Sub: Submission of Annual Life Certificate by the Pensioners / Family Pensioners – Reg.

I would like to bring to your kind notice that the Pr. CCA T.N. Circle issued a notification today (06.10.2023) to hold a Mela for Life Certificate in CCA Office in Chennai for those pensioners / Family Pensioners whose LC expired on 30.09.2023 and earlier. This is not constrained to the pensioners residing in and around Chennai & City Suburban. It is for the pensioners/ Family pensioners of the entire circle from Chennai to Kanyakumari.

Hither to the life certificate was given in the month of November each year as per para 15.1 and 15.2 of Scheme for payment of pension to Central Government Civil Pensioner through Authorised banks. The Post Offices also were following the same procedure and there was no complaint of Non-drawal of Pension / FP for want of LC. The Dept. of Telecom has introduced a portal called “Jeevan Pramaan” and asked the DOT/BSNL Pensioners / Family Pensioners to submit LC digitally on this portal. For doing this the following documents are compulsorily required.

1) Aadhar Card Copy
2) PPO Copy (First Page with Name & PPO details)
3) PAN Card Copy
4) Filled in LC Form.

Actually when the pensioners / Family pensioners try to give digital life certificate it is not updating the Jeevan Pramaan software due to some differences in the name and other details of the pensioners, particularly family pensioners. At the time of issue of Aadhaar card initially the name of the family pensioners i.e. widows are noted with the name of their husband’s name or father’s name as surname. This is not tallying with the name in the PPO where only the name of the widow or divorced, daughter etc are available without any surname. Because of this difference the LC is not updated n the Pramaan Software leading to the stoppage of drawal of FP to the Family pensioners. Further many of the centers are not clearly aware of the procedure for printing life certificate properly. Thus the family pensioners are suffering a lot due to non-drawal of FP for want of LC. It may please be noted that the Dept. of Pension and Pensioners welfare has prescribed so many procedures for submission of Life Certificate by giving a list of persons specified for signing the LC as per para 14.3 of Scheme Booklet by CPAO. This has been followed by the pensioners and family pensioners hither to without any problem.

Only after the migration of the drawal of pension and FP from various Banks / Post offices to CCA Offices the pensioners and family pensioners are suffering a lot due to stoppage of drawal of pension / FP due to non receipt of LC or not updating the LC in the Sampan software. This Association therefore request the CGCA and the DOT to kindly continue to hold the old practice on submission of LC singed by various authorities as usual. Such life certificates may be accepted and updated by engaging separate staff in the CCA offices. This work will be only for two or three months i.e. November, December and if necessary for January also in the CCA offices. It may be noted that many pension disbursing authorities are still following the existing methods also in the matter of life certificate.

In the above instant case of T.N. Circle it is highly impossible to pensioners /  family pensioners to travel long distance of about 700 kms from Kanyakumari to Chennai to give life certificates. Such Melas may be conducted in all SSAs in the General Managers offices. It is also suggested that all the existing pensioners / family pensioners have already submitted LC during November 2022 in the Banks and Post officers, and therefore they may be allowed to submit the same again in November. All Pensioners / family pensioners may be allowed to submit LC in the month of November only by whatever means possible to them instead of Sampann procedure being introduced by the Dept. of Telecom as its own to avoid hardship to the Pensioners / family pensioners.

OFFICE MEMORANDUM

Subject: CGHS facilities to the retired BSNL/MTNL employees (Combined Service Pensioners) who are in receipt of pension from Central Civil Estimates – Revised mapping for determining CGHS subscription and Ward entitlement.

The undersigned is directed to refer to this Office Memorandum No. 4-12(12)/2018-PAT-Part(1) dated 01.07.2019 on above subject vide which the revised mapping of IDA and CDA pay scales was issued for deciding the rate of monthly CGHS contribution and entitlement of wards in private hospitals empanelled under CGHS in respect of retired BSNL /MTNL employees who receive pension from Central Civil Estimates and avail CGHS facilities.

2. The entitlement of wards in Private Hospitals empanelled under CGHS has been revised e.f. 28.10.2022 by Ministry of Health & Family Welfare vide its O.M. No. S.11011/11/ 2016-CGHS(P) /EHS dated 28.10.2022. This has necessitated corresponding modification in Annexure-8 of the said O.M. dated 01.07.2019 .

3. Accordingly, Annexures to the said M. dated 01.07.2019 stands modified w.e.f . 28.10.2022, as enclosed.

4. This M. and mapping is applicable only for the Combined Service Optees who retired from BSNL/ MTNL with IDA pay scale.

5. This M. and mapping is not applicable for pro-rata pensioners who retired from DoT under CDA pay scale. Also, as per guidelines issued from Directorate of CGHS, MoH&FW, ward entitlement is based on the last basic pay and CGHS subscription is based on the pay scale as mentioned in the Pension Payment Order (PPO) of a particular retiree. Accordingly, ward entitlement and CGHS subscription in case of pro-rata pensioners of BSNL/MTNL will continue to be decided based on last pay drawn in DoT before absorption, as mentioned in their respective PPO while retiring from DoT, Govt. of India as already conveyed vide this office O.M. No. 4-12(12)/2018- PAT dated 08.09.2021. Hence, no mapping of IDA/ CDA scale is required in case of pro-rata pensioners.

Subject: Scheme for compassionate appointment – Other Policy Decisions.

The undersigned is directed to refer to the subject cited above and to state that the following decisions relating to appointment on compassionate appointment ground in Department of Telecommunications has been taken, which are mentioned below:-

i) The following offices of Department of Telecommunications are grouped for the purposes of processing of compassionate appointment applications/cases, as mentioned underneath:-

• In case of pending cases in Block 2 that are awaiting appointment only due to non-availability of vacancies (vacancy means 5% of Direct Recruitment in Group ‘C’ vacancies for the year), then Block 3 will be approached (through O/o CGCA Hqrs) and the case may be considered based on relative merit score and availability of vacancies in CCA units.
• In case of unfilled vacancy on compassionate ground in a particular year (ending on 31st December of the year) due to unavailability of eligible candidates, CGCA/WMO shall report such vacancy to DoT HQ.

ii). Cut-off date/validity period may be regulated as follows: –

• Applications to be considered: Application for compassionate appointment received upto 31st December for appointment cycle in respect of death-in-harness or retirement on medical grounds of Government servant upto 31st December for appointment cycle may be considered in the cycle beginning on 1st January of the subsequent year.
• Validity of application – DoPT instructions regarding the same may be followed; as on date the instructions of DoPT provides for considering the applications for compassionate appointments without any time limit.
• Calculation of vacancies – Cumulative unfilled vacancies upto 31st December for appointment cycle beginning on 1st January of the subsequent year may be included.

2. Relative Merit Point Scheme issued vide OM of even no. dated 01 July, 2022 shall be followed by all DoT units.

Subject: Issue of life time CGHS Card to BSNL pensioners.

The matter regarding issue of life time CGHS card to BSNL pensioners who had deposited CGHS contribution before switching over to the health scheme of BSNL and are desirous of switching over again to CGHS was under examination in the Ministry for quite some time past.

2. It has now been decided that BSNL pensioners who draw their pension from Central Civil Estimates are entitled for CGHS facilities. In case of their switch over again to CGHS from the health scheme of BSNL, they are required to pay subscription at the prevalent rates only for the balance period for life time membership i.e. the number of years for which subscription was already paid by them to CGHS before being switched over to BSNL health scheme, will be deducted from the ten-year subscription period. However, the option of payment of subscription at prevalent rate on annual basis will continue to be available to them for the balance period and the life time CGHS card will be issued on completion of payment of subscription for the total period of ten years.

Sub: Online recording of Annual Performance Appraisal Report (APAR) on SPARROW Portal for all IP&TAFS Group ‘A’ Officers for the Reporting Year 2021-22-reg.

The undersigned is directed to refer to this office O.M. of even no. dated 11.03.2022 on the subject cited above. It has been observed that timelines circulated vide O.M. dated 11.03.2022 for recording of PARs i.e. self appraisal by Officers Reported Upon (ORUs) and further recording of PARs by Reporting, Reviewing and Accepting Authorities are not being adhered to.

2. The last date for submission of self-appraisal to the Reporting Officer is 15.04.2022. A no. of. IP&TAFS Group ‘A’ officers (as per list attached) have not yet submitted their self-appraisal to their respective Reporting Officers and e-APARs are still pending at the level of ORUs.

3. All IP&TAFS Officers who have not submitted their self-appraisal to their respective Reporting Officers, are requested to forward their self appraisal to Reporting Officers within a week of issue of this O.M. failing which e-PARs will be force forwarded to the respective Reporting Officer for recording their comments.

4. In order to give effect to the time bound recording of PARs, all IP&TAFS officers are requested to ensure that the timelines for recording of PAR at each level circulated vide O.M. dated 11.03.2022 are strictly adhered to failing which PARs will be auto forwarded / force forwarded to the next level.

5. lt is requested to bring to the notice of all concerned the above instructions for strict compliance to ensure recording of PARs in time bound manner as per stipulated timelines.

At the outset, Sr. GM(SR) welcomed the worthy Chairman and all the esteemed participants from management and staff side. It was informed that in the first meeting held on 18.11.2021, the staff side had requested the management side to present a draft proposal in the next meeting for further discussions. The proposal had been drafted and a power point presentation of new scales was shared /discussed.

2.0 Discussions.

2.1 Broad Principles.

At present there are total 33048 non-executive employees comprising of 18553 absorbed employees & 14495 BSNL recruitees and around 30% employees are stagnating.

It was explained to the staff side that new Pay scales have been designed on the following principles:

(1) There is no reduction in the Pay (basic+DA) of any employee after implementation of new pay scales.

(2) Stagnation in the existing pay scales has been largely addressed.

(3) As pension contribution is linked to the maximum of the Pay scale, the new Pay scales have been designed optimally to minimise increase in Pension contribution.

(4) Financial burden has to be minimum so as to make the Proposal viable, as any additional financial burden is to be met only from internal resources of the company.

2.2 Multiplication Factors and Span.

a) It was informed that the Pay scales in 2007 were designed as per details given below:

• Multiplication factor of 1.91 to 1.94 was used for the minimum of the pay scale.
• Multiplication factor of 2.30 to 2.53 was used for the maximum of the pay scale.
• Span of scale was 18 Stages.

b) New pay scales proposed by the management side notionally w.e.f from 1.1.2017 are designed as below:

• Multiplication factor of 2.20 to 2.24 has been used for the minimum of the pay scale.
• Multiplication factor of 2.33 to 2.62 has been used for maximum of pay scale.
• Span of pay scale is from 20-28 stages.

2.3 Financial Impact

Staff side was informed that:

a) New pay scales have been designed to take care of Stagnation issue and BSNL recruitees will get additional benefit on account of increase in EPF contribution by BSNL.

b) The implementation of new Pay scales will result in an additional burden of increased pension contribution in case of absorbees and increased EPF contribution in case of Direct Recruitees.

c) There are a number of CPSUs which are loss making and the government has to decide in totality. Whatever Proposal Joint Committee recommends, should be with minimum financial implication.

d) Feedback was sought from staff side on following points:

1. Will implementation of new pay scale result in any anamolous situation where pay in new pay scales is less than pay in old pay scales?
2. Will new pay scale remove stagnation in majority of the cases?

2.4 Staff side comments.

The Staff side agreed to examine the draft pay scales proposed by the Management and to discuss in the next meeting. However, they stated that:

• Incase of Executive’s 3th PRC, new pay scales have been fixed by DPE and which cannot be changed. Whereas in case of Non-Executives. already negotiated scales in the earlier held meetings are being proposed to be changed and this will have long term effect on the next pay revision due in 2027.
• The new pay scales should be designed considering Five Percent fitment instead of Zero percent.

3.0 Conclusion.

The management suggested that the staff side can send suggestions/proposals based on the actual Stagnation/pay anomaly cases of the employees for further discussion. The meeting closed with a vote of thanks to the chair, all the participants and to the SR Cell team.

Sub: Requesting to settle the Wage Revision with 5% fitment – req.

We wish to bring the following to your kind notice for favour of information and necessary action.As you are aware, the AUAB had organised a number of struggles, including the 3 day strike organised in February, 2021, demanding settlement of the Wage Revision issue. However, despite the best efforts taken by the AUAB, the issue is not settled. Further, you are also aware that a large number of employees are suffering from stagnation. All the efforts taken by the unions and associations have also not resolved this problem.

It was under these circumstances that, in the meeting held on 27.10.2021, between the CMD BSNL and the AUAB, a suggestion was made by the unions and associations to settle the Wage Revision with 0% fitment. This proposal was made by the AUAB, keeping in view, the sufferings being faced by a large number of employees, due to stagnation. There can be no two opinions that, Wage Revision is the only way out to settle the issue of stagnation.

In the first meeting of the Reconstituted Wage Negotiating Committee, held on 18.11.2021, the Staff Side requested the Management Side to furnish the details of the employees suffering from stagnation. The Management Side came out with these information in the second meeting of the Committee, held on 03.12.2021.

From the information furnished by the Management Side, it is observed that, out of the total 33,000 Non-Executives, only around 9,000 Non-Executives are suffering from stagnation, including those who will be affected by this problem in the next one year. As can be seen from the data, presently, only less than one third of the Non-Executives are affected by stagnation. This is due to the fact that, a large number of Non-Executives who were affected with stagnation, had already retired under the VRS-2019.

In this scenario, if the Wage Revision of the Non-Executives is settled with 0% fitment, two thirds of the Non-Executives will not be benefited. Hence, this issue was discussed in a threadbare manner in the Central Executive Committee Meeting of BSNLEU, held online on 22.12.2021. After detailed discussion, the meeting took the unanimous decision, to request the Management to settle the Wage Revision of the Non-Executives with at least with 5% fitment.

The Wage Negotiating Committee meeting, scheduled to be held on 19.01.2022, has been postponed. As the third wave of the COVID-19 is spreading rapidly now, it will not be possible to hold a physical meeting of the Wage Negotiating Committee at least for the next few weeks. In view of this, we request you to kindly consider to hold the Wage Negotiating Committee meeting online, at the earliest.
