being declared medically unfit for service both in the military as well as civil.</p>



<p>(d) Only those Armed Forces personnel who are placed in medical classification SHAPE — 5 and boarded out of service by a Competent/ Appellate Authority on the recommendations of an Invaliding Medical Board, before completing their terms of engagement, shall be treated as invalided out of service.</p>



<p>(e) JCOs/WOs/ OR and equivalent rank in other services who are placed permanently in a medical category other than SHAPE — 1 or equivalent and are discharged because (i) no alternative employment suitable to their low medical category can be provided, or, (ii) they having been retained in alternative employment, are discharged before the completion of their engagement, shall be deemed to have been invalided out of service.</p>



<p>(f) Retired officers who are not granted re-employment or JCOs/ WOs/ OR who are not granted extension of service, beyond their prescribed term of engagement, for not meeting the laid down medical standards, shall not be deemed to have been invalided from service.</p>



<p>(g) Cadets whose training is terminated and who are boarded out on the orders of the Competent Authority, solely on account of a wound, injury or any medical condition shall also be deemed to have been invalided from military training.</p>

<h2 class="wp-block-heading">Outcome of the issues discussed in the Standing Committee meeting of the National Council &#8211; JCM held on 20/09/2023 under the Chairpersonship of Secretary (P) DOPT</h2>



<p>As already informed to you the meeting of the&nbsp;Standing Committee of National Council &#8211; JCM was held on 20/09/2023&nbsp;under the Chairpersonship of Secretary (P) DOPT. AIDEF was represented by Comrade C. Srikumar in the meeting. At the outset after the introductory remarks made by the Chairperson and before taking up the agenda points Staff Side raised the following important issues:-</p>



<p>1) More than 20 lakh Central Government Employees are in NPS. A huge rally on the 10th of August 2023 was held at Ramleela Maidan New Delhi in which more than 3 lakhs of Central &amp; State Government Employees participated demanding for Scrapping of the No Guarantee NPS and to restore the Defined and Guaranteed Old Pension Scheme. The Staff Side once again reiterates its demand that the NPS should be scrapped and the Old Pension Scheme should be restored at the earliest.</p>



<p>2) The office of the Staff Side is receiving innumerable representations on issues which can be sorted out at the Departmental Level itself. Since the Departmental Councils are not functioning and meetings are not taking place, all the issues are referred to our office and we are forced to bring all those issues to your notice. It is therefore essential that the Departmental Council &#8211; JCMs should meet regularly in accordance with the JCM scheme and regular meetings at the Departmental Level should be held with the Staff Side so that the National Council &#8211; JCM can concentrate on the common issues of Central Government employees.</p>



<p>This is a serious matter and hence DOPT may take up the matter with all the Secretaries of the various Ministries and Departments to ensure that the JCM functions effectively in accordance with the spirit of the JCM Scheme.</p>



<p>3) The Meeting of the National Council &#8211; JCM is also overdue. The last meeting of the National Council &#8211; JCM was held through video conference during 21/06/2021. We request the Cabinet Secretary through you that he may convene the meeting of the National Council JCM at the earliest.</p>



<p>4) Despite High Court orders upheld by Supreme Court for grant of 3 MACP nd in GP Rs 4600 to the Master craftsman of MOD who were given 2 ACP in the Grade pay of Rs.4200, the DOPT have advised the MOD to withdraw the same. All the concerned employees have retired long back and as per DOPT instructions there cannot be any recovery and as per CCS Pension Rules, Pension once fixed cannot be revised downwards other than on penalties moreover the DOPT Instructions to Defence Ministry amounts to contempt of Court.</p>



<p>Therefore DOPT may Direct MOD not to take any precipitative action in this regard. A copy of letter written by the AIDEF is this regard is being handed over to Secretary DOPT. The same may please be considered favorably.</p>



<p>5) Another matter of serious concerned is the non-implementation of the DOPT O M dated 02/03/2016 on the subject of recoveries of wrongful / excess payments by the employers impermissible in Law. According to this instruction any excess payment made to the employees due to the mistake of the administration and not because of any false claim by the employees the concerned department should process the case for waiver of recovery and get the approval of Department of expenditure. However in many field units / offices instead of following these guidelines recoveries of huge amount from the employees and retiring employees are being effected.</p>



<p>Therefore DOPT may issue strict instructions to all the departments to follow the DOPT O M date 02/03/2016 and not to recover any amount from the employees and retiring employees in accordance with the DOPT OM.</p>



<p>6) Department of Pension &amp; Pensioners Welfare have issue orders on 03/03/2023 for conversion of NPS employees to Old Pension Scheme if they were recruited on or after 01/01/2004 on the basis of the notification / Advertisement issued before 22/12/2003. Due to a confusion with regard to Notification and Advertisement the benefit of Old Pension Scheme is not being extended to the concerned employees. This needs to be clarified by the Department of Pension or DOPT.</p>



<p>It is proposed that the Notification letter issued by the concerned Ministry / Department / Field Units for recruitment of certain number of vacancies in different categories should be taken as the date of Notification since in many cases the advertisement by the DAVP in the employment News etc are delayed by months together. Moreover there are many issues which needs to be clarified since the field units are not implementing the Department of Pension order dated 03/03/2023. A separate meeting with the Staff Side may please be convened in this regard.</p>



<p>7) The Staff Side is repeatedly representing for releasing the 18 months frozen DA / DR arrears to the Central Government employees &amp; Pensioners. However till date a favorable decision is not taken by the Government. It is therefore requested that Government may reconsider the decision &amp; released DA/ DR Arrears due for 18 months as a Diwali gift.</p>



<p>8) Posts lying vacant in all the Central Government Departments should be filled up to stop outsourcing and contract etc.</p>



<p>Thereafter the following Agenda Points were taken up for discussion.&nbsp;Decision take on each of the agenda points is given below:-</p>

Extension of CGHS facilities to the Civilian Employees of left out Industrial Establishment under Western Command of Navy Mumbai.<br /></strong> <p class="schema-faq-answer"><strong>Decision</strong>: After discussion representative / senior officer from NHQ stated that the NHQ fully agree with the demand of the Staff Side and stated they have already recommended the case to Ministry of Health&amp; Family Welfare. Additional Secretary Assured that Health Ministry will consider the demand of the Staff Side and the recommendations of NHQ will issue necessary instructions in consultation with Department of Expenditure if required.</p> </div> <div class="schema-faq-section" id="faq-question-1695350426272"><strong class="schema-faq-question">2. Empanelment of Private Day Care Therapy Centers for Ayurveda, Yoga &amp; Naturopathy under CGHS in all the CGHS governed cities / towns<br /></strong> <p class="schema-faq-answer"><strong>Decision</strong>: Ministry of Health have already taken a decision to empanel private Health Care Organization of Ayurveda, Yoga and Naturopathy etc under CGHS if they apply for the same. Moreover Private day care therapy centers under Ayush is established at Delhi on a trial basis. After 6 months Ministry of Health will review the position and there after decision will be taken for extending the benefits for other cities / towns</p> </div> <div class="schema-faq-section" id="faq-question-1695350493444"><strong class="schema-faq-question">3. To retain the status of more than 70,000 Defence Civilian Employees who are on deemed deputation with the newly created 7 Ordnance Factory Corporations as Central Government Employees / Defence Civilian Employees till their Superannuation.<br /></strong> <p class="schema-faq-answer">Decision: The Staff Side informed about the harassment being faced by the employees of Ordnance Factories Post Corporatization. In violation of the Cabinet decision and the commitment given by the Government before the Hon’ble High Court, the 7 Corporations are tinkering with the service conditions of the employees like changing the working hours, implementing incentive scheme by replacing piece work system, not implementing he settlement reached between AIDEF and DDP in the presence of CLC on the formation of IR Machineries in the Corporations, Non Grant of Compassionate Appointments, and the DDPs apathy towards the employees, not holding of the meetings with the Federation etc.<br />Moreover now the Government have decided to merge Corporations and reduce to 4 Corporations. This has further created fear and apprehensions in the minds of the employees. We have decided to issue contempt of Court Notice to the Government and the Corporations for violation of the assurance given in the High Court. We demanded that the Government instead of extending the deemed deputation should issue a notification for retaining the status of employees as Central Government Employees / Defence Civilian employees till their retirement.<br />Responding to the views expressed by the Staff Side JS (LS ) from DDP informed that the corporations are making the HR Policies and option will be asked from the employees whether they would like to join the Corporations or they would like to remain as Government Employees.<br />Secretary DOPT directed JS (LS) DDP that the concerns expressed by the staff Side are serious and the same should be communicated to the Defence Secretary and meetings should be held with the Staff Side to settle the issues represented by them.</p> </div> <div class="schema-faq-section" id="faq-question-1695351077452"><strong class="schema-faq-question">4. Provision to book two rooms through e-Sampada Portal in CPWD Guest Houses / Holiday Homes</strong> <p class="schema-faq-answer">Decision: The demand will be examined by Ministry of Housing and Urban Affairs.</p> </div> <div class="schema-faq-section" id="faq-question-1695351413540"><strong class="schema-faq-question">5. Restoration of historic Pay-Parity between Income Tax Inspector and analogous posts in Department of Revenue and Inspector of CBI/ ACIO Gr.-I of IB</strong> <p class="schema-faq-answer">Decision: After discussion Secretary (P) desired that Department of Revenue should hold separate meeting with the Staff Side and explore the possibility of resolving the issue.</p> </div> <div class="schema-faq-section" id="faq-question-1695351456530"><strong class="schema-faq-question">6. Revision of Deposit linked Insurance Scheme under the GPF for Central Government Employees</strong> <p class="schema-faq-answer">Decision: We objected and protested against the decision taken by the Department of Expenditure to reject the demand. After discussion it was decided that the Department of Expenditure would reconsider its decision and the proposal of DOP&amp;PW to increase the Deposit Linked Insurance from GPF to Rs. 5 Lakh</p> </div> <div class="schema-faq-section" id="faq-question-1695353400192"><strong class="schema-faq-question">7. Revision of calculation Ceiling Limit of PLB and Ad hoc Bonus for the Central Government Employees</strong> <p class="schema-faq-answer">Decision: Bonus ceiling will be revised only if the Bonus Act is amended by the Labour Ministry. After discussion it was decided that a reference will be made to the Labour Ministry in this regard</p> </div> <div class="schema-faq-section" id="faq-question-1695353447699"><strong class="schema-faq-question">8. Restoration of festival advance to the Central Government Employees</strong> <p class="schema-faq-answer">Decision: After discussion Special Secretary Department of Expenditure stated the Government may consider for granting Rs 20,000 as festival advance to be recovered in 10 installments. The staff Side demanded the amount may be increased to Rs. 50,000. The Department of Expenditure will take a final decision in this regard.</p> </div> <div class="schema-faq-section" id="faq-question-1695353535607"><strong class="schema-faq-question">9. Stepping up of pay of seniors promoted prior to 31.12.2015 getting lesser basic pay than the juniors promoted after 01.01.2016</strong> <p class="schema-faq-answer">Decision: The Staff Side stated that since the Department of Expenditure have approved stepping up of pay on the above circumstances to the Armed Forces personnel there is no justification on the part of the Government to deny the same benefits to the Civilian Central Government employees. After discussion Special Secretary Department of Expenditure agreed to consider the demand.</p> </div> <div class="schema-faq-section" id="faq-question-1695353602404"><strong class="schema-faq-question">10. Extending the benefit of option to Central Government Employees to switch over to the 7th CPC Pay Scale from a date! beneficial to the employees and also for extending revised option for the employees who were given entry pay benefit on promotion in the 6th CPC Pay Scale to switch over to 6th CPC Pay Scale w.e.f.01.01.2006</strong> <p class="schema-faq-answer">Decision: After discussion Special Secretary Department of Expenditure th th agreed to consider the option period for switching over to 7 CPC up to 25 July 2017 from the date of promotion / MACP etc. As regards issuing a general Government order for extending option to the entry pay th beneficiaries on promotion to switch over to 6 CPC w.e.f. 01/01/2006 would be considered in consultation with the Government Department</p> </div> <div class="schema-faq-section" id="faq-question-1695353650423"><strong class="schema-faq-question">11. Subversion of JCM norms with misuse of CCS(RSA) Rules, 1993</strong> <p class="schema-faq-answer">Decision: The Staff Side demanded that the withdrawal of the recognition granted to the NFPE and AIPEU (Gr. C) should be reconsider and the recognition should be granted back. When the official side stated that the matter is sub-judice then the Staff Side is ready to withdraw the Court case if the Government agrees to restore the recognition. As regards the position in ISRO not recognizing the majority Association and dissolving of the JCM would be referred to ISRO to find out the position and thereafter the matter will be further discussed.</p> </div> <div class="schema-faq-section" id="faq-question-1695353690079"><strong class="schema-faq-question">12. Necessary clarification to ensure that the service Associations which are governed by the CCS (RSA) Rule 1993, are kept out of the purview of Rule 15 (1) (c)</strong> <p class="schema-faq-answer">Decision: The Staff Side insisted the DOPT should issue clarification that the DOPT instructions that no Government employee should hold elected office for more than 2 terms / 5 years is not applicable to service associations recognized under RSA Rules 1993 and to the cooperative societies which are register under the Government of India Cooperative Societies Act or under the respective State Government Cooperative Society Act. We also stated that employees are being illegally issued Show Cause Notices for initiating disciplinary action in the Navy on the above pretext.<br />Therefore the matter may be treated urgently and necessary clarification should be issued to avoid punitive actions against the office bearers of the Associations and elected Directors of the Cooperative Societies. Secretary DOPT assured that the entire matter would be reconsidered and necessary instructions would be issued.</p> </div> <div class="schema-faq-section" id="faq-question-1695353729644"><strong class="schema-faq-question">13. Extension of LTC-80 one time relaxation in the case of employees who availed LTC to Andaman &amp; Nicobar Island (A&amp;N) by purchasing air tickets from other than authorized agents</strong> <p class="schema-faq-answer">Decision: After discussion Secretary DOPT agreed to reconsider the demand of the Staff Side and assured a decision would be taken at the earliest.<br />Notional Increment to the employees retiring / retired on 30th of June and 31st of December While concluding the meeting the Staff Side requested Special Secretary Expenditure to issue Government orders for grant of Notional Increment to the employees retiring / retired on 30th of June and 31st of December. Special Secretary informed that the matter is under serious consideration and a decision would be taken soon.<br />As regards the Action Taken Reports on the Agenda Points of the previous meetings and the Arbitration Awards a separate meeting would be held with the Staff Side after 10tt of October 2023.</p> </div> </div>

<h3 class="wp-block-heading">UPGRADATION OF CLASS OF TRAVEL IN RESPECT OF CANDIDATES APPEARING FOR SSB INTERVIEW AND / OR MEDICAL EXAMINATION AND CANDIDATES SELECTED FOR PRECOMMISSIONING TRAINING</h3>



<p>Sir,</p>



<p>1. I am directed to convey the sanction of the Competent Authority to amend the following provisions as contained in the Travel Regulations &#8211; 2014:-</p>



<p><strong>FOR</strong></p>



<p><strong>192 (3)(a)(i)(a) Civilian candidates called up for interview and / or medical test will be entitled to the following allowances within Indian limits:</strong><br />(a) One second class single fare for a journey performed by rail or road mileage at the rate laid down in Rule 61 at par with individual drawing grade pay of, Rs 2400/- to Rs 2800/- for journeys performed by road from the normal place of residence to place of interview and / or medical examination and return where Government transport is not provided. Where considered necessary or advisable, &#8211; the authority calling up a candidate for interview may issue railway warrant by second class for the journey to be undertaken by the candidate. Such railway te warrants will be issued by the shortest route. No cash TA will be paid in addition.</p>



<p><strong>192(3)(b)&nbsp;Candidates selected to join the National Defence Academy,&nbsp;</strong><strong>Khadakvasla, OTA, Chennai / Gaya, IMA, Dehradun and Naval Academy,&nbsp;</strong><strong>Kochi will be provided with conveyance as under:</strong></p>



<p>(i) Civilian candidates will be issued with second class warrants, but if this is not possible for want of time, they will travel in second class at their own expense and Claim second class fare on arrival at the destination.</p>



<p><strong>192(4)</strong>&nbsp;TA to the extent laid down in clause (3) of this rule will be admissible to the following when called for interview / medical examination:-</p>



<p>(a) Engineering graduates and graduates in agriculture called for permanent / regular commission by Service Selection Board.<br />(b) Medical graduates for regular commission in AMC.<br />(c) Dental graduates for regular commission in Army Dental Corps.<br />(d) Veterinary graduates for permanent / regular commission in RVC.<br />(e) Cadets of Senior Division of Army Wing of NCC for grant of regular commission in the Army.<br />(f) Special entry cadets of the Indian Navy, cadets of Senior Division Naval Wing NCC and Dufferin cadets.<br />(g) Civilian candidates called up for recruitment in the Education Branch of Indian Navy.<br />(h) Candidates called for interview by Air Force Selection Board.<br />(j) Candidates for the regular commission in the Military Nursing Services.</p>



<p><strong>192-A&nbsp;The ex-JCOs and their equivalents in the Navy and Air Force&nbsp;</strong><strong>when called for interview by Deputy Director General, Defence Security Corps&nbsp;</strong><strong>for selection as JCOs in Defence Security Corps will be entitled to:</strong></p>



<p>(a) Free return second class railway warrants within Indian limits.</p>



<p><strong>193 Conveyance to Recruits, Combatants and Non-Combatants (enrolled)</strong></p>



<p>(d) Candidates when called up for interview and medical examination for recruitment as Airman will be entitled to the following TA:</p>



<p>(i) Rail fare by second class from place of residence in India to the place of interview and back. If the placed are not connected by rail, actual bus fare will be admissible.</p>



<p><strong>194&nbsp;Travelling Allowance to individuals accepted as a candidate for direct&nbsp;</strong><strong>commission in the rank of JCO</strong></p>



<p>An individual accepted as a candidate for direct commission in the rank of JCO and ordered to join with a view to his nomination for a direct commission in entitled to 2nd class rail fare from home to the station where the unit is located. Road Mileage. Allowance at prescribed rate is admissible in respect of journeys by road if the placed are not connected by rail.</p>



<p><strong>196&nbsp;Conveyance to Ordnance Factories Personnel when called for interview&nbsp;</strong><strong>/ selection<br /></strong>Personnel of the Ordnance Factories, when permitted compete with outsiders for appointments in any posts in the ordinance factories and called for interview by a Selection Committee, will be granted 2nd Class rail fare.</p>



<p><strong>197&nbsp;Conveyance to Personnel for Scientific / Technical posts in Defence&nbsp;</strong><strong>Production / Inspection and R&amp;D Organisation</strong></p>



<p>Candidates called for interview in connection with appointment to Scientific / Technical posts | Establishments / Laboratories under the Defence Producation / Inspection Organisation, Research and Development Organization / Director General of Ordnance factory Organization, will be granted 2nd class railway fare from their normal place of residence to the place of interview and back When return tickets at concessional fare are available under the Railway Rules in force at the time of travel, reimbursement will be restricted to the actual cost of return ticket.</p>



<p><strong>198&nbsp;Travelling Allowance to Scheduled Castes / Tribes / Disabled Ex-</strong><strong>Service Personnel when called up for Interview / Written test for group ‘C’&nbsp;</strong><strong>post</strong></p>



<p>(i) Scheduled Castes / Tribes candidates and disabled ex-Servicemen when called for interview / written tests for appointment to Group ‘C’ advertised posts, recruitment to which is made departmentally i.e. otherwise than through the UPSC., either direct or through employment exchange the recruiting authority may allow such candidates 2nd class rail fares by the shortest route from the Railway Station nearest to their normal place of residence, or from which they normally perform the journey whichever is nearer to the place of interview and back to the same station provides the distance travelled by rail each way exceeds eighty kilometers. No extra charges, if any incurred for reserving seat / sleeping berth in the train will however, be reimbursed to the candidates.</p>



<p><strong>READ</strong></p>

Such railway warrants will be issued by the shortest route. No cash TA will be paid in addition.</p>

<p>I am directed to invite attention to MoD fetter No. 1(20)/2017/ D(Pav/Services) -Part-1 dated 2.112020 and 1(4)/2021/D (Pay/ Services) dated 04.06.2021 on the above subject.</p>



<p>2. Enclosed herewith is the Ministry of Finance, Department of Expenditure (E.III.A Branch) OM No 04-21/ 2017-IC/E.III.A dated 04 July 2023 and to say that the provisions therein, will be applicable mutatis-mutandis to the Defence Services Officers and JCO/OR and equivalent provided all the conditions and stipulations laid down therein are strictly fulfilled.</p>



<p>3. The employees to exercise; re-exercise option for pay fixation as allowed under MoF OM dated 28.11.2019 within three months from date of issue of this letter.</p>



<p>4. All other conditions of MoD Letter No. (20) / 2017/ D(Pay Services) Part-1 dated 2.11.2020 remain unchanged.</p>



<p>3. This issues with the concurrence of Ministry of Defence (Finance) vide their <strong>Dy. No. 1(8)/2017/ AG/125-PA</strong> dated <strong>16.08.2023.</strong></p>

<h3 class="wp-block-heading">Subject: Grant of House Building advance to Defence Service Personnel (Army, Navy and Air Force) &#8211; regarding.</h3>



<p>Sir,</p>



<p>In supersession of this Ministry’s letter No. 15(1)/2009/D(Pay/ Services) dated 24-07-2009, I am directed to say that the President has pleased to decide that the Defence personnel may be granted House building Advance under the House Building Advance Rules promulgated by the Ministry of Housing &amp; Urban Affairs vide OM No. 1.17011/11(4)/2016-H-III dated 09-11-2017 as amended from time to time. After considering the recommendations of the 7th CPC and other relevant factors the President is pleased to liberalise further the existing scheme of <a href="https://centralgovernmentnews.com/tag/house-building-advance/" target="_blank" rel="noreferrer noopener">House Building Advance</a>, as below:-</p>



<p>(a) 34 months’ basic pay subject to a maximum of ₹7 lakhs only (Rupees Seven lakhs), or cost of the house/ flat, or the amount according to repaying capacity, whichever is the least for construction/ purchase of new house/ flat.</p>



<p>(b) For expansion of existing house, the amount of HBA will be limited to 34 months’ basic pay subject to maximum of 6.00 lakhs only (Rupees Six lakhs), or &nbsp;the cost of the expansion, or the amount according to repaying capacity, whichever is the least.</p>



<p>(c) Cost of the house to be built/ purchased (excluding the cost of plot) should not exceed 139 times of the basic pay of the employee subject to a maximum of 60 lakhs (Rupees Sixty lakhs) only. If the Head of the Department (HOD) is satisfied on the merits of the case, the cost ceiling may be relaxed up to a maximum of 25%. HOD means Adjutant General/ Chief of Logistics/ Air Officer-in-Charge Administration, as the case may be.</p>



<p><strong>2. Repayment Capacity:</strong> &#8211; For the purpose of calculating the admissible loan amount, the repayment capacity of the central government employee shall be calculated as below: –</p>



<figure class="wp-block-table"><table><tbody><tr><td>(a)</td><td>In case of employee retiring after 20 years.</td><td>40% of basic pay</td></tr><tr><td>(b)</td><td>In cases of employee retiring after 10 years but not later than 20 years.</td><td>Up to 40% of basic pay, 65% of DCR Gratuity may also be adjusted</td></tr><tr><td>(c)</td><td>In cases of employee retiring within 10 years.</td><td>Up to 50% of basic pay DCR Gratuity up to 75% can be adjusted.</td></tr></tbody></table></figure>



<p><strong>3. Applicable Rate of Interest and Methodology of Recovery of House Building Advance: </strong>&#8211;</p>



<p>(a) The Interest on Housing Building Advance for the financial year 2017-18 onwards shall be 8.50%. This shall be reviewed every three years to be notified In consultation with Ministry of Finance.</p>



<p>(b) The methodology of recovery of HBA shall continue as per the existing pattern of recovery of principal first in the first fifteen years in not more than 180 monthly instalments and interest thereafter in next five years in not more than 60 monthly instalments. The advance carries simple interest from the date of payment of first instalment.</p>



<p>(c) All cases of subsequent tranches/ instalment of HBA being taken by the employee in different financial years shall be governed by the applicable rate of interest in the year in which the HBA was sanctioned, in the event of change in the rate of interest.</p>



<p><strong>Note</strong>: The clause of adding a higher rate of interest at 2.5% (two point five percent) above the prescribed rate during sanction of House Building Advance, as reproduced below, stands withdrawn.</p>



<p><em>“Sanction should stipulate the interest 2.5% over and above the scheduled rates with the stipulation that, if conditions attached to the sanction including those relating to the recovery of amount are fulfilled completely to the satisfaction of competent authority, a rebate on interest of the extent of 2.5% will be allowed”</em></p>



<p><strong>4. Disbursement: :</strong></p>



<p>(a) Advance for purchase of ready built house can be paid in one lump sum as soon as the applicant executes an agreement in the prescribed form. The employee should ensure that the house Is purchased and mortgaged to the Government within 3 months of drawl of the advances.</p>



<p>(b) Advance for purchase/ construction of new flat may be paid either in one lump sum or in convenient instalments at the discretion of the Head of Department. The employee should execute the agreement in prescribed form before the advance’ first instalment of advance is paid to him/ her. The amount drawn by the&nbsp;employee should be utilized for the purchase/ construction of the flat within one month.</p>



<p>(c) Advance for construction/ expansion of living accommodation, etc. shall be payable in two instalments of 50% each. The first instalment will be paid after the olot and proposed house/ existing house is mortgaged and the balance on the construction-reaching plinth level.</p>



<p>(d) Advance for expansion to be carried out on the upper storey of the house will be disbursed in two instalments, first instalment on executing the mortgage deed and the second instalment on the construction reaching roof-level.</p>



<p>(e) In the case of advance for purchase of plot and construction of house, the advance will be disbursed as below: &#8211;</p>



<ol class="wp-block-list">
<li><strong>Single Storeyed House: After</strong>&nbsp;agreement in prescribed form is executed on production of surety bond, 40% of the advance OF actual cost will be disbursed for purchase of plot. The balance amount will be disbursed in two equal instalments, first after the mortgage is executed and second on the construction reaching plinth level.</li>



<li><strong>Double Storeyed House</strong>: 20% of advance for cost of plot will be disbursed on executing the agreement. The balance amount will be disbursed in two equal instalments, the first on executing the mortgage deed and the second on construction reaching plinth level.</li>
</ol>



<p><strong>5. Mortgage and Creation of Second Charge: –</strong></p>



<p>(a) House shall be mortgaged on the behalf of President of India. However, the employee, if he wishes to take a second charge to meet the balance cost of the house/ plot or flat from recognized financial institutions, then he/ she May declare the same and apply for NOC at the time of the applying for HBA. NOC for second charge will be given along with sanction order of HBA. The total loan from HBA and from all other sources cannot be beyond ceiling cost of the house as defined under para 1 (c) above.</p>



<p>(b) In case if HBA is availed by both husband/ wife jointly,</p>



<ul class="wp-block-list">
<li>HBA Mortgage paper, insurance paper and other papers regarding property shall be submitted to one of the loan sanctioning authorities of their choice.</li>



<li>A No Objection Certificate may be obtained from the 2nd loan sanctioning authority.</li>



<li>The property mortgaged to behalf of President of India, shall be reconvened on the prescribed form to the central government employee concerned (or their successors in interest, as the case may be), after the advance together with interest thereon, has been repaid to Government in full and after obtaining No Demand Certificate in respect of HBA loan sanctioned by the 2″ loan sanctioning authority.</li>
</ul>



<p><strong>6. Insurance: –</strong></p>



<p>(a) immediately on completion of construction/ purchase of house/ flat, the employee shall insure the house with the recognized institutions as approved by&nbsp;<strong>Insurance Regulatory and Development Authority (IRDA)</strong>, for not less than the amount of advance and shall keep it so insured against damage by fire, flood and lightning till the advance together with interest thereon is repaid in full and deposit the policy documents with the Head of the Department (HOD). Renewal of insurance will be done every year and premium receipts produced for inspection of the HoD regularly.</p>



<p>(b) Penal interest of 2% over and above existing rate of interest will be recovered from the employee for those periods which are not covered by Insurance of the house.</p>



<p><strong>7. Extant Rules:</strong> &#8211; Apart from above stated changes in relevant sections in the earlier version of House Building Advance rules, all other extant rules, terms and conditions of HBA will be applicable as prescribed under Ministry of Defence letter No.15(1)/99/D(Pay! Services) dated 16-04-1999 and 45(1)/2009/D (Pay/ Services) dated 24-07-2009 as amended from time to time shall continue to apply till further orders.</p>



<p>8. This letter issues with the approval of M/o Finance (Department of Expenditure) vide their I.D. No. 12(01)/2020/E.11.A dated 05.06.2023 and with the concurrence of Ministry of Defence (Finance) vide |. D. No. 3(2)2018-AG/PA/25-PA dated 07 June 2023.</p>

<h3 class="wp-block-heading">Subject : Clarification regarding admissibility of Night Duty Allowance to FED re-designated to Station Officer.</h3>



<p>Night Duty Allowance was admissible to the Fire Fighting staff as per list of categories identified for grant of NDA in accordance to the MoD OM dated 15.03.1990 (copy enclosed). It is pertinent to mention here that among the list of staff identified FED ‘B’ Fire Supervisors have been re-designated to the post of Station Officer with a revised pay level Gand GP 2800 / –</p>



<p>Further, as per DoPT OM No. A-27016/02/ 2017-Estt (AL) dated 13.07.2020. the ceiling of Basic Pay for entitlement of NDA has been upgraded to Rs.43600/- per month.</p>



<p>Since, the list of categories has not been revised w.r.t admissibility of NDA to the Fire Fighting Staff who have been re-designated to the post of Station Officer, it is difficult to conclude whether Station Officer is eligible to get NDA or not.</p>



<p>In view of the above, your views and practice followed in r/o grant of Night Duty Allowance to fire fighting staff ( FED ‘B’) re-designated to Station Officer may please be furnished to this office within 15 days for our better appreciation and enabling this office for further necessary action on the subject matter.</p>

<p><strong>Subject: Regulation of payment of Dress Allowance to the Armed Forces personnel joining service after 1st July of a year &#8211; regarding.</strong></p>



<p>1. In continuation of this Ministry’s letter no. 1(4)/2019-D (Pay/Services) dated 01.09.2022 on  he above subject, the Govt has decided that the rate of Dress allowance in respect of Armed Forces personnel joining service after 1st July of a year, shall be as follows:</p>



<p>(a) Rate of Dress allowance:</p>

<p>(b) The amount of Dress Allowance shall be credited to Armed Forces personnel’s account directly in the month of July. The disbursement of the payment of Dress Allowance has been explained below with an example:</p>

<p><strong>* Formula for proportionate payment of Dress Allowance is:-</strong></p>



<p>(Amount/12) x No. of months (Date of commission in case of Officer/ MNS Officers Or from date of reporting to Units in case of JCOs/OR till month of June of the following year)</p>



<p>2. These orders shall be effective from date of issue of this letter.</p>



<p>3. This issues with the concurrence of Finance Division of this Ministry vide their 1.D. No. 110/ AG/ PD/ 2023 dated 22/05/2023 of RF No. 2(7)/2017-AG/PD.</p>
